CONSENT CALENDAR:

Commissioner Davert moved Commissioner Kawashima, to.approve the Consent
Calendar. Motion carried 5-0.
PUBLIC HEARINGS:
2. Conditional Use Permit 00-004 a request to establish a contractor's office in an
existing office building. The project is located at 275 Centennial Way, Suite 211,
within the First Street Specific Plan zoning district.

Commissioner Davert moved, Commissioner Bell 'seconded, to adopt
Resolution No. 3716 approving Conditional Use Permit 00-004. Motion
carried 5-0.

The public hearing opened at 7:11 p.m.
Lori Ludi presented the subject report.
Commissioner Davert asked staff if the applicant could make do with a monopole of less
than 60 feet and still have reasonably good coverage.
Lori Ludi replied that the radio frequency analysis indicated that 45 feet would be
sufficient for vehicular use but not for use within a building and a 60 foot facility, may leave
gaps in coverage.
Commissioner Davert asked if the applicant anticipated another structure.
Lori referred that question to the applicant.
Commissioner Davert noted that there are a number of buildings taller than the Snapple
building and asked staff's opinion on the feasibility of using the Orange County Teachers
Credit Union building for a roof mounted antenna.
The Director responded that staff believes it would be possible and the applicant has not
provided justification that it cannot be done and further noted other sites that use signs
and relatively high buildings to accommodate cell sites.
Chairperson Kozak stated that the Micro Center sign would be an excellent site.

Commissioner Davert stated that with the upcoming Tustin Legacy project he would like
to see other options explored before committing to a 60 foot monopole..
Commissioner Kawashima asked what the height restriction is for the Pacific Center East.
The Director stated that the maximum height permitted in this district is 50 feet for
buildings which is why an additional 10 feet for clearance was incorporated in the wireless
ordinance.
Commissioner Davert asked if two or more building mounts would provide the same
coverage. :
Karen Peterson noted that the applicant's justification letter states that any antenna
height of less than 60 feet may require the placement of two antenna locations to cover
the signal requirements for the area.
Commissioner Davert stated that the Planning Commission could suggest. two well-
screened antennae as opposed to one monopalm.
The Director responded that the Commission,could request that and noted that several
• other carriers have done that. She further noted that the ordinance incorporated approval
of stealth facilities at the Zoning Administrator level for ease of development.
Chairperson Kozak noted that the Commission has to take potential developments at
Tustin Legacy into consideration.
Saundra Jacobs, Sprint representative, thanked Lori Ludi and Karen Peterson for their
hard work and assistance through the application process. She stated that the proposed
antenna is in response to very poor cellular coverage in the area of the 55 freeway,
Redhill and Edinger 'Avenue. She noted that Sprint reviewed several potential site
candidates and chose this property owner because he-was a willing.lessor, agreed to the
lease rate that Sprint budgeted for, and lastly there is- enough physical space for the
equipment. She asked for the Commission to approve a standard antenna because it is
conducive to co-location and the tree poles are not conducive to collocation. She
thanked the Planning Commission for their time.
Chairperson Kozak stated his appreciation for comments regarding alternatives and,
stated his preference for a multiple building alternative.
Saundra Jacobs, Sprint representative, stated that the site acquisition personnel looked
at various buildings in the area and this was the best alternative.
Chairperson Kozak asked the applicant for assistance in reading the graphical depictions
of coverage and drop areas.
Kathleen Abola, radio.frequency engineer for Sprint, stated that map 1 shows the current
cell sites and.green and yellow is vehicle coverage level; map 2 shows the same area

with two additional cell sites that are being added to show what they will cover; map 3
shows the same area with the requested at 60 feet; and map 4 shows the same area with
the facility at 45 feet. She noted that the system is very dynamic and coverage changes
according to how many people are using their phones. She further noted that if the, pole
is approved for only 45 feet, the coverage gets smaller and the site would have to be
revisited.
Commissioner Davert asked staff how much the FCC limits what the City can do.
The Director stated that the City may not ban the technology they are proposing which is
why the ordinance identifies site location criteria. TheCity does have the discretion to
regulate location and what the facility looks like. She further noted that five years ago it
was not possible to do a-monopalm or building. mounted, otherwise monopoles would be
located throughout the community.
Commissioner Pontious stated that she cannot support a monopole and believes it is
unfortunate that:once an acceptable location was found, the applicant did not review
alternative mounting locations. She further stated that she would be more inclined to
approve a monopine since there have been problems with keeping the palm trees alive in
other locations.
Chairperson Kozak asked Commissioner Pontious if her recommendation would be for 60
feet or lower.
Commissioner Pontious responded that she is willing to approve the- 60 foot proposal
because of the possibility of having more poles at the 45 foot height.
Commissioner Davert stated his first preference would be something that is building
mounted but noted that he does find the applicant's justification compelling-. ..He stated he
is very concerned about the impact on surrounding community particularly with the Tustin
Legacy project. He stated that he would be willing to approve a monopalm with a round
trunk. He further noted that the project site has rusty furniture and garbage all over and
asked if the property owner could be encouraged to clean up the site.
Commissioner Bell stated that she would also prefer a roof mounted facility but given the
choice between a palm or a pine she feels the pine blends in better with the existing
landscaping. She also encouraged the applicant to look at other locations.
Commissioner Kawashima stated he would be willing to approve a monopine at 60 feet.
The Director stated that she believed the applicant did not explore the possibility of a 45
foot screen on top of a 30 foot building but staff would not likely recommend approval.
Commissioner Dayert noted that, to be fair to the applicant, this was the one property
owner they were able to come to terms with.

Seline (incomprehendable), a representative from Sprint, noted that the, search for
buildings is left to the site acquisition personnel to negotiate with landlords who are
responsive to their needs. He further stated that it is not a case of not investigating other
sites since the search, has been going on for a year and they have been, looking in that
area extensively. He noted that there are technical restrictions in terms of power loss and
requirements for this type of equipment.
Chairperson Kozak stated that he did not see the difference in the cable run for a 60 foot
above ground antenna and a 30 foot building because it is still 60 feet above ground
level.
Seline (incomprehendible) stated that the underground structural engineers would not
approve an extension at a maximum 50 feet above roof line even if the landlord .was
willing:
Commissioner Davert asked if the applicant would be lowering antennas in the future.
Seline stated that they probably wouldn't lower antennae`but adjust specific antennae.
Commissioner Davert asked staff about the conditions that would limit the applicant.-
The Director noted that Condition 1.6 would allow her to re-review the project in 2005 in
the event that technology exists to bring down the height but would require Council
approval; Condition 1..9 would limit the overconcentration of their facilities in this area
which would mandate a building mounted facility in the future; and, she noted that other
carriers' technology may allow them to collocate on stealth facilities and a condition could
be included that would mandate that at a fair market rate.
Commissioner Pontious asked if Condition 1.6 could-be amended to indicate review every
five years after.
The Director stated that the condition could be modified as such.
Chairperson Kozak asked staff if they had any information about future development
plans for the vacant property between the Snapple building and,Del Amo.
The Director responded that City is undertaking the development of the Newport Avenue
extension and the reconfiguration of the offramps in that area. As. part of the public
improvements, the undergrounding of Edison trunkliries that are going through there is
being considered.
Chairperson Kozak stated his concern about the effect of a 60 foot cell site on the Tustin
Legacy and any development proposals for the vacant property. He stated his preference
for a roof-mounted alternative and his concern about setting a precedent by going above
50 feet. He further stated he would be more in favor of a palm tree rather than a pine but
would not like either at 60 feet.

Commissioner Davert asked the Director if there is a.50 foot limit on the height of the
antenna.
The Director responded that there is a 50 foot height limit on buildings but the wireless
ordinance allows an additional 10 feet in height for an antenna.
Commissioner Davert asked if a 50 foot building were constructed on the vacant lot what
affect that would have on the cell site and what the applicant would do in that situation.
Saundra Jacobs, Sprint representative, stated that if the antenna were 60 feet high and
the building were 50 feet high there would be no affect on coverage. She further noted
that she brought samples of the fake,pine branch and trunk and noted that they can now
be made round and the carrier guarantees to the landlord 'the site will be kept .working
and in good order.
Commissioner Davert noted the staff recommendation of Pleasure of Commission and
asked staff has a recommendation after examining the issue.
The Director stated that staff does not feel that all options have been exhausted which is
why a resolution of denial has been presented. She stated that the decision was up to .
the Commission and if they are inclined to approve a palm or pine monopole, staff would
recommend continuing the hearing for two weeks to allow staff to modify the resolution.
Commissioner Pontious stated she is pleased`that the cell site will -not be impacting
residential areas as in the past.
Commissioner Davert stated he did not wish to be unbusiness friendly but did not wish to
see cell sites continue to-proliferate.
Chairperson Kozak_ stated that the Commission is going to see more requests of this kind.
Commissioner Davert stated that he accepts the applicant's justification for 60 feet height
but he prefers a stealth site.
The Director stated that the Commission can take action this evening and direct staff to
prepare a resolution of approval.
Commissioner- Davert moved Commissioner Pontious seconded, to approve the
project and directed staff to prepare a resolution of approval to reflect the
Commission's direction.
Saundra Jacobs, Sprint representative, noted that the additional living trees have to be
shorter than the antenna.
The Director noted modifications including requirement for collocation and lowering facility
if technology exists.

Chairperson Kozak stated that the pole should be round.
The applicant responded affirmatively.
Commissioner Pontious thanked the applicant for the excellent graphics that were
provided.
Commissioner Davert asked if the property owner could- be encouraged to clean up the
property.

Stated that the public auto auction signs mentioned at the last meeting have

Ana code enforcement be enlisted to assist in the elimination of the signs.

The Director stated that staff contacted the persons placing the signs and they
said they would not locate the signs in Tustin and staff will contact them again.

BACKGROUND --
At the March 13, 2000 meeting the .Planning Commission directed staff to revise
Resolution 3714 approving a sixty (60) foot tall monopine major wireless communication
facility. The modifications made to Resolution 3714 include the following:

• Condition 1.6 has been modified to include a review of the'Conditional Use Permit
by the Community Development Director every five (5) years.
• Condition 1.10 has been added to mandate co-location of the facility by additional
carriers. Finding No.. 4 has also been added, which states that mandating co-
Iodation ofthe facility would 'avoid infiltration of additional major wireless
communication facilities within the surrounding area.
• Condition 3.1 has been modifed 'td identify that a sixty (60) foot tall monopine shall be
located on the subject site with a cluster of six (6)additional live mature trees planted in
the leased area Jand the monopine shall have a round trunk with artificial bark and full
branching from top to bottom.

8 The Planning Commission does hereby resolve as follows:
9 I. The Planning Commission finds and determines as follows:
10 - A. That a proper application for Conditional Use Permit 98-012 and
11 Design Review 98-017 was filed by Sprint PCS to establish-a major
wireless communications facility sixty feet in height with six antenna
12 panels fifty-six (56) inches in length on the property located at 15201
13 Woodlawn Avenue.
>> B. That -the proposed facility is consistent with the requirements of
Tustin City Code Section 9276 et seq., relating to wireless
15 communications facilities. •

C. That a public hearing was .duly called, noticed and held on said
17 application on February 14, 2000, and continued to the February 28
18 and March 13, 2000 meetings of the Planning Commission.
19 D. That installation, operation, and maintenance of a major wireless
communication facility, as conditioned, will not be detrimental to the
20 health, safety, morals, comfort, or general welfare of the persons
21 residing or working in the neighborhood of such proposed use, nor be
injurious or detrimental to the property and improvements in the
72 neighborhood of the subject property, or to the general welfare of the
23 City of Tustin, as evidenced by the following findings:
24 1) As conditioned, the proposed facility would not be detrimental
to, or have a negative effect on, surrounding properties in that
25 it would appear to be a tree set within the "Technology Center"
26 zoning district of the Pacific Center East Specific Plan which
provides for general research and development, light industrial
27 and accessory office and commercial uses. A monopole
constructed as an artificial tree within a cluster of trees at this
28 location is consistent with the second and third site selection
29 order of preference in Tustin City Code Section

would provide screenings and in commercial and industrial
3 zones. In,addition, consistent with the locational guidelines in
TCC Section 9276(H), the facility would not,be located within
4 '100 feet of any existing, legally established major wireless
51 communication facility nor within 300 , feet of' residentially
zoned or used property.
2) As -conditioned, the-proposed facility would riot be detrimental.

close proximity to living trees of comparable heights consistent
9 with the screening guidelines of Tustin City Code Section
9276(F)(1).

3) As conditioned, the use of a. portion of the project site for the

12 The facility would- be unattended and not necessitate use of
13 required parking spaces nor generate significant traffic in the
neighborhood.

• 15 4) As conditioned, co-location of the facility shall be required for
other carriers at a fair market rate to avoid an infiltration of'
16 additional' major wireless communication facilities within one
hundred (100) feet of the facility.

1s E. Pursuant to Section 9272 of the Tustin Municipal Code, the
Commission ,finds that the location, size, architectural features and
19 ger"eral appearance of the proposed facility would not impair the

orderly and harmonious development of the area, the present or
future development therein, or the occupancy as a inrhole. In making
21 I such findings, the.,Commission has considered at least the following
'items:

23 1. Height, bulk and area of buildings.
2. Setbacks and site planning. "
24 3. Physical relationship of proposed improvements to existing
structures in the neighborhood.
25 4. Appearance and design relationship of proposed
26 improvements .to existing structures and possible future
structures in the neighborhood and public thoroughfares.
27 6. Development Guidelines and'criteria as adopted by the City

(1) 1.8 Except as otherwise stated in Condition 1.2, Design Review approval shall
remain valid for a period not to exceed the term of the lease on the subject
property, including any.extension thereof. A copy of said lease shall be
submitted to the Community Development Director prior to issuance of any
permits. if the lease is extended or terminated, notice and evidence thereof
shall be provided to the Community Development Director. Upon
- termination or expiration of the lease, the facilities shall be removed from the
subject property.
(1).. 1.9 To prevent overconcentration of monopole structures, future wireless
communication facilities proposed by Sprint south of the 1-5 Freeway and
east of the SR-55 Freeway within the City of Tustin shall be limited to
building mounted facilities which are integrated into the architecture of the
host buildings. The applicant shall submit a master plan of the for the area
south of the 1-5 Freeway and SR-55 Freeway to the Community
Development Department demonstrating that building mounted facilities
could be developed to eliminate existing or future gaps in service.
(1) 1.10 The applicant shall be required to accommodate additional carriers that
request to co-locate on the facility at a lease that is at a fair market rate.
(1) 1.11 The owner shall bring the property into compliance with the City's Property
Maintenance Ordinance prior to the issuance of a building permit. Said
property shall be maintained in a manner to ensure compliance with the
Property Maintenance Ordinance.
PLAN SUBMITTAL
(1) 2.1 At building permit plan check, the applicant shall submit three (3) complete
sets of architectural, electrical and mechanical plans with the necessary
structural calculations, specifications and details complying with the Uniform
Building Code, other related Codes, City Ordinances and State and Federal
Laws and regulations. The structural calculations and specifications shall be
prepared by a California registered civil or structural engineer. The
engineer's license number and License expiration date shall be indicated on
the report.
(1) 2.2 All grading, drainage, vegetation and circulation shall comply with the City of
Tustin Grading Manual. All street sections, curbs, gutters, sidewalks,
lighting -and storm drains shall comply with on-site improvement standards.
Any deviations shall be brought to the attention of the Building Official and
request for approval shall be submitted in writing prior to any approval.

(6) 2.3 At- building plan check, the applicant shall submit three (3) sets of
'landscaping and irrigation plans identifying the existing, and proposed
landscaping, planting details, soils report 'arid,modifications to the existing
irrigation system. The plan shall be prepared consistent with the City's
landscaping and,irrigation guidelines.
USE RESTRICTIONS
(4) 3.1 The wireless-facility shall be,disguised as a pine tree no more than sixty (60)
feet in height with a round trunk with artificial bark and full branching from the
_top of the. pole to the ground. A total of six (6),living trees_ of a variety of
species shall be installed in close proximity and height to the monopole tree
structure subject to review and approval of the Community Development
Department. , If sufficient space -is not available for. installation of one
monopole structure and' 'six (6) living trees, the applicant shall request
approval of revised plans from the Planning Commission.
(4) 3.2 The number and dimensions of the antenna sectors shall be limited to six (6)
panels fifty-six (56) inches in length as shown on the approved plans. The
location and configuration of the facility shall be restricted to the location and

configuration shown on the approved pians.
*** 3.3 The artificia[tree/monopole structure shall be maintained in good condition.
If the condition of the structure serves to lessen the visual mitigation of the
communication facility as an artificial tree, the Director may require that the
structure be -refurbished within thirty (30) days of notification from the
Community Development Department.'
*** ` 3.4 The condition of the. living trees shall be monitored by 'the. Community
Development Department. If the height, style -or condition of the trees
serves to lessen the visual mitigation of the- communication facility, the
Director may require That the trees be trimmed, altered, moved or replaced
within 'thirtji (30) days of notification from the. Community Development
Department to ensure that thea facility will 'be screened by healthy trees .of
comparable heights.
3.5 Maintenance and pruning of the live trees shall comply with the International
Society of Arborculture (ISA) pruning practices..
(4) 3.6 A six (6) foot eight (8) inch tall block wall enclosure shall be installed around
the wireless facility to prevent unauthorized -access and visibility,from any
surrounding sites or public .right-of-ways, subject to final approval of the
Community Development Director. Access into the facility shall not encroach
over any property line.

*** 3.7 The applicant shall prepare a preliminary report within 90 days of completion
of the project demonstrating conformance with national standards for safe
human exposure to electromagnetic fields and radio frequency installation.
Said report shall be submitted to the Community Development Director.
NOISE
(1) 4.1 Afl construction operations including engine warm up shall be subject to the
provisions of the City of Tustin Noise Ordinance, as amended, and may take
place only during the hours of 7:00 a.m. until 6:00 p.m., Monday through
Friday and 9:00 a.m. until 5:00 p.m. on Saturday unless the Building Official
determines that said activity will be in substantial confo-
rmance with the
Noise Ordinance and that public health and safety will not be impaired
subject to application being made at the time the permit for the work is
awarded or during progress of the work.
FEES
(1) 5.1 Prior to issuance of any building permits, payment shall be made of all
applicable fees, including but not limited to the following. Payment shall be
required based upon those rates in effect at the time of payment and are
subject to change.
A. Building plan check and permit fees to the Community Development
Department based on the most current schedule.
B. Within forty-eight (48) hours df approval of the subject project, the
applicant shall deliver to the Community Development Department, a
cashiers check payable to the COUNTY CLERK in the amount of
$38.00 (thirty-eight dollars) to enable the City to file the appropriate
environmental documentation for the project. If within such forty-eight
(48) hour period that applicant has not delivered to the Community
Development Department the .above-noted check, the statute of
limitations for any interested party to challenge the environmental
determination under the provisions of the California Environmental
Quality Act could be significantly lengthened.

RECOMMENDATION
That the Planning Commission adopt Resolution No. 3720 approving Conditional Use
Permit 00-002.
BACKGROUND
The applicant is proposing to establish a fifty (50) seat restaurant in conjunction with the
existing Honeybaked Ham retail outlet within the Tustin Plaza retail commercial center
(see Attachment A - Location Map). Permitted -uses and development standards within
Tustin Plaza generally conform to those within the Commercial General (CG) zoning
district. To accommodate the additional seating, the applicant is proposing to modify the
shared parking program established for the center in March 198.7 and amended in July

1990 and November 1996. Shared parking programs are conditionally permitted by Tustin
City Code (TCC) Section 9271(AA) and require Planning Commission approval for
developments larger than 30,000 square feet of floor area. Uses surrounding the project
site include the Civic Center complex to the north, residential and commercial uses to the
west, office uses to the south, and commercial uses to the east.
Project Description
Restaurant and Retail Outlets
Honeybaked Ham has operated a 2,268 square foot retail facility within the Tustin Plaza
center since October 1988 and offers a variety of products and services, from individual
sandwiches and side orders to full catered meals. To broaden their range of services and
take advantage of increased demand, they are proposing to expand into an adjoining
1,134 square foot tenant space and offer restaurant seating for their customers. The
restaurant portion would be operated in conjunction with the retail outlet as one facility.
Parking and Circulation
Pursuant to the approved Conditional Use Permit for Tustin Plaza (CUP 85-009) and three
subsequent amendments, parking spaces allotted to tenants are calculated based upon
the proposed use. Retail uses utilize the parking :ratio of one (1) space for every 200
square feet of floor area, and restaurants are parked at a ratio of one (1) space for every
three (3) seats (TCC Section 9235(F)(3)(b)). This tenant space was originally allocated six
(6) parking spaces, which would permit a total of eighteen (18) seats. The additional thirty-
two (32) seats proposed by the applicant would require an additional eleven (11) parking
spaces. The applicant is requesting an' amendment to the shared parking program to
account for the additional eleven (11) spaces required for the thirty-two (32) seats.
ANALYSIS
As part of the City review of the proposal, staff required the preparation of a Parking
Demand Study by a Licensed Traffic Engineer. The Parking Demand Study is an analysis
of conditions within the center's parking facilities based on the current mix of tenants. At
the time the Study was prepared, there were three (3) tenant spaces that were vacant,
totaling approximately 4,500 square feet. Assuming the spaces were occupied by retail
uses, at a ratio of one (1) space for every 200 square feet of floor area, the vacant spaces
would have a parking demand of twenty-three (23) parking spaces. The same
methodology used with Conditional Use Permit 85-.009, as amended, was used to
determine if the center can accommodate additional restaurant seats based upon the
current tenant mix. The study is included as Attachment C.

The Public Works Department has reviewed the parking study and determined that the
methodology and conclusions are accurate. - The study finds that during the peak parking
demand periods (lunch and dinner) there is adequate parking in close proximity to the
subject tenant space to accommodate the seventeen (17) spaces needed for the
Honeybaked Ham restaurant and the existing restaurants and retail spaces. At the peak
demand (measured ion a Friday during the noon hour), the study concludes that of the total
447 parking spaces provided within the retail portion of the project, .a total of 314 spaces
were occupied, thus leaving -133 spaces available. Taking into account the potential.
parking demand from the three (3) other vacant suites for twenty-three (23).spaces, there
are 110 spaces remaining to accommodate the seventeen (17) additional spaces for the
proposed restaurant. The study also found that the parking area behind the project
location is under-utilized, as only 11 vehicles were parked in the area with a total of 37
parking spaces. Condition No. 3.6 has been included'in Resolution No. 3720 (Attachment
D)' requiring the applicant to notify their employees that this area.shall be used for
employee parking.
Existing Condition No. 1.6 of Planning Commission Resolution No. 3494 which approved
the 3rd Amendment to CUP 85-009 reads as follows:
"The maximum floor area for restaurants and/or food related uses (including
outdoor seating areas) shall not exceed tenant commitments and/or proposed
tenant plans of the property owner as of November 12, 1996."
The subject tenant space was previously designated for a. retail use. If approved, the
proposed restaurant use will require an amendment to this condition. A current summary
table including existing ,and proposed uses, gross square footage for.each use, and the
required parking ratios for the uses has been included in the parking demand analysis
(Attachment C). Condition No. 1.6 would modify the previous_Condition 1.5 to incorporate
this updated tenant mix.
Additionally, Condition No. 3.7 would require preparation of another parking demand
analysis identifying, mitigation measures should there be a problem with adequacy of
parking in the future. Staff does not anticipate parking problems due to the abundance of
parking (447 parking spaces)for the current mix of tenants (office, retail and restaurant).
In determining whether to approve the Conditional Use Permit, the Planning Commission
must determine whether or not the proposed project will be detrimental to the health,
safety, morals, comfort and general welfare of the persons residing or working in the
neighborhood or whether it will be injurious or detrimental to property or improvements in
the vicinity or to the welfare of the City. A decision to approve this request can be
supported by the following findings:

1) - The proposed use, as conditioned, will-not .be detrimental to the health, safety,
morals, comfort and :general ,welfare of- persons residing or working in the
neighborhood in that:
a) The parking study was prepared by a licensed traffic, engineer and
demonstrates that no substantialconflict will exist in the peak hours. of
parking demand for the center;
b) The number of spaces credited against the requirements for the proposed
restaurant does not exceed the •number of spaces anticipated. to be
available during different hours of operation; and,
C) Parking spaces designated for joint-use are located such that,they will
adequately serve the uses for which they-are intended.
2) The proposed use, as conditioned, will not be detrimental to nor have a negative
effect on surrounding property owners in that the shared parking.program ensures
that the parking demand can be accommodated on-site.

PROJECT DESCRIPTION
The proposed project is adding a sandwich shop with 50 seats to the existing Honey Baked Ham

Tustin Plaza shopping center. Figure I illustrates the location of the proposed suite within the
shopping center.
This study has been directed toward the evaluation of the adequacy of the parking 'supply to
accommodate existing and future parking demands.

• The existing uses within the Tustin Plaza shopping center were verified and are listed in Table I
along with the associated square footages. As shown in Table I,there are a total of four(4)vacant
suites. The proposed proj ect will be located'within building 13771, Suite 12 which is 1,134 square
feet.
There are a total of 447.,existing marked parking spaces that currently serve the existing uses within
the•Tustin Plaza shoppirig.center.
FIELD STUDIES
The Tustin Plaza shopping center was counted. by WPA Traffic Engineering, Inc. on Friday
(12110199)and Saturday(12/11/99) from 11:30 AM to 1:30 PM and 4:00 PM to 7:00 PM by fifteen
minute intervals. The existing parking lot was subdivided into five parking areas to provide detailed
information on where.the current parking demand is being provided.-These parking areas are shown
on Figure 2 and the count data can be found in Appendix A.
The.numb er of vehicles-parked in the study.area are documented in Table 2. As shown in Table 2,
the peak parking period for the Tustin Plaza shopping center was observed on Friday(12110199)•at
12:15 PM with 314 parked vehicles and on Saturday (12111/99) at 1:15 PM.with 275 parked
vehicles. The-shopping center has a total of 447 parking spaces,which indicates that the parking lot
was 70 percent utilized during the peak period under existing conditions.

CITY PARKING CODE
The City of Tustin Planning Department was contacted to ascertain the City Parking Codes for the
remaining uses within the shopping center. The parking code requirements are shown below:

Based upon the City Parking Code's listed above along with the projected number of parking spaces
required for the proposed project, a total of 569 parking 'spaces would be required for the entire
shopping.center with the vacant suites. Table I lists each land use within the Tustin Plaza shopping
center along with the applicable parking code and number of parking spaces required.
PARKING DEMAND ANALYSIS
The focus of these analyses is to document the actual parking demand in proximity to the proposed
proj ect and to determine if there is justification for a parking variance. The parking demand analyses
will not only account for the existing spaces utilized, but the spaces required by the vacant suites
within the Tustin Plaza shopping center and the demand for the proposed Money Baked Ham

expansion.
Parking counts were conducted at the Tustin Plaza shopping center on a Friday and Saturday. These
parking demand counts were conducted from 11:30 AM to 1:30 PM and from 4:00 PM to 7:00 PM.
A summary of the number of vehicles parked in the study area are documented in Table 2.

For convenience, the parking demand counts were translated to "REMAINING AVAILABLE
SPACES", so the remaining parking supply could be compared to the projected parking demand.
The projected parking demand requires that both the vacant suites in the study area and the proposed
Honey Baked Ham expansion be accounted for within these analysis.
Four of the suites within the Tustin Plaza shopping center are presently vacant. Of these four suites
one is the proposed project location,the remaining three suites total 4,498 SF,which would translate
into a parking demand of 23 spaces based on City code. The project is proposing 50 seats and would
require 17 parking spaces based upon the City code of 1 space per 3 seats. A combination of the
vacant suites and the proposed project would result in an added parking demand of 40•parking
spaces.
Table 2 shows that the 40 space demand can be adequately served by the available supply of 133
spaces on Friday afternoon and 172 spaces on Saturday afternoon. These are representative of the
"worst case" peaks, as they represent a 15-minute period and assume full parking code for the
vacant suites at these particular times of the day. •
SUMMARY
The actual parking demand within the Tustin Plaza shopping center was observed. This resulted in
documentation of the available parking supply. The projected parking demand of 40 spaces would
be adequately served by the peak parking supply of 133 and 172 available spaces during a Friday
and Saturday afternoon, respectively.

GENERAL
(1) 1.1. The proposed use shall substantially conform with the submitted plans for
the project date stamped March 27, 2000 on file with the Community
Development Department;.except as herein modified, or as modified by the
Director of Community Development in accordance with this Exhibit. The
Director of Community Development may also approve minor modifications
to plans during plan check if such modifications are to be consistent with the
provisions of the Tustin City Code and other applicable codes.
(1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be
complied with as specified or prior to the issuance of any building permits
for the project, subject to review and approval by the Community
Development Department.
(1) 1.3 The subject project approval shall become null and-void unless permits are
issued within twelve (12) months of the date of this Exhibit and substantial
tenant improvements are underway. Time extensions may be granted if a

BACKGROUND
On November 15, 1999 the Zoning. Administrator approved a Conditional Use Permit to
allow the County of Orange Public Facilities and Resources Department to stockpile
quarry rock on private property located on the west side of Harvard Avenue directly north
of Edinger Avenue for a period up to six months-or'until'April 1, 2000. 'In accordance with
Tustin ,City Code Section 9299b(3), a temporary use for a period of up� to six months
requires a conditional use permit subject to the approval of the Zoning Administrator.
Temporary uses that exceed six.(6):months require approval by the Planning Commission.
Thee applicant is proposing to use the site for the purpose of,storing quarry rock for an
additional 5 months, or until August 31, 2000 (see Attachment B).

SITE AND SURROUNDING PROPERTIES
The vacant site is located at the southwest cornea of Harvard Avenue and the OCTA/
SCRRA Railway (See Location Map- Attachment A).' Existing and future residential
properties are located to the east and north of the site within the City of Irvine. Located to
the south and southwest of the site is MCAT-Tustin. Jamboree Plaza, which is an
industrial complex, is located to the west across Jamboree Road.
DISCUSSION
The applicant proposes to store quarry rock at the subject site for use in repairing the
Como Orange County Flood Control Channel (see Site Plan - Attachment B) which is
located directly north of the project site, parallel to the OCTA/ SCRRA Railway. The
quarry rock is used to line and reinforce the slopes and the bottom of the channel, which
protects the houses and railroad located next to the channel.
The angular quarry rocks are 18 inches at the widest dimension and the color of granite. In
order to receive FEMA funding for the project, the entire amount of quarry rock to be used
must be stored at the location by March 31, 2000. There would be a maximum of 10,000
tons of quarry rock stored at this location. There will be four, ten-wheeler trucks without
trailers that will transport the rock from the storage site to the channel from the hours. of
7:00 am to 4:00 p.m., Monday through Thursday. -These trucks are stored overnight at a
maintenance facility in Anaheim. In addition to the quarry rocks, a loader (Model 950
Caterpillar) approximately the size of a dump truck will be stored on the lot. This loader will
• be used to transport the rocks from the ground to the trucks. Due to the large size of the
rocks, there- would not be -a significant amount of erosion on the site. Also, the lot is.
covered with a gravel material used for dust control.
The applicant began storing material at this site on October 1, 1999. The project was
originally scheduled to start in November 1999, but has been delayed due to delays in
obtaining the necessary permits from the U.S. Army Corps of Engineers. The estimated
date of completion is August 31, 2000, depending on the weather. Condition 2.2 is
included to allow the Community Development Director to approve a ninety (90) day
extension if the weather delays the project. Since the project site is located on the former
MCAF-Tustin facility, the application was routed to the Redevelopment Agency (RDA) for
comment. The RDA indicated no concerns related to the use.
FINDINGS
In determining whether to approve this Conditional Use Permit, the Zoning Administrator
must determine whether or not the proposed use will be detrimental to the health, safety,
morals, comfort and. general welfare of the persons residing in or .working in the
neighborhood or whether it will be injurious or detrimental to the property or improvements
in the vicinity or to the welfare of the City.

A decision to approve this request can be supported by the following findings:

1} The proposed temporary use, as conditioned,•would not be detrimental to the
surrounding properties in that storage of the quarry rocks will not result in erosion or
excessive dust.
2} As conditioned, the use would not have a negative effect on the surrounding
properties in that there would not be excessive truck traffic on Harvard Avenue and
operations will occur only between 7:00 a.m. and 4:00 p.m., Monday through
Thursday.
3) As conditioned, the use would terminate by August 31, and no later than November
30, 2000, and the applicant would be required to,remove all excess quarry rock and
related equipment.

Dear Ms. Ludi:
The purpose of this letter is to request an extension of time for the subject permit which is
currently set to expire on May 9,2000. The need for the stockpile site is to facilitate the repair of
Como Flood Control Channel that provides flood protection for the local residents. This project
was initially scheduled'to start in November, 1999,however, we experienced substantial delays
in obtaining the necessary Section 404 permit from•the U.S. Army Corps of Engineers. We have
made substantial progress in our negotiations and feel confident,of receiving theauthorization to
proceed within the next 30 days. For this reason,we are requesting an extension to August 31,
2000. _
I have enclosed.an executed Development Application form, a copy of my Entry Permit with The
Irvine Company and check No. 827 in the amount of$375 to cover the applicable fees.

to A. That a proper application for Conditional Use Permit 99-025 was filed by
Dale Dillon, County of Orange Public Facilities and Resources Department,
11 requesting authorization to temporarily store quarry rock at the southwest
12 corner of Harvard and the'OCTAI SCRRA Railway for.use in repairing the
Como Orange County Flood Control Channel for a maximum of eleven
13 months.
14 B. Pursuant to City Code Section 9299b(3), a temporary use exceeding six
15 (6) months requires a conditional use permit approved by the 'Planning
Commission.

C. That a public hearing was duly called, noticed and held on said application
17 on March 27, 2000 by the Planning Commission.
D. That the establishment, maintenance and operation off the use applied for
19 will not, under the circumstances of this case, be detrimental,to the health,
�0 safety, morals, comfort, or general welfare of the persons residing or
working in the neighborhood of such proposed use, nor be injurious or
21 detrimental to the property and improvements in the neighborhood of the
22 subject property, or to the general welfare of the City of Tustin, as
evidenced by the following findings:

1) The proposed temporary use, as conditioned, would not be
24 detrimental to the surrounding properties in that storage of the quarry
,; rocks will not result in erosion or excessive dust.
26 2) As conditioned, the use would not have a negative effect on the
27 surrounding properties in that there would not be excessive truck
traffic on Harvard Avenue and operations will occur only between
28 7:00 a.m. and 4:00 p.m., Monday through Thursday.
�9 3) As conditioned, the use would terminate by August 31, and no later
than November 30, 2000 and the applicant would be required to
remove all excess quarry rock and related equipment.

3 E. That this project is Categorically Exempt from the requirements of the

CONDITIONS OF APPROVAL
AMENDMENT TO
CONDITIONAL USE PERMIT 99-025
GENERAL
(1) 1.1 The proposed use shall substantially conform with the submitted pians for
;the project date stamped March 27, 2000, on file with the Community
Development Department, except as herein modified, or as modified by the
Director of Community Development in accordance with this Exhibit. The
Director of Community Development may also approve minor modifications
to plans during plan check if such modifications are to be consistent with the
provisions of the Tustin City Code and other applicable codes.
(1) 1.2 Approval to amend Conditional'Use Permit 99-025 is contingent upon the
applicant signing and returning an "Agreement to Conditions Imposed" form
as established by the Director of Community Development.
(1) 1.3 The applicant shall hold harmless and defend the City of Tustin from all
claims and liabilities arising out of a challenge of the City's approval of this
project.
USE RESTRICTIONS
(1) 2.1 The Temporary Use approved under this Conditional Use Permit shall
expire on August 31, 2000. The applicant shall remove all quarry rock and
equipment prior to the expiration date of this permit.
(1) 2.2 Time extensions may be granted by the Community Development Director if
a written request is received by the Community Development Department
---. by August 31, 2000. An extension up to ninety (90) days may be granted
subject to review and approval by the Community Development Director.
(1) 2.3 All operations, including engine warm-up, and deliveries and- pick-up of
materials and equipment, shall be subject to the provisions of the Tustin
Noise Ordinance and shall take place only between the hours of 7:00 a.m.
and 6:00 p.m., Monday through Friday, and between 9:00 a.m. and 5:00
p.m. on Saturday, unless otherwise determined by the Building Official.
(1) 2.4 No more than 10,000 tons of quarry rock and one (1) loader may be
stored on the site at one time.
(1) 2.5 Movement of quarry rock will occur only during the hours of 7:00 a.m. and
4:00 p.m., Monday through Thursday unless otherwise approved by the
Director of Community Development.

BACKGROUND
Section 65402(b) of the California Government Code (State Planning and Development
Law) requires counties to inform and obtain general plan conformity from .the local
planning agencies prior to- acquisition or disposition of real property. The Orange County
Health Care Agency is proposing to enter into a lease agreement for approximately 950
square feet located at the C.E. Utt School located 'at 13601 Browning Avenue (see
Location Map): The proposed space would be used for physical and occupational therapy
services-to physically disabled school age children. This location would be operated by a
maximum of 4-6 staff members depending on the case load for the day. The County has
a case load of approximately 125 students from the Tustin Unified and Irvine Unified

School Districts that would be using the services. The majority (66%), of these students
would be using the services twice a year. The remaining number (34%) of the students
are more active and use the services 2-3 times a week. The program will operate from -
7:00 a.m. to 5:00 p.m. Monday.through Thursday. The services provided include individual
and group therapy; consultation with parents; consultation with doctors .and related
medical personnel; and home consultation to assess and advise on the student's activities.
The Planning Commission is authorized to,determine whether the location, purpose, and
extent of the proposed lease is consistent with the General Plan.
The Tustin General Plan Land Use - Map classifies the proposed , site as
"PublictInstitutional". The Public/Institutional designation provides for a wide- range of
public and quasi-public uses (i.e. schools, churches, child care centers, etc.). Goal 8 of
the General Plan Land Use Element states-"Ensure that necessary public facilities and
services are available to accommodate development proposed on the Land Use Policy
Map,
The proposed' therapy and counseling services for school age children would be
compatible with the school use and would provide a service to students and parents within
the Tustin Unified and rlrvine Unified School Districts. As such, the location, purpose, and
extent of the proposed lease is in conformance with the City of Tustin General Plan and
the Land Use Policy Map. i
