to include a definition, development' standards and design review criteria for
accessory structures. The project is located west of Tustin Village Way; north of

Lori presented the subject report and .noted the continuance was being requested due to
a complaint received after the public hearing notices were mailed out.

Commissioner Davert moved; Commissioner Pontious_.seconded, to continue
Conditional Use Permit 99-014 to the December 13, 1999 Planning Commission
meeting. Motion carried 5-0.

The public nearing opened at 7:05 p.m.
Commissioner Davert noted his concern about the hours of operation being restrictive
and noted that perhaps changing the hours to 9:00 a.m. to 9:00 p.m. for all days would be
more appropriate.
Minoo noted that these are the hours proposed by applicant.
Chairperson Kozak noted that private lessons provided on Saturday should have hours of
operation listed also.
Commissioners Davert, Bell and Pontious concurred with Chairperson Kozak.
Chairperson Kozak asked Doug Anderson about the need for condition 2.7 which
requires a parking demand analysis and asked if the analysis would include circulation as
his concerns are centered on drop off and pick up of vehicles and the creation of
problems for-tenants.
Doug Anderson replied that typically any congestion would be for no more than 15 or 20
minutes and staff would not be as restrictive to invoke a traffic study.
The Director noted that if the Planning Commission is concerned about circulation, the
condition could be amended to reflect that concern.
Chairperson Kozak stated he did not wish to impose anything on the applicant if there
were no issue.
The Director noted that the site is relatively small but there could be an issue in the future.
Doug Anderson noted there could be issues with other businesses.
Commissioner Pontious stated she believed the- center would be underparked in most
cases.
Ch_airperson Kozak stated his comfort with leaving the conditions as they are.
The Public hearing closed at 7.:08 p.m.
Commissioner Pontious suggested that staff speak with the property owners since they
were not aware.of what kind of businesses are appropriate for their center.

Condition 2.2: to'read "Hours of operation shall be limited to 9:00 a.m..to 9:00-p.m.
Monday through Saturday. The school shall be closed on Sundays. Modifications
to the hours of operation may be approved by the Director 'of Community_ _
Development if it is determined that no impacts to surrounding tenants or
properties will occur."
Motion carried 5-0.

4. - Code Amendment 99-001 a request to amend the Tustin City Code related to
Boarding Houses in the Suburban Residential (R-4) and Multiple Family
:Residential (R-3) Districts. and associated definitions.

Recommendation -
That the Planning Commission:
1. Adopt Resolution No. 3706 recommending approval of the
environmental.determination for the project; and,
2. Adopt Resolution No. 3707 recommending that the City Council°
approve Code Amendment 99-001..
Scott Reekstin presented the subject report and` noted the changes made to the
ordinance.
The Public Hearing opened at 7:12 p.m.
Commissioner Davert noted his concern with the definition-of,boarding houses and asked
how compensation would be addressed if a non-profit group were running a facility.
The Director stated,that issue is covered under the definition:
Lois Bobak stated that type of facility would.fall under a single family. use and-Would have
to meet the code and if there were unique burdens placed on that development_ it would
be dealt with as a code enforcement issue.
Commissioner Davert asked if there was any benefit to tightening up the ordinance.

Lois Bobak noted that would be difficult because California and Federal law places
restrictions on cities regulating uses on the basis of family definitions. The uses must be
regulated by their impacts and not the nature of the people making the impacts.
The Director noted that if eleven individuals get together to live in a fraternity house on a
college campus it would be considered a boarding house..and would be' subject to-,a_ _
conditional use permit.
Commissioner Davert asked about the impacts if an individual were to buy a big house
and take in homeless people for free.
The Director stated that use would fall under the definition of a family and further stated
that staff believes what is being presented is as restrictive as permitted by law.
Chairperson Kozak asked the Director if staff received any contacts from interested
parties.
The Director responded that notices were- provided as required and she spoke with Nick
Spadafno who indicated that he and his attorney found the ordinance acceptable.
• The Public Hearing closed at 7:17 p.m.
Commissioner Kawashima asked if individuals'in the R-4 district could use the ordinance
as a tool of enforcement.
The Director noted the ordinance establishes boarding house as a conditionally permitted
use within the R-4 district with certain development standards and provides greater
opportunity for someone to legally establish a use and affords the City the ability to
regulate the use in a reasonable manner.
Chairperson Kozak noted that someone in audience may wish to speak.
The.individual noted that he was attending for Conditional Use Permit 99-014.
The Director informed the individual that the hearing,was continued to December 13' but
he could supply staff with his comments in writing or over the phone if he is unable to
attend the meeting on December 13'.
Commissioner Kozak moved, Commissioner Davert seconded, to adopt
Resolution No. 3706 recommending that the City Council approve the
environmental determination for the project. Motion carried 5-0.

Commissioner Kozak moved. Commissioner Davert seconded, to adopt Resolution
No. 3707 recommending that the City Council approve Code Amendment 99-001,
revised.as follows:
Ordinance No. 1225, Page 4, Section IV, under definition of "Family" — delete the
following "related' by blood or legal status or a group of not more than six (6)
persons who are not so related"
Motion carried 5-0.
REGULAR BUSINESS
5. AIRPORT ENVIRONS LAND USE PLAN (AELUP). -The Orange County Airport
Land Use Commission (ALUC) has the- authority to adopt a comprehensive
airport land use plan. I'n-1975 the ALUC adopted Orange County's first Airport
Environs Land Use Plan (AELUP). The AELUP is a twenty-year planning
document for the airports within Orange County. The AELUP may be amended
on.an annual basis. The City of Tustin has responded to a number of issues
proposed in previous amendments and the current 1999 Amendment.
Recommendation
Receive and file.
The Director noted that the Planning Commission requested information on'the AELUP
so staff has provided a staff report on that topic.
Chairperson Kozak asked the status of the cities in litigation.
The Director replied that she was not sure how many cities were involved, but does not
believe Tustin will join the effort and'noted that staff will provide updates to the
Commission as the issue progresses.
The Director stated that part of the reason the City is not joining the litigation is because
Tustin has a different issue than the other cities who are considering litigation.
Commissioner Davert thanked Rita Westfield for an excellent report.

6. Status Report
Elizabeth A. Binsackpresented the subject report and noted that staff will be
doing a status report every other month or quarterly starting in January 2000.

7. Report on Actions taken at the November 15, 1999 City Council Meeting,
Elizabeth A. Binsack, Director of Community Development reported on the. subject
agenda.

Commissioner Bell
Asked staff for clarification'on the Sutcliffe;property issue.
The Director responded that in addition to the variance that the Planning
Commission approved for the.:property to allow the owner to maintain a fence, the
• Public Works Department issued an encroachment permit to allow construction in
the public right-of-way.. The property owner proceeded to construct the wall
without permits. She.further noted that permits have,been issued since that time.
Commissioner Davert,
- Stated his agreement with comments from Councilmembers Saltarelli and
Thomas who pointed out the importance of building permits.
Noted the Mayor's Prayer breakfast was a huge success and reminded
everyone of the December 3`d tree lighting ceremony in Old Town.
Commissioner Pontious
Noted that landscaping at the former headache clinic at Newport and
Mitchell was overgrown.
Noted that graffiti was coming down and thanked staff.
Commissioner Kawashima
Noted that he did some work in the City of Orange and they,required him to
obtain a business license. He. asked if the City of Tustin requires a
business'license for:work being done in the City.

The Director respondedthat although she was not sure of .the City of Orange's
regulations; however, if an individual is doing business in Tustin, they are required
to obtain a license similar to a contractor.
Chairperson Kozak
- Thanked staff for taking care of the lease sign in front-of-the- Fireman's Fund
building.
Stated that the Tustin Lanes bowling alley -has received a new coat of
purple paint and he believed one of the conditional use permit. conditions
was for the color purple to be fazed out.

The Director responded that staff will follow up on that issue.
Thanked staff for their help and wished everyone a Happy Thanksgiving.

BACKGROUND
The applicant is requesting approval to expand the existing Garden Center area on the north side
of the building and construct a canopy and A-frame structure to cover a portion of the Garden
Center. The application includes the construction of additional walls to enclose the Garden Center
area and screen the existing loading dock. Since exterior modifications are proposed, Design
Review approval is required for this project, Section 3.12.2 of the East Tustin Specific Plan
requires that Design Review projects be reviewed by the Planning Commission.

Site and Surrounding Conditions
The site is zoned "Planned Community--Mixed Use" by the East Tustin Specific Plan and located
southwest of the intersection of El Camino Real and West Drive in Phase I of the Tustin Market
Place (see Location Map—Affachmenf A). Surrounding uses include a car wash to the north, in-
line retail tenants to the south, the auto center and flood control channel to the west of Myford
Road and Carl's Junior and EI Polio Loco restaurants across the parking lot to the east.
DISCUSSION AND ANALYSIS
The following summarizes the proposed modifications to the building (see Site Plan and Elevations
--Attachment B):
• The construction of new metal canopy to cover 5,400 square feet of existing gross floor area
within the Garden Center. This would replace an existing screen canopy. The proposed
metal canopy is relatively flat and would not be visible from the exterior of the building. The
canopy would be screened by the proposed A-frame'structure,which also has a flat roof.
• The construction of a new A frame structure to cover 1,475 square feet of existing gross floor
area within the front portion of the Garden Center. The 24-foot high A-frame structure would
extend 96-feet north along the front fagade and be approximately 24 feet in depth. Four
gates would be incorporated into the design of the A-frame structure, which would provide
access to the Garden Center from the front of the store. Three of the gates would be made of
black tubular steel and one would be a fence made of the same materials and design. All
four openings in the wall of the structure are the same size and spaced equally apart. On the
north side elevation of the A-frame, an additional gate the same size as the front gates is
proposed, which is made of the same black tubular steel as the front gates and fence. The
color and texture of the A-frame structure exteriormatches the exterior color and texture of
the main building. Four cash registers and checkout counters are proposed to be located
under the A-frame structure.
• The construction of a new shade screen to cover 2,980 square feet of existing gross floor
area within the center of the Garden Center.
• The construction of a 24-foot high wall to continue from the'A-frame structure along the north
property line and enclose the Garden Center area. The wall would incorporate the design of
the A-frame with picket fencing evenly spaced, similar to the gates and fence on the A-frame.
This wall would have three small jogs, approximately 2'6"'in depth and extend 154 feet from
the A frame structure to the west, or rear, of the Garden Center. The color and texture of the
wall would match the exterior color and texture of the main building.
• The addition of 476 square feet of uncovered gross floor area. This additional area would
"square" an existing diagonal corner of the Garden Center area, add more space to display
merchandise, and incorporate the existing rear access gate.

• The construction of anew 12-foot high screen wall adjacent to the existing loading dock.
This screen wall would extend north from the existing building to the existing 8-foot high
perimeter wall. The existing perimeter wall would be increased an additional four (4) feet in
height with tubular steel metal fencing to match the fencing and gates incorporated into the A-
frame structure and wall. The increased height of the existing wall would match the height of
the new 12-foot screen wall adjacent to the loading dock. The color and texture of the
proposed wall would match the A-frame, 24-foot wall, and the exterior of the main building.
This screen wall will buffer any visual impact of the loading dock area from public view.
The proposed alterations to the Garden Center and loading dock are designed to incorporate
materials, colors and finishes that are consistent with the existing conditions to ensure compatibility
with the surrounding buildings. As such the proposed modifications would be consistent with the
architectural design of the existing Home Depot building and Tustin Market Place.
Parking and Circulation
As part of the original construction of Home Depot, the calculations for required parking did not
include uncovered areas in the Garden Center. This rationale was continued when determining
the required parking for the Garden Center expansion proposed under Design Review 94-021,
• which was neves constructed. The Home Depot main building is 96,715 square feet which requires
484 parking spaces at the retail parking ratio of 1 space for every 200 square feet of gross floor
area. The area of the Garden Center that is proposed to be covered is 6,875 square feet, which
requires 34 spaces. The total required parking for Home Depot with the proposed remodel and
expansion is 518 spaces. Tustin Market Place requires 3,921 parking spaces and has 4,142
parking spaces available for use by all tenants. Therefore, there is sufficient amount of parking for
the proposed expansion of the Home Depot Garden Center.
Pedestrian and vehicular circulation should not be adversely affected by the proposed project.
Additional pedestrian access gates will be available on the front elevation. The new exit gates on
the north elevation will be used for emergency access only and the access gate on the rear
elevation is existing and being relocated.

7 The Planning Commission of the City of Tustin does hereby resolve as follows:

A. That a proper application, Design Review 99-018, was fled by Home Depot
10 on.behalf of Irvine Retail Properties requesting authorization to remodel and
expand the Home Depot Garden Center area.and construct a screen wall
' adjacent to the existing loading dock located at 2782 EI Camino Real.

(1) IA The proposed project shall substantially conform with the submitted plans
for the , project date-stamped December 13, 1999, on, file with the
'Community Development Departrnent,,as herein modified, or as modified
by the Director of Community Development Department in accordance with
this Exhibit. The Director may also approve minor modifications to the

(4) 3.4 - If applicable, -all mechanical and electrical fixtures and equipment shall be
adequately and,decoratively screened. The screen shall be considered as
an element of the overall design,of the project and shall blend with the
architectural design of the building.
NOISE
(1) 4.1 All construction operations including engine warm up shall be subject to the
provisions of the City of Tustin -Noise.Ordinance and shall take place only
during the hours of 7:00 a.m. until 6:00 p.m., Monday through Friday unless
the Building Official determines that said activity will be in substantial
conformance with the Noise Ordinance and the public health and safety will
not be impaired subject to application being-made at the time the permit for
the work is awarded- or 'during progress of the work unless other

FIRE
(5) 6.1 Prior to the issuance of a building permit, the applicant shall submit plans
for any required automatic fire sprinkler system in any structure to the
OCFA for review and approval. Prior to the issuance of a certificate of use
and occupancy, this system shall be,operational in a manner meeting the
approval by the Fire Chief.
(5) 6.2 Prior to the issuance of a building permit for combustible construction, the
builder shall submit a letter on company letterhead stating that water for
fire-fighting purposes and the all weather fire protection access roads shall
be in place and-operational before any combustible material is placed on
site.
(5) 6.3 Prior to the issuance of any building permits the applicant shall submit to
the Fire Chief a list of the quantities of .all hazardous, flammable and
combustible materials, liquids or gases.` These liquids and materials are to
be classified according to the "Orange County Fire Authority Chemical
Classification Handout". The submittal shall provide a summary sheet
listing each hazard. class, the total quantity of chemicals stored per class
and the total quantity of chemicals used in that class. All forms of materials
are to be converted to units of measure in pounds, gallons and cubic feet.
(5) 6.4 Prior to the issuance of a building permit, the applicant shall contact the
Orange County Fire Authority Hazardous Materials Disclosure Office at
(714) 744-0463 to obtain a "Hazardous Materials Business Information and
Chemical Inventory Packet". This shall be completed and submitted to the
Fire Chief prior to the issuance of a building permit.
(5) 6.5 Prior to the issuance of a building permit, the applicant shall submit plans
for the review and approval of the Fire Chief as indicated on the OCFA Plan
Submittal Criteria form. Contact the OCFA at (714).744-0403 for a copy of
the Fire Safety Site/Architectural'Notes to be placed on the plans prior to

Attachment B). The Planning Commission is authorized to determine whether the
location, purpose,:and extent of the proposed acquisition and construction is consistent
with the.General Plan.
The General Plan designates the project site as "Planned Community Residential" (PCR).
Schools that are determined to be compatible with and oriented towards meeting the
needs of surrounding residential neighborhoods are allowed in this land use designation.
The East Tustin Specific Plan Land Use Map classifies the proposed site as a "Potential
Elementary School". With respect. to schools, the General Plan identifies the following
Goals and Policies:
Goal 1: "Provide for a well balanced land use pattern that accommodates
existing and future needs for open space and community facilities and
services".
Goal 8: "Ensure that necessary public facilities and services are available to
accommodate development proposed on the Land Use Policy Map".

serve the residential community".
The City of Tustin has transmitted comments on the environmental documentation for the
project to the Tustin Unified School District (see Attachment C). With implementation of
the City's recommended mitigation measures, the proposed elementary school would be
compatible with uses in the vicinity and serve residents of the surrounding community. As
such, the location, purpose, and extent 'of the proposed acquisition/ construction is in
conformance with the City of Tustin General Plan and the East Tustin Specific Plan.

School by the Tustin Unified School District
Dear Ms. Binsack:
On behalf of the Tustin Unified School District("District"), this letter serves as notice of
the District's intention to construct the proposed Rawlings Elementary School which will
accommodate approximately 650 students. Specifically, the District proposes to undertake the
construction of all appropriate and necessary permanent and/or temporary school facilities,
including, but not limited to, modular teaching stations, play fields, administration, support, and
parking facilities, as well as lighting on approximately 9 acres of real property located at the
northeasterly corner of Township Drive and Rawlings Way legally described as Lot 6 of Tract
No.,12870 contained within Sections 42 and 43, Township 5 South; Range 9 West, in the City of
Tustin, County of Orange, State of California ("Proposed Project Site"). The purpose of the
project is to provide educational facilities for up to 650 elementary students within the Tustin
Unified School District. The beneficiaries of the Project include the students, parents and other
members of the community.
This letter shall serve as formal request for the Planning Commission to investigate the
Proposed Project Site and submit a written report to the District within thirty days of your receipt
of this letter. The report should detail the Planning Commission's investigation and
recommendations concerning the District's proposed use of the property for classroom activities.
Because the County has adopted a general plan, this letter also serves to advise the
Planning Commission, pursuant to Government Code Section 65402, that the District is

Project Site. We further request that the Planning Commission report on whether the District's
construction of the proposed Rawlings Elementary School will conform with the adopted general
plan as is required pursuant to Government Code Section 65402. This additional aspect of the
County's report should include a determination of whetl=the zoning for the Proposed Project
Site permits construction of the proposed Rawlings Elementary School.
To assist the Planning Commission in its investigation, we have enclosed a vicinity map
and tract map showing the location of the Proposed Project Site.
We would appreciate your sending your response to this request to the undersigned on or

SUBJECT: RAWLINGS WAY ELEMENTARY SCHOOL DRAFT NEGATIVE
DECLARATION
Dear Ms. Mulvihill:
Thank you for the opportunity to comment on the draft Negative Declaration for the
proposed elementary school on Rawlings Way. The City of Tustin has reviewed the
document and offers the comments:
1. Determination: Under the "Determination" section of the Environmental •
Information Form, item number 2 should be checked. The project will have an
impact on the environment and mitigation measures will be necessary. If
measures will not mitigate impacts, an EIR should be prepared.
2. General: The draft Negative Declaration does not mitigate the project's impacts
nor provide a monitoring program as required by CEQA.
3. General: Throughout the document, the statement is made that "the project was
included within the scope of the East Tustin Specific Plan and Final EIR 85-2."
While Final EIR 85-2 may be incorporated by reference as a previous
environmental document which generally addressed the development of schools
within East Tustin, the EIR did not provide construction level environmental
analysis. The draft Negative Declaration needs to identify specific, construction
level impacts and mitigation measures under each topical discussion. If no
impact is anticipated, the text should provide the justification for this conclusion.
4. General: The project description should be modified to clarify what lighting is
proposed for the project.
5. Page 4, Aesthetics: Construction of the school has the potential to affect the
visual character and quality of the site and surroundings and introduce new light

sources on the property. The responses to I(c) and I(d) shouldbe revised. At a
minimum, the following mitigation measures are necessary:
a. The existing jandscaping along Rawlings and Township may be altered
but shall conform to the requirements of the East Tustin Specific Plan.
Approval from the homeowners associations affected by any changes to
the. existing landscaping shall be obtained. The slopes at the rear of the
property will be maintained in an attractive. manner and shall not be
encroached upon.
b. A Street Improvement Pian shall be submitted for review and approval by
the City of Tustin which includes existing or proposed street 'lighting.
Approval of the Street Improvement Plan shall be obtained from the City of
Tustin Public Works Department to ensure that there are no impacts due
to light or glare.
5. Page 5, Air Quality: Since the project will increase vehicular traffic in the vicinity,
potential air quality impacts should be analyzed and appropriate mitigation
measures included.-
6. Page 7, Geology and Soils: Since the project site-is located in an area that ,is
subject to seismic activity, the text should identify that potential impacts will be
reduced to a IeVel of insignificance with implementation of the requirements of
the Office of the State Architect.
7. Page 9, Hydrology and Water Quality: Construction on the project site will modify
drainage patterns and introduction of impervious surfaces has the potential to
affect the amount and quality of surface runoff water. Items VIII (c), (d), (e), and
(1) .should be modified and° construction and operational impacts should be
analyzed. At a minimum, the following mitigation measures are necessary:
a. The TUSD shall obtain approval of the Tustin Ranch III Homeowners
Association for runoff.into private facilities and approval from the City of
Tustin for runoff into public facilities.
b. Construction and operation of the school shall comply with the
requirements of the National Pollution Discharge Elimination System.
8. Page 11, Noise: The school facility has the potential to increase the noise level
within the area. Items XI(a), (c), and (d) should be modified and construction and
operational impacts should be analyzed. At a minimum, the following mitigation
measures are necessary:

a. Construction and operation of the school shall comply with the City of
Tustin,Noise Ordinance.
b. The Tustin Unified School District shall work ' with the adjacent
Homeowners Associations to reduce the noise generated by traffic on
Rawlings Way by directing maintenance vehicle access to the Township
Drive entrance of the adjacent gated community.
9. Page 12, Public Services the Orange County Fire Authority should be provided
with the opportunity to review*and comment on the plan.
10. Page 12, Recreation: The text should document that no adverse impacts from
joint use or lighting of the play fields is anticipated since joint use and lighting are
not proposed.
11. Page 13, Transportation/Traffic: Based upon land use generation rates of- the
East Tustin Specific Plan, this project will generate approximately 520 vehicle
trips per day. It is anticipated that approximately 50 percent, or 260 trips, will be
generated in the A.M. peak hour. Since Rawlings Way terminates into a private
gated community, all of the vehicular access to the school will be from the
intersection of Tustin Ranch Road and Rawlings Way. In addition, maintenance
vehicles and workers use the Rawlings Way entrance gate for A.M. access and
may conflict with the A.M. peak hour school drop off activities. This may result in
traffic congestion and driver frustration from attempting to maneuver for street
frontage to drop-off students and turn around to return to Tustin Ranch Road.
Items XV (a) and (c) should be modified and construction and operational
impacts should be analyzed. In addition, items XV (d), (e), and (f) should be
explored with the Office of the State Architect for compliance with design and
parking criteria and with the Orange County Fire Authority for emergency access.
With respect to traffic impacts on Rawlings Way, at a minimum the .following
mitigation measures are necessary:
a. The TUSD shall work with the adjacent homeowners associations to
reduce the traffic congestion by directing maintenance access to the
Township Drive entrance of the adjacent gated community.
b. The location of the two access driveways on Rawlings Way and the
location of the bus drop-off and the vehicular parking/drop-off area shall
not be modified without review and approval of the City of Tustin. No
parking shall be permitted on Rawlings Way. The curbs along Rawlings
Way shall be painted red and signing shall be added for drop-off only after
the completion of the project.

G. An area of right-of-way shall be dedicated to the City of Tustin adjacent to
the two driveway approaches. Radius returns shall be used to increase
the circulation at these access points.
d. The TUSD shall work with the adjacent homeowners association to obtain
a permanent and secure pedestrian access to the school from Township
Drive.
e. Prior to construction, the proposed access plan shall be approved by the
Orange County Fire Authority and applicable requirements shall be
incorporated into the construction plans.
12. Page 14, Utilities and Service Systems: Construction and *operation of a new
school will require utility installations and coordination with service agencies.
Item XVI(c) should be modified and potential impacts analyzed -and mitigated.
With respect to storm water facilities, at a minimum, the following mitigation
measures are necessary-
a. A Street Improvement Plan shall be submitted to the City 'of Tustin for
review and approval. The plan shall include the location of all proposed
and existing utilities and storm drains. Approval of the Street
• Improvement Plan shall be obtained from the City of Tustin Public Works
Department to ensure that there are no impacts on the existing water
supplies and the water drainage facilities.

-AMENDMENTS
RECOMMENDATION TO THE JOINT POWERS AG
Upon formation of the Orange County Fire Authority
(OCFA) in 1995, the members agreed that there would
be a three-year period during-which no charges could be
_ made to the basis for setting the cost of services. An
Equity Study was prepared in order to address the issue
of whether members of OCFA are paying a "fair share of
the cost of providing regional fire services. -The Tustin
City Council considered the study at. its April 5, 1999
meeting and directed staff to submit comments to
OCFA. The City Council also directed staff to prepare an
analysis of service levels/costs for options to whatever
final action_ was-taken_ _by_the OCFA Board of Directors on

the Equity Stud . The OCFA Board created a corrmmittee
to provide final recommendations concerning the Equity
Study. After several months of negotiations, the Board
approved policy guidelines concerning equity issues, and
in September 1999, approved amendments to the Joint
Powers Agreement (JPA). The amendments to the JPA .
would enable the City of Tustin to enter into a ten-year
contract with fixed caps on yearly increases. Approval of
the amended JPA does not commit the City to a ten-year
contract. The amended JPA provides that the City has
until July 1, 2000 to consent to a ten-year fire services
contract or withdraw from OCFA effective July 1, 2001.
Recommendation by the City Manager:
1. Approve the amended Orange County Fire Authority
Joint Powers Agreement.-
2. Direct staff to enter into negotiations with the OCFA
on a ten-year fire services agreement based on the
terms of - the amended Joint Powers Agreement,
including fire services performance standards.
