CONDITIONAL USE PERMIT (CUP) 2018-00012 APPLICANT: Leanne & Carlos Herrera 434 EI Camino Real Tustin, CA 92780 PROPERTY OWNER: Margaret Pottenger PO Box 1946 Tustin, CA 92782 LOCATION: 434 EI Camino Real REQUEST: A request to establish an Alcoholic Beverage Sales (ABC) establishment in conjunction with an existing delicatessen/cafe at 434 EI Camino Real. ENVIRONMENTAL STATUS: This project is categorically exempt pursuant to the California Environmental Quality Act (CEQA) Section 15301, Class 1. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 18-006 approving Conditional Use Permit (CUP) 2018-00012 to authorize on-site beer and wine sales (ABC License Type 41) in conjunction with a delicatessen/cafe and existing outdoor seating area at 434 EI Camino Real. It was noted there were several members of the public in attendance for this item. They were all in support of the item. The applicants, Leanne & Carlos Herrera, were present. Zoning Action Minutes October 16, 2018 Page 2 The Zoning Administrator stated she had reviewed the staff report and did not need a presentation. The Zoning Administrator opened the Public Comments Section of the Public Hearing at 10:05 a.m. Mrs. Herrera thanked the supporters who attended the hearing and voiced her good intentions with the ABC license and the use at her establishment. The Zoning Administrator asked Mrs. Herrera if she had the opportunity to review ZAA 18-006, including the Conditions of Approval and the amendment made to Section No. 4 of ZAA 18-006. Mrs. Herrera reviewed the Conditions of Approval, along with the amendment and she had no concerns. The Zoning Administrator closed the Public Comments Section at 10:06 a.m. The Zoning Administrator adopted ZAA 18-006, as amended. With regards to the letter received earlier that morning from Mr. Joseph Leaman- Prescott and Maureen Leaman, addressing their concerns (i.e. hours of operation, bottle disposal noise, and the possibility of the tea shop converting to a bar) City staff did not propose modifying the Conditions of Approval, per the Zoning Administrator. She referred to the Tustin City Code Section 9294a regarding the appeal process. The Public Hearing item was closed at 10:07 a.m. REGULAR BUSINESS: None ADJOURNMENT: 10:11 a.m. The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
