RECOMMENDATION That the Zoning Administrator adopt Zoning Administrator Action 96- 010 approving Design Review 96-049. BACKGROUND AND DISCUSSION The applicant proposes to convert 116 ' carport spaces into an equivalent number of fully enclosed garage spaces at the., 160-unit Newpoint Apartments complex, located at 14831-14821,Newport Avenue. No change in total parking would occur as a result. of this proposal. The project site is located on the westerly side of Newport Avenue at its southerly terminus. Surrounding uses include several small r apartment' buildings to the north, the Newport" Freeway (SR-55) to the west, the Santa Ana/Santa Fe Channel to the south, and single- family residences (Tustin Groves) to the east (across Newport Avenue) . i Zoning Administrator Report - Design Review 96•-049 November 12, 1996 Page 2 The project is located in the South Central Redevelopment area'; therefore, final design review approval rests with the Redevelopment Agency. However, City Code Section 9299 (b) (3) (c) grants authority to the Zoning Administrator to approve Design Review applications within .the City's Redevelopment Areas in lieu of the Redevelopment Agency. Project Description There are presently 299 covered and 49 open on-site parking spaces serving the subject property. Among the covered spaces, 183 are located under detached canopy-type covers, supported by posts, unenclosed on all four sides. The remaining 116 covered spaces are integrated into the residential structures and are enclosed on three sides: the applicant proposes to install garage doors at the entrances to these spaces. A total of 69 garage doors are proposed, consisting of 47 double- car doors and 22 single-car doors. The allocation of door sizes is based on the existing spacing of load-bearing posts located within the parking areas. The doors proposed are multi-paneled steel roll-ups with a baked on white polyester paint finish and an embossed woodgrain texture on the exterior faces. All doors will be provided with automatic openers. Frames for the garage doors will be mounted flush with the exterior walls above the carports (to maintain an interior stall depth measurement of 20 feet) and will be stuccoed and painted to match the existing building finishes. Interior partition walls are proposed to provide interior parking bays of up to five vehicles. The ntr dimensions of the parking spaces will not be altered as a�"'x�of the proposed modifications. The proposed improvements are architecturally compatible with the existing structures on-site and will enhance the appearance- of the property. In addition, the project will improve the amenity levels provided by the apartment complex. The project is in compliance . with' the Zoning Code and Parking Guidelines . Gregory-S. The Zoning Administrator finds and determines as follows: 6 A_ That a proper application, Design Review 96- 7 049, was filed by Associated Arts to authorize the conversion of 116 carport spaces into 8 fully enclosed garage spaces 'at Newpoint Apartments, located at 14831-14921 Newport 9 Avenue. 10 B. That the project is located within the South Central Redevelopment area. Pursuant to City 11 Code Section 9299 (b) (3) (c) , the Zoning Administrator has the authority to approve 12 Design Review applications within the City' s Redevelopment Areas. 13 C. Pursuant to Section 9272 of the Tustin 14 Municipal Code, the Zoning Administrator finds that the architectural features, materials and 15 colors will not impair the orderly and harmonious development of the area, the 16 present or future development therein, or the occupancy as a whole. In making such 17 findings, ' the ' Zoning Administrator has considered at least the following items: 18 1. Exterior materials and colors. 19 2 . Physical relationship of proposed 20 structures to existing structures in the neighborhood. 21 3 . Appearance and design relationship 22 of proposed structures to existing structures and possible future 23 structures in the neighborhood and public thoroughfares. 24 4 . Development Guidelines and criteria 25 as adopted by. the.•City Council. 26 D. That the proposed project is categorically exempt (Class 1) pursuant to the California ' 27 Environmental Quality Act 15301. 28 . I 9111 . (1) 1.2 Unless otherwise specified, the conditions contained in the Exhibit shall •be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Design Review approval shall become null and void unless all building permits are issued within eighteen (18) months of the date of this Exhibit . (1) 1.4 The applicant shall sign and return an Agreement to Conditions Imposed form prior to issuance of building permits. (1) 1.5 The applicant and property owner .shall hold harmless and defend the City of Tustin from all claims and liabilities arising out of the City' s approval of the entitlement process for this project. Planning Division (1) 2 .1 Tenants of the subject property only shall be permitted use of the garage spaces, as assigned by the complex management. Tenants shall use the garage spaces solely for the purpose of parking operable vehicles currently registered by the Department of Motor Vehicles for use on public streets, roads and highways . 'Storage of personal items may occur in the garages only to the extent that vehicles may still be able to be parked within the required garage spaces. SOURCE CODES (1) STANDARD CONDITION (2). Building Division (3) 3 .1 At building plan check, provide three (3) complete sets of plans, including the manufacturer' s brochure/ installation manual for the garage doors, complying with the , Uniform Building Code, other related Codes, City Ordinances and state and federal laws .and regulations. (3) 3 .2 Ceilings and walls at garages connected to `residential units shall be protected by materials approved for one- hour fire rating. Fees (1) 4.1 Prior to'the'issuance of any building permits, payment •of all Building plan check and permit fees shall ,be made to the Community Development Department based upon the most current fee schedule. Payment will be required based upon those rates in effect at the time of payment and are subject to change. (1) 4.2 Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier' s check payable to the COUNTY CLERK in the amount of $38 . 00 (thirty-eight. dollars) to enable the City to file the appropriate environmental documentation for .the project. If within such forty-eight •(48) hour period that applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened.
