HomeMy WebLinkAboutCC RES 98-065 RESOLUTION NO. 98-65 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING 3 FINAL TRACT MAP 15563, THE FIRST OF TWO FINAL MAPS FOR TENTATIVE TRACT 14396, LOCATED LOTS 12, 13, 24 AND 25 OF TRACT 13627 4 5 The City Council of the City of Tustin does hereby resolve as follows: 6 I. The City Council finds and determines as follows: ? A. That Final Map 15563 has been submitted by Irvine Community g Development Company; 9 B. That a public hearing was-duly called, noticed and held for Tentative Tract ~0 Map 14396 on August 11, 1997. At this hearing, the Planning Commission recommended that the City Council approve said map. Subsequently, the ~ City Council approved Tentative Tract Map 14396 on August 18, 1997; C. That, pursuant to Section '66456.1 of the Subdivision Map Act, the Subdivider intends to file multiple final maps in relation to approved Tentative Tract Map. 14396. Final Tract Map 15563 is the first of such final maps; D. Pursuant to Section 15268(b) (Ministerial Projects) of the California Environmental Quality Act, the Final map is considered statutorily exempt from the requirements of CEQA; E. That the proposed subdivision is in conformance with the Tustin Area ~s General Plan, adopted East Tustin Specific Plan, Development Agreement. ~9 as amended and Subdivision Map Act as it pertains to the development of single-family dwellings; 20 F. The 1.4238 acres of parkland required for this development was previously dedicated with recordation of Tract 13627; 22 G. That the City has reviewed the status of the School Facilities Agreement 23 between the Irvine Company and the Tustin Unified School District, for the impact of Tentative Tract 14396 on School District facilities, and changes in 24 state law. The impacts associated with this approval on School District 25 Facilities are adequately addressed; H. That the site is physically suitable for the type of development proposed; 27 I. That the site is physically suitable for the proposed density of development; 28 29 Resolution No. 98-65 Page 2 1 J. That the design of the subdivision or the proposed improvements are not 3 likely to cause substantial environmental damage or substantially and 4 avoidably injure fish or wildlife in their habitat; K. That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public, for access through or use of the property Within the proposed subdivision; 7 L. That the design of the subdivision o~ the types of improvements proposed s are not likely to cause serious public health problems; M. The proposed project has been determined to be exempt from the provisions of Measure "M" because entitlements specified in the East Tustin Development Agreement entered into in, 1985, and the estimated project generated traffic does not cause the roadway system to exceed established level of service standards; N. That the Final Map is in substantial conformance with the Vesting Tentative Map: ]4 II. The City Council hereby approves Final Map 15563, subject to final approval by the City Engineer. ]?
