4. Conditional Use Permit 98-032 is a request to amend the Master Sign Program
for the Tustin Marketplace to allow pad tenants occupying a building of at least
10,000 square feet as a sole tenant to have an aggregate total of up to 300 square
feet of signage, allocated among up to four elevations with no more than 150
square feet on any one elevation. The project is located at 3030 EI Camino Real
within the East Tustin Specific Plan Mixed Use Land Use designation.

authorization to amend the Jamboree Plaza District regulations Section 3.4.b.4 to
list veterinary surgical clinics as conditionally permitted uses within Planning Area
D and to amend Section 3.7.f.2 to include parking ratios for medical uses. CUP
98-28 is a request to establish a veterinary surgical clinic within Building 22 at
Jamboree Plaza at 2955 Edinger Avenue within the Planned Community Industrial

Minoo Asliabi presented the subject report.
Commissioner Jones asked for height of the berm and if the sign would be installed at
grade.
Minoo Ashabi responded that the berm is from .,I 'foot to 3 feet and portions. of the
pedestal will'be hiddenby the berm.
Commissioner Kozak asked staff to,-compare this-sign to.,the ;Unocal monument sign.
and stated his concern about weakening the:sign code.
The Director indicatedthat- staff would check on,the size of.the Unocal sign and the
Unocal sign is part of a larger center tn'at'has different sign regulations.

Commissioner Davert noted that the Unocal monument sign is not on the corner and,
maybe a little smaller:
Commissioner Kozak stated that the sign was well'designed and he supports adoption.
Chairperson Pontious inquired if the findings could be changed to indicate combining
the two signs into one. s a
The;.Director provided additional language to be added to Finding D1 to identify that the
copy area contains price and bdsiness identification information.
Commissioner Davert moved Commissioner Kozak seconded, to adopt
Resolution No. 3635, as revised, approving Sign Code Exception 98-005. Motion

STAFF CONCERNS:
5. Report on Actions taken at the December 7, 1998 City Council Meeting
Elizabeth A. Binsack, Community Development Director presented the subject report.
COMMISSION CONCERNS:
Commissioner Davert
Noted that the Tustin Lanes sign was still purple:
Commented about the proliferation of commercial real estate signs.
Asked. if the City would be developing an e-mail system that would be
accessible to the public.
The Director responded that staff is working on a City web site and currently have
an internal e-mail system and offered her own 'e-mail address.
- Stated his pleasure with the media attention MCAF Tustin has been
receiving and asked when the EIR would be finaled.
The Director stated that the Elk would be finaled sometime in-March or April.
Wished everyone a Happy Holiday.
Commissioner Jones
Complemented the City's contract tree trimmers for,their work and excellent
customer service.
The Director stated that she would forward the comment to the City's Public Works
Department.
Asked if the large temporary banner at Enderle Center on the corner of
Yorba and Vandenberg was permitted.
The Director responded that staff temporarily permitted the banners because the
center could not get their monument signage prior-toathe holidays.

BACKGROUND
The applicant is requesting approval to establish a pre-school for children ages 2 to 6 years old in.
an'existing building at 1.091. Bryan Avenue. The property is currentlyimproved with a single
family home which has been modified and used commercially. The property is surrounded by
medical office buildings to the east and north, an adult care home to the west, and offices and
veterinarian clinic to the south (see Location Map). The establishment of a nursery
school/preschool is authorized by Section 9232bo) of Tustin City Code with the approval of a
Conditional Use Permit. Design Review is required for exterior modifications to the building.

DISCUSSION
Project Description/Use
The proposed pre-school would accommodate 60 students and would employ 5 teachers and I
director. The applicant indicated that there would be 95-100 percent occupancy between
September to June, and 50 percent occupancy between July and August. The pre-school will
operate Monday through Friday, with school hours proposed from 8:20 A.M. to 2:45 P.M. The
school will conduct five classes-each day: two classes for younger children, two classes for pre-
kindergarten children, and one older children's class. All start and dismissal times.are staggered in
fifteen (15) minutes intervals to avoid parking and circulation congestion. For those children who
need extended care before and after the class hours,extended childcare will be provided from 7:00
a.m. to 6:30 p.m.
Site Plan
Vehicular Circulation
The proposed site plan indicates a one way circulation along the front of the building. Condition
No. 4.3 requires installation of"Entrance Only and Exit Only"signs to regulate traffic circulation.
To avoid congestion in the front of the building, the front parking area is designated'as a drop-off
and pick-up area only. Should parents wish to enter the building for any reason, they will be
required to park at the rear of the.building. Condition No. 2.2 requires installation of signs which
designate the front parking spaces as loading and unloading only. If in the future the City is
advised that a parking or traffic circulation problem exists-on the property as a result of this
establishment, the applicant will be required to prepare a parking demand analysis or traffic study.
If said study indicates that there is inadequate parking or a traffic problem, the applicant will be
required to provide mitigation measures to be reviewed and approved by the Planning Commission
(Condition No. 2.3).
Parking Requirements
Section 9232(b) (j) of the Tustin City Code requires one (1) parking space for each staff member
and one(1) loading space for each eight(8) children. The Code also requires that loading spaces be
located for easy circulation and not interfere with other required parking.
The proposed site plan indicates 4 drop-off spaces at the front of the building,-and 4 drop-off and 6
staff parking spaces to the rear of the building. Although the number of spaces provided would
meet the code requirement, the City's Traffic Engineer has a concern with the possibility of 60
vehicles dropping off and picking up students at the same time. As noted above class start times

and dismissal times are staggered to reduce congestion on the property and Bryan Avenue.
Condition No. 2.9 requires the applicant to have parents sign an,acknowledgement which indicates
parking restrictions.
The parking restrictions include:
■ No parking in adjacent lots;
■ Parents who need to leave the car must park in the rear parking lot;
■ Parking along the front is for loading and unloading only; and
■ No line-up or parking along the curb on Bryan Avenue is permitted.
FIoor Plan/Elevations
The proposed site plan shows an addition of 989 square feet to the front and rear of the existing
2,305 square feet building. The front addition consists of a child restroom facility and an
enlargement of a classroom. The rear addition consists of an additional classroom and enlargement
of two classrooms.
• Improvements to the building elevation include installation of decorative brick veneer along the
front, and portions of the sides of the building. The existing glass storefront will be removed and
replaced with stucco and a shadow box to create the appearance of a window. New windows and
doors will be installed through out the building to accommodate Uniform Building Code and
Uniform Fire Code requirements as they relate to exits and openings requirements. The building
• will be painted with an Off-white (Soft Shimmer) color and the trimmings will be painted with a
Taupe (Simply Taupe) color. A new roof will be installed utilizing wood-tone asphalt shingles.
The front decorative wall will be demolished to provide parking spaces and landscape areas.
Perimeter Wall
The property is currently surrounded,by a five-foot high solid wall along the eastern, northern and
western property lines, and a five-foot perforated wall along the front of the existing building. The
applicant wishes to maintain the perimeter solid block walls and utilize them as screening for the
play area along the rear. Tustin City Code Section 9232 (b) 0) requires outdoor play areas to be
screened from surrounding properties by a 6'8" high solid wall or fence. The applicant submitted a
request to use of the existing five-foot wall as the screening. The City, in the past,has granted this
request since State law regulating child`-care facilities only requires a four-foot high fence.
Condition 2.7 is included for the Planning Commission consideration.

Landscaping
The property is currently improved with minimal landscaping along the front of the property. New
concrete walkway and landscape areas will be provided around the building. A five-foot landscape
area along the front property Iines will also be provided to create a buffer for the parking area. A
five-foot landscape area is proposed along the front of the building. Four trees and shrubs will be
planted in the front planter adjacent to the sidewalk to screen the parking area from the street.
To the rear of the property, annuals will be planted within planters in the parking area. Existing
lemon/tangerine trees will remain in the playground area to the rear of the building'. The applicant
will provide new turf on the entire area of the playground. To the west of the property, adjacent to
the playground area, is a driveway of an adult care facility that leads into a'parking area. No
immediate rooms are adjacent to the playground area. Thus, with the existing trees within the
playground area and the existing trees along the driveway of the adjacent lot, sufficient screening
would be provided.
Noise
Noise may be generated from the outdoor playground area and may affect the adult care facility.
Therefore, Condition No. 2.3 is included to ensure if in the future the City is advised that a noise
problem exists as a result of the school, the City may require a noise analysis be prepared which
include mitigation measures.
ANALYSIS
In determining whether to approve the Conditional Use Permit, the Planning Commission must
determine whether or not the proposed pre-school will be detrimental to the health, safety, morals,
comfort and general welfare of the persons residing in or working in the neighborhood or whether it
will be injurious or detrimental to property or improvements in the vicinity or to the welfare of the
City.
A decision to approve this request is supported by the following findings:
1) As conditioned, the proposed use will not be detrimental to nor have a negative effect on
surrounding property owners in that the preschool will provide adequate student
loadinglunloading areas and staff parking, and the number of students and staff allowed at
any time will be limited by the total number of parking spaces provided for the site.
2) As conditioned, the proposed circulation will not be detrimental to the surrounding
properties in that the property shall have a one-way traffic circulation at the front of the

property with signs to be installed indicating "Entrance"Only" and"Exit Only", and that the
parking spaces at the front of the property shall be designated as loading and unloading

I. The Planning Commission finds and determines as follows:

9 A. That a proper application for a Conditional Use Permit was filed by Barbara J. Kruil
to establish a pre-school in an existing building at 1091 Bryan Avenue, more
10 specifically described as Assessor's Parcel No. 500-131-09.
11 B. That the proposed use is allowed within the Retail Commercial (Cl), with the
12 approval of a Conditional Use Permit(TCC 9232).
13 C. That a public hearing was duly called, noticed and held on said application on
14 January 11, 1999 by the Planning Commission.
15 .D.' That the establishment, maintenance and operation of the use applied for will not,
under the circumstances of this case, be detrimental to the health, safety, morals,
16 comfort, or general welfare of the persons residing or working in the neighborhood
17 of such proposed use, nor be injurious or detrimental to the property and
improvements in the neighborhood of the subject property, or to the general welfare
18 of the City of Tustin, as evidenced by the following findings:

GENERAL
(1) 1.1 The proposed project shall substantially conform with the submitted plans for the
project date-stamped January 11, 1999, on file with the Community Development
Department, except as herein modified, or as modified by 'the Director of
Community Development in accordance with this Exhibit. The Director of
Community Development may also approve minor modifications to the plans if
such modifications are consistent with the provisions of the Tustin City Code.
(1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be
complied with prior to the issuance of any building permits for the project, subject
to review and approval by the Community Development Department.
(1) 1.3 The subject project approval shall become null and void unless the use is established
within twelve (12) months of the date of this Exhibit. Time extensions may be
granted if a written request is received by the Community Development Department

USE RESTRICTIONS
(4) 2.1 A total of 60 students are authorized by CUP 98-023. The maximum number of
occupants in the preschool shall be limited by the total number of parking spaces
provided on site based upon the following ratios:
Preschool: 1 parking space for each staff member,plus 1 Ioading space for each
eight children
If student enrollment is increased, the applicant shall request an amendment, subject
to review and approval of the Planning Commission.
(4) 2.2 A minimum of three spaces in the front parking lot shall be marked by either
painting the curb or installation of signs as restricted for children Ioading and
unloading only during peals period hours. Said spaces may be used for parking
during non-peak periods.
(4) 2.3 If in the future the City is advised that a parking, traffic, or noise problem exists on
the site or in the vicinity as a result of the school, the Director of Community
Development may require the applicant to prepare a parking demand analysis,
traffic study, or noise analysis. If said study indicates that there is inadequate
parking or a traffic or noise problem, the applicant shall be required to provide
mitigation measures to be reviewed and approved by the Planning Commission.
Said mitigation may include,but are not limited to,the following:.
a_ Adjusting hours of operation;
b. Securing off-site parking from adjacent property owners; and,
C. Limiting student enrollment.
(4) 2.4 Any graffiti occurring on the properly shall be removed within 72 hours of a
complaint being transmitted by the City to the property owner. Failure to maintain
said structure and adjacent facilities would be grounds for City enforcement of its
Properly Maintenance Ordinance,including nuisance abatement procedures.
(4)7 2.5 The front gate leading to the rear parking lot area shall remain open during business
hours.

(4) 2.6 In accordance to the Tustin City Code Section 8402 (a), all electrical, telephone,
community antenna, television and similar services wires or cables which provide
direct service to the property being developed, shall, within the exterior boundary
lines of such property,be installed underground.
(4) 2.7 The outdoor play area shall be separated from surrounding properties by a minimum
of five (5)foot high solid wall or fence.
(6) 2.8 The applicant shall install two 24"box trees within the five foot front landscape area
and two 24"box trees within other landscape area along the front property line.

(4) 2.9 The applicant shall provide the City with a statement that must be signed by each
parent upon enrollment which indicates parking and circulation restrictions. The
restriction shall include the following:
■ No parking in adjacent lots;
■ Parents who need to leave the car must park in the rear parking Iot;
• ■ Parking along the front is for loading and unloading only; and
■ No line-up or parking along the curb on Bryan Avenue is permitted.

(3) 3.3 Plans shall comply with 904.2.4.1. U.B.C. for fire sprinkler requirements.
(3) 3.4 In accordance with the Private School Safety Act,the design professional
submitting construction documents must be a licensed architect or civil engineer.
(3) 3.5 When submitting for a building permit, submit four sets of plans, two sets of
structural calculations, acoustical-reports, specification and soils reports.
Electrical,mechanical and plumbing plans shall be included. Landscaping plans
and sign plans shall be submitted separately.
ENGINEERING
(5) 4.1 A street improvement plan shall be submitted and shall identify the installation of
red curb on the approaches to the proposed driveways. The street improvement plan
shall include a stripping pattern(to scale)on Bryan Avenue.
(5) 4.2 The dimensions of the adjacent driveways shall be included on the street
improvement plan.
(5) 4.3 Access signs indicating "ENTRANCE ONLY • Exit -+" and "EXIT ONLY-
Entrance —>" shall be maintained on site. Prior to installation, the location and
dimension of signs shall be approved by the Community Development Department
and Public Works Department.
FIRE AUTHORITY
(5) 5.1 Fire Hydrants
Prior to the issuance of any building permits,the applicant shall submit to the Fire
Chief evidence of the on-site fire hydrant system and indicate whether it is public
or private. If the system is private, the system shall be reviewed and approved by
the Fire Chief prior to issuance of building permits. Provisions shall be made by
the applicant for the repair and maintenance of the system, in a manner meeting
the approval of the Fire Chief. A fire hydrant shall be located within 150 feet of
all exterior portions of the building.
(5) 5.2 Fire Access
Prior to issuance of any building permits,the applicant shall obtain approval of
the Fire Chief of all fire protection access locations. Obstructions within the fire
protection access locations are prohibited. The approval of the Fire Chief is

required for any modifications such as speed bumps, control gates or other
changes that would affect Fire Authority access. A fire lane with turning radius,
apparatus turnaround, signage and widths meeting the requirements of the OCFA
shall be provided on the east side of the building or provide access through the
new proposed concrete'wall on the west side of the building by a gate meeting the
requirements of the OCFA. The lockable grill gate on the south,side of the
building shall be approved by the Fire Chief.
(5) 5.3 Street Plans
Prior to the issuance of any building permits,the applicant shall submit and obtain z
approval of preliminary plans for all streets and courts,.public or private, from the
Fire chief in consultation with the Manager, Traffic Engineering. The plans shall
include the plan view, sectional view, and indicate the width of the street or court
measured flow line. All proposed fire apparatus turnarounds shall be approved by
the Fire Chief and be clearly marked when a dead-end street exceeds 150 feet or
when conditions require it. Both vehicular entrance and exit driveways shall be a
minimum of 20 feet wide.

(5) 5.4 Street Markings
a) Prior to the issuance of any building'permits, the applicant shall submit
and obtain approval from the Fire Chief for street improvement plans with
fire lanes shown. The plans shall indicate the Iocations of red curbing and
signage. A drawing of the proposed signage with the height, stroke and
color of lettering and the contrasting background color shall be submitted
to and approved by the Fire Chief.
b} Prior to the issuance of the certificate of use and occupancy,the approved
fire lane marking plan shall be installed. The applicant shall develop a fire
lane map and provisions which prohibit parking in the fire lanes. A
method of enforcement shall be included.
(5) 5.5 Access Gates
Prior to the issuance of any certificate of occupancy permits, the applicant shall
submit and obtain the Fire Chief's approval of the construction details for any
access gate. Contact the Orange County Fire Authority Plan Review Section at
(714) 744-0403 for a copy of the"Guidelines for Fire Authority.Emergency
Access".

(5) 5.6 Water Availability
Prior to the issuance of any building permits, an Orange County Fire Authority
Water Availability Form shall be submitted to and approved by the Plan Review
Section of the Orange County Fire Authority. If sufficient water to meet fire flow
requirements is not available, an automatic fire extinguishing system shall be
installed in each structure, in a manner meeting the approval of the Fire Chief.
(5) 5.7 Architectural Plan
Prior to the approval of a site development/use permit, or the issuance of a
building permit, whichever occurs first,the applicant shall submit plan for the
review and approval of the Fire Chief. The applicant shall include information on
the plans required by the Fire Chief. Contact the Orange County Fire Authority
Plans Review.Section at(71.4) 744-0403 for the Fire Safety Site/Architectural
Notes to be placed on the plans.
(5) 5.8 Fire Alarm System
Prior to the installation,plans for the fire alarm system shall be submitted to and
approved by the Fire Chief. This system shall be operational prior to the issuance
of a Certificate of Use and Occupancy.
SIGNS
(4). 6.1 Prior to construction and installation of any wall signs, a complete sign plan shall be
submitted which addresses all proposed monument, wall, direction and address
signs, subject to the approval of the Community Development Department. The
sign plans shall include dimension, materials, colors and method of illumination for
each proposed sign.
FEES
(1) 7.1 Prior to issuance of any building permits,payment shall be made of all applicable
fees, including but not limited to the following. Payment shall.be required based
upon those rates in effect at the time of payment and are subject to change.
a) Building plan-check and permit fees to the Community Development
Department based on the most current schedule.

b) Orange County Fire Authority plan-check and inspection fees to the
Community Development Department based upon the most current schedule.
c) New development fees in the amount of $.10 per square foot for the 989

e) Payment of Sewer Connection Fees in the amount of$2,360 at the time a
building permit is issued.
(1) 7.2 Within forty eight(48)hours of approval of the subject project,,the applicant shall
deliver to the Community Development Department, a cashier check payable to
the COUNTY CLERK in the amount of$38.00 (thirty eight dollars)to enable
the City to file the appropriate environmental documentation for the project. If
within such forty eight(48)hours period that applicant has not delivered to the
Community Development Department the above noted check,the statute of
limitations for any interested party to challenge the environmental determination
under the provisions of the California Environmental Quality Act could be
significantly lengthened.

BACKGROUND AND DISCUSSION
The Tustin Village Townhomes community is a 118 unit owner-occupied townhome complex
located at-the southwest comer of the intersection of the 1-5 Santa Ana Freeway and the SR-55
Newport Freeway at 15500 Tustin Village Way. In 1995, Caltrans completed their work on the
reconfiguration of the 1-5/SR-55 freeway interchange. In reconfiguring the interchange, Caltrans
abandoned a parcel that was a portion of the freeway right-of-way. This .5 acre parcel is situated
along the eastern edge of the Tustin Village Townhomes complex. The parcel abuts the
Townhome complex and is separated from the current freeway right-of-way by a sound wall (see
Location Map). `
The Tustin Village Community Association purchased the parcel from Caltrans with the intent of
paving a portion of the parcel for additional guest parking,spaces and landscaping the remaining
area. The City had the first option to acquire the parcel, but the City Engineer had found that there
was no public need for the parcel. To make use of the parcel,the Zoning District and General Plan
Designation must be changed. Currently,the parcel is zoned "Unclassified" (U) and is designated
"Transportation" by the General Plan. This application would change the Zoning District to
"Planned Development (PD)and change the General Plan Land Use Designation to "High Density
Residential".(see Zone Change and General Plan Amendment Exhibits to Resolution No. 3643).
These designations are consistent with the Zoning District and Land Use Designations of the
Tustin Village Townhomes Complex.
No formal plans for any improvements on site have been submitted, however, accessory structures
such as residential parking facilities is a permitted use within this Planned Development and future
improvements would require building permits. Any other improvements would be subject to
applicable discretionary actions.
ENVIRONMENTAL
Attachment C is the Initial Study/Negative Declaration prepared for this project. Notice of the
Negative Declaration public comment period was provided from December-25, 1998, through the
Planning Commission and City Council meetings. No significant impact's were identified. Any
potential impacts would be relat to the approval of future projects.

GENERAL PLAN AMENDMENT 98-002 AND ZONE CHANGE 98-005
ANALYSIS
The proposed project involves amending the General Plan Land Use Designation,and
Zoning District of an abandoned portion of Caltrans right-of-way. The proposed
amendments would not create significant impacts. Any potential impacts would be
associated with discretionary approval of future projects at the subject location, if proposed.
Additional environmental review and analysis would be conducted at the time that a
specific project is proposed to be implemented in accordance with the Tustin City Code
and the California Environmental Quality.Act. -
Since the proposed amendment is regulatory in nature, no potential impacts related to land
use, planning, population, housing, geology, water quality, air quality, transportation,
circulation, biological resources, energy or mineral resources, hazards, noise, public
services, utilities, aesthetics, cultural resources, or recreation are anticipated. In addition;:

BACKGROUND
In September 1997, the Planning Commission approved Conditional Use Permit 97-010
by adopting Resolution No. 3545 for .the current Master Sign Plan for the Tustin
Marketplace, located at the intersection of Jamboree Road and the 1-5 Santa Ana
Freeway (see Location Map). The applicant is requesting an amendment to the Master
Sign Plan to allow pad tenants that occupy a buildingof at least 10,000 square feet of
floor area as a sole tenant to have an aggregate total of 300 square feet of signage
and/or logos allocated as desired among up to four elevations, not to exceed 150 square
feet on any one elevation (Attachment B). The site is within the East Tustin Specific Plan
Mixed Use land use designation and all.signs on the property are regulated by the Master
Sign Plan for the Tustin.Marketplace. Section 9403(h)(2)(e)of the Tustin City Code Sign
Regulations allows flexibility for master sign plans with the approval of a Conditional Use
Permit.
Surrounding properties are developed withresidential uses to the north.and commercial
uses to the;east, west and south.
PROJECT DESCRIPTION
AMENDMENT
The applicant is proposing to amend Section C of the,"Sign Type Criteria for Tenant Signs"'
section of the Tustin Marketplace Master Sign Program (see Attachment B). Pad tenants
who occupy a building of at Ieast 10,000 square feet are allowed a maximum of 220
square feet total of sign copy area to be allocated among up to four building elevations, as
desired (CUP 93-028). Sign copy includes actual text, closed line logos and figures, and
open line designs. Multiple sign elements are allowed per elevation provided the
maximum total sign copy area is not exceeded, as noted above. The amendment would
authorize pad tenants who occupy a building of at least 10,000 square feet of floor area as
a sole tenant to have a maximum of 300-square feet total of signage and/or logos.
Signage would be allocated among up to four elevations as desired, but with a maximum
of 1'50 square feet of sign area on any one elevation.
The proposed amendment would apply throughout the Tustin Marketplace, however, the
Black*Angus restaurant is the only pad tenant that would be able to make use of the
proposed amendment. All other pad tenant- buildings are either occupied by multiple
tenants or are smaller than 10,000 square feet in size (see Attachment C - Site Plan).

WALL SIGNS
The existing signage is installed on three of the building elevations. The entry tower facing
Jamboree Road currently has a neon "Cowboy, Fire, and Smoke" logo (16 square feet)
installed between the columns with "Stuart.Anderson's" and "Black Angus" copy (total of
60 square feet) above and below the logo. There are two neon "Cow" logos totaling 64
square feet mounted on the side elevation facing EI Camino Real. On the rear elevation
facing the parking area, there is currently"Black Angus" copy (28 square feet) and a neon
"Cowboy, Fire,.and Smoke" logo (38 square feet), for a total of 206 square feet of signage
for all elevations. Sign copy and logo area is calculated using regular geometric outlines
around the logos or copy.
The applicant is proposing to :remove the signage and logo on the entry elevation and
replace them with a 36 square foot"Cowboy, Fire, and Smoke" logo mounted between the
entry columns and "Black Angus" open channel letter sign copy (57 square feet) mounted
above the logo on the fascia of the tower, for a total of two (2) sign elements on that
elevation. Three bands of neon (ruby, purpie, and emerald) are also to be mounted along
the upper-entry fascia, as 'is existing on the side columns and rear elevation (see
• Attachment C.1 - Submitted Plans). The "Cow" logos on the side elevation are proposed
to remain, and-a second open channel letter "Black Angus" sign of 57 square feet would
be installed on the center of the-building elevation facing El Camino Real, for a total of
three (3) sign elements on the elevation (see Attachment C.2 - Submitted Plans). The
existing sign copy and iogo_on the rear elevation are proposed to remain as is (Attachment

ANALYSIS
The proposed amendment to the Master Sign Plan meets the criteria as identified in TCC
Section 9403h(2) in that:
1. The signs reflect a common theme, incorporating design elements, in terms of
materials, letter styles, colors, illumination, sign'type and sign shape. The new wall
signs utilize open channel letters, logos and, neon banding, as encouraged by the,
existing,Master Sign Plan.
2. All of the new signs- utilize: materials, colors, and a design: motif which are
compatible and reflect the special qualities of the architecture of the existing.
buildings both in- daytime and nighttime settings. , The Tustin Marketplace
encourages larger scale signage and distinctive designs that complement the multi;-
colored
ulti=colored stucco buildings.
3. Provisions of the proposed Master Sign Program may be less restrictive than the
standards for' permanent business identification within the Tustin 'Sign Code
provided.the center is greater than one acre in size.
In determining whether to approve this Conditional Use Permit, the Planning Commission
must determine whether or not .the Master Sign Plan will be detrimental to the health,
safety, morals, comfort and general welfare of the persons residing in or working in the
neighborhood or whether it will'be injurious or detrimental to property or improvements in
the vicinity or to the welfare of the City.
A decision to approve this request may be-supported by-the following findings:
1. The Master Sign Program, as conditioned, wili not be detrimental to the health,
safety, morals, comfort and general welfare of the persons residing in or working in
the neighborhood of the use, nor will. it be injurious or detrimental to property or
improvements in the vicinity or to the general welfare of the City in that:
a) The new wall signage uses materials, colors, and styles complementary to
existing signage and buildings within the Tustin Marketplace-, and,
b) The signage allowed under the Master Sign Program uses materials, colors,
and styles appropriate fora mixed-use commercial and entertainment

B. That a master sign plan less restrictive than the sign code is allowed
14 pursuant to Tustin City Code Section 9403(H)(2)(e) with the approval of a

17 on January 11, 1999 by the Planning Commission.
18 D. Pursuant to Sign Code Section 9403h(2), the request to amend the master
sign plan can be supported by the following findings:

20 1. The signs reflect a common theme; incorporating design elements in
terms of materials, letter styles, colors, illumination, sign type and
21 sign shape. The new wall signs utilize open channel, letters, logos
22 and neon banding, as encouraged by the existing Master Sign Plan.
23 2. All of the new signs utilize materials,colors, and a design motif which
are compatible and which reflect the special qualities of the
24 architecture of the existing buildings both in daytime and nighttime
25 settings. The Tustin Marketplace encourages larger scale signage
and distinctive designs that complement the multi-colored stucco
26 buildings.
27 3. Provisions of the proposed Master Sign Program. may be less
28 restrictive than the standards for permanent business identification

a) The new wall signage uses materials, colors, and styles
7 complementary to existing signage and buildings within the
Tustin Marketplace;and,

materials, colors, and styles appropriate for a mixed-use
10 commercial and entertainment center.

c) Increased sign area for Pad Tenants occupying a building of
12 at least 10,000 square feet as a sole tenant is appropriate to
reflect the size and scale of such a building and tenant within
13 a mixed-use center.

E. That this project is categorically exempt -pursuant to Class 11, Section
15 15311 of the California Environmental Quality Act.
16 IL The Planning Commission hereby approves CUP 98-032 for an amendment to the

GENERAL

5 (1) 1.1 The proposed signs shall substantially conform with the submitted plans for
the project date stamped January 11, 1999, on file with the Community
6 Development Department,except as herein modified, or as modified by the
Director of Community Development in accordance with this Exhibit. The
Director of Community Development may also approve minor modifications
8 to plans during plan check if such modifications are to be consistent with the
provisions of the Tustin City Code and other applicable codes.

to (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be
complied with as specified or prior to the issuance of any building permits
11 for the project, subject to review and approval by the Community
Development Department.

13 (1) 1.3 The subject.project approval shall become null and void unless permits are
issued within twelve (12) months of the date of this Exhibit and substantial .
14 construction is underway. Time extensions may -be granted if a written
15 request is received by the Community Development Department within
thirty(30) days prior to expiration.

(1) 1.4 Approval of Conditional Use Permit 98-032 is contingent upon the applicant
" and property owner signing -and returning an "Agreement to Conditions

22 City becomes aware of any lighting or signs that are not operable, the
23 applicant shall be responsible for making appropriate repairs within 72
- hours of being notified by the City. The entire sign shall not be illuminated

4 (1) 2.1 All signs shall comply with the applicable provisions of the Uniform Building
5 Code and the National Electrical Code as adopted by the City (including UL
-approvals).

(1) 2.2 All signs, including any change of copy, require review and approval by the

General Plan Amendment 98-002 and Zone Change 98-
005 are requests to amend the General Plan Land Use.
Designation and Zoning District of a .5 acre parcel of
abandoned Caltrans. freeway right-of-way that was
acquired by the Tustin Village Townhomes Community
Association.
Recommendation: Continue this item to the January 19,
1999 City Council meeting as recommended by the
Community Development Department.

Recommendation: Authorize the Mayor and City Clerk to
execute subject Quitclaim Deeds identified as follows:
(1) Temporary construction easement for the
construction of Jamboree Road along the easterly side
from approximately 2800 feet northerly of Tustin Ranch
Road to approximately 1800 feet northerly of the City of
Tustin/City of Orange boundary, and (2) Portions of the
slope maintenance easement along the easterly side of
Jamboree Road from approximately 1500 feet northerly
of Patriot Way to the northerly City limits as
recommended by the ' Public Works Department/
Engineering Division.
APPROVED 13. CONSULTANT SERVICES AGREEMENT FOR DESIGN OF
PASADENA AVENUE RECONSTRUCTION BETWEEN THE
FIRST STREET CUL-DE-SAC AND THE MAIN STREET
CUL-DE-SAC (CIP NO. 700.157) AND SECOND STREET
RECONSTRUCTION BETWEEN PASADENA AVENUE AND
MYRTLE STREET (CIP NO. 700158)
Recommendation: Approve Consultant, Services
Agreement with Berryman and Henigar to provide design
related services for Pasadena Avenue. Reconstruction
(CIP No. 700157) and Second Street Reconstruction
(CIP No. 700158) for a not-to-exceed fee of $42,082.00
and authorize execution of the Consultant Services
Agreement by the Mayor and City Clerk subject to
approval by the City Attorney as recommended by the
Public Works Department/Engineering Division.
