REQUEST: ESTABLISHMENT OF A CAR RENTAL OFFICE IN AN EXISTING
OFFICE SPACE LOCATED AT, 17251 SEVENTEENTH STREET,
SUITE A.
RECOMMENDATION
That the "Zoning Administrator approve Conditional Use Permit 96-024
by adopting Zoning Admini"strator Action 96-009 .
BACKGROUND & DISCUSSION
The applicant is requesting authorization to establish a car rental
office in an existing multi-tenant commercial center known as the
Tustin French Quarter. The subject site is zoned Commercial
General (CG) . • The proposed use is permitted . in the CG District
subject to a Conditional' •Use Permit (City Code Section 9235 (c) ) .
Site and Surrounding Properties
The Tustin French Quarter shopping center is comprised of 91., 207
square feet of leasing area, and is located on the northwest corner
of Seventeenth Street and Carroll Way. The subject tenant space is
located at 17251 , Seventeenth Street, Suite . A, and is situated on
the westerly portion of the center facing Carroll Way.

Surrounding land uses include single family residential to the east
and north, a service station and retail center across Carroll Way
to the west,. and a retail center across Seventeenth Street to the
south.
Project Description
The applicant proposes to establish a car rental office within a
1, 500 square foot tenant space in .the existing shopping center.
The proposed use is to be for office use only. No sale or leasing
of vehicles is proposed, nor will there be any storage of vehicles
at this -site. The applicant intends to store the rental vehicles
off-site. A ' copy of a leasing agreement for the storage of the,
rental vehicles. at a site located at 2615 South Rouselle Street in
the City of Santa Ana has been provided (See Attachment D) :
The applicant states that 95 percent of the business will be
generated over the phone. The proposed hours of operation will be
from 7 :30 a.m. to 6 : 00 p.m. Monday through Friday; 8 : 00 a.m. to
2 : 00 p.m. on Saturday; and 9 : 00 - a.m. to 1 : 00 p.-m. on Sunday.
The proposed use will- require six (6) parking spaces, based on the
ratio of one (1) parking space per 250 square feet of area. A
Variance was previously approved allowing a reduction in required
parking from 518 spaces to 381 spaces - for the - entire shopping
center. No additional square footage is proposed. The tenant ,
space has previously been occupied .by a variety of retail and
office uses . Therefore, no additional parking spaces are needed to
accommodate- the proposed use.
Customers wishing to rent a vehicle would_- make previous
arrangements over the telephone . If they wish to see the available
vehicles beforehand, they would be directed to the Santa Ana
location. Once arrangements ate made, the vehicle will be brought
from the Santa Ana location and parked in an available .parking
space in the parking area north of the tenant space. No designated
or assigned spaces will be provided. .
Conditions of Approval have been added limiting the parking of
rental cars to one (1) vehicle for a maximum of three (3) hours to
accommodate the transfer of vehicles . Overnight parking •of rental
vehicles will be prohibited. The applicant has agreed to these
conditions .

Discussion
In determining whether to approve a Conditional Use Permit, the
Zoning Administrator must ' determine whether or not the
establishment, maintenance or operation of the subject use is
detrimental to the. 'health, safety, morals, comfort or general
welfare of the persons residing or working in the neighborhood of
the subject site and secondly, whether it will be injurious or
detrimental to property and improvements in the neighborhood or the
general welfare of the City.
The proposed use, as conditioned, will be compatible with the
surrounding community. The proposed site will be used as ani office
use only. Conditions of Approval have been included limiting the
parking of rental cars and prohibiting the storage of vehicles at
the premises . These Conditions are added to prevent any potential
problems at the site and to maintain the professional service and
retail atmosphere of the center. In addition, the shopping center
is buffered from residential properties by Carroll Way to the west
and Medford Avenue to the north.
Approval of this Conditional Use Permit will not be detrimental to
the- character of .development- in the_ immediate neighborhood and will
be in harmony with the various elements ... and objectives of the
General Plan. This use will occur in an existing retail commercial
center, and no exterior modifications are proposed to the office
space. Also, the proposed business hours are compatible with the
surrounding retail commercial uses.
CONCLUSION
Based on the above analysis, staff' recommends approval of
Conditional Use Permit 96-024 to permit the establishment of a car
rental office in, an existing shopping center, subject to the
findings and conditions of attached Zoning Administrator Action
Number 96-009 .

JUSTIFICATION FOR
MINOR CONDITIONAL USE PERMIT
PROJECT LOCATION: 17251-C Seventeenth Street

REQUEST:
The applicant, Adrian Cayetano, respectfully requests approval of
a Minor Conditional Use Permit to allow an automobile rental
business located in the CG Commercial General Zone District in an
existing shopping center. The proposed .use will be automobile
rental, only. There will- be no automobile sales or leasing at this
location. No repairs or washing of vehicles would be conducted on
the premises.
The applicant will voluntarily agree to a condition of no overnight
storage of vehicles on this property.
OBJECTIVE:
Automobile rental provides an alternative transportation source to
the surrounding community. . Our business objective is to provide
-ustomers with a reliable and economical vehicle for short term
se.
PROJECT DESCRIPTION:
This - site location has 1000 square feet of leasable floor area in
an existing shopping center - and would require five (5) parkin
spaces, per code. No changes are being made to the retail -space.
The shopping -center 'contains 90,941 square feet and has 393 parking
spaces. The parking ratio is 1 parking space for each 230 square
feet of gross leasable area. A variance was previously approved to
permit 384 total parking spaces for the shopping center.
The applicant plans to utilize one of the allocated parking spaces
for rental vehicles that would be provided to customers.
Arrangements have been made for off-site storage of rental
vehicles. No repairs or washing of vehicles will be conducted on
the premises.
RENTAL OPERATIONS:
Topically, customers call in over the phone to make arrangements '
pick-up or delivery of vehicles. Ninety-five percent of
customers come from phone calls. Most sales come from the "yellow
pages" and most transactions are via credit card.
Approximately 40 percent of - the business is to serve community
needs, i.,e. : alternative transportation while a vehicle is being
repaired at a local garage, vacation transportation, or utilization
f a larger passenger vehicle; approximately 40 percent is from
nsurance replacement associated with collision repairs; and 20
percent, of the business is tourist related. Very few of our
customers will be "walk-ins".

About 90 percent of the rental fleet will be vehicles from 1-3
years old. They will consist of automobiles plus a mini-van and/or
utility vehicle. No overnight storage is contemplated on-site and
washing and storage of vehicles will occur off-site. Only one car
would be parked. on the site.
This business is built based on 85-90 percent utilization of
vehicles. Typically with- a fleet of 10 cars, one or two will be
in, while the rest are rented out. Customers would call in to
rent, and arrangements would be made for pick-up or delivery of the
vehicle. When the rental is completed customers would drop-off the
vehicle at the site. Then the vehicle would be moved off-site for
overnight storage.. If a customer was waiting, it would be washed
off-site and made available to the next customer.
This operation will start with five cars, then grow to ten cars,
and eventually, over time, may increase to about twenty cars.
Again, storage of vehicles will occur off-site.
CUP JUSTIFICATION:
1 . The location of this proposed automobile rental business will
be desirable to the public, convenience and welfare.
This use will occur at the Tustin French Quarter neighborhood
shopping center, and should have no impact on adjacent
residential properties. The proposed .store _lo.cation will be
:.-at the rear-of. the-=center, with access from Carroll Way.
-2 . --The proposed automobile rental use will be proper in relation
to adjacent uses or the development of the community.
This use will- be compatible with' the surrounding community.
There will be no overnight storage or washing of rental
vehicles at this location. The shopping center is buffered
from R-1 single-family residential properties by Carroll Way
to the west and Medford Avenue to-the north. - Proposed hours
of operation will be from 7:30AM to 6: OOPM, Monday through
Friday; 8: OOAM to 2: OOPM on Saturday; and 9:.00AM to 1: OOPM on
Sunday.
3 . Approval of this CUP will not be detrimental to the character
of development in the immediate neighborhood and will be in
harmony with the various , elements and objectives of the
General Plan.
This use will occur in an existing retail commercial center.
No construction is involved. Providing automobile rental on
this site will not be detrimental to the :character of
development in this immediate neighborhood. Operation of this
automobile. rental use will be in harmony with the various
-elements and objectives of-the City of Tustin General Plan.

-Ana, California. As agreed, we could provide parking spaces for 10 vehicles, on as needed basis by your
operation. The rental of the space will be between$2004500 per month depending on the actual usage
of .our space. While we have good security (fences, alarms, locks) and did not have any negative
experiences in the past,you agree to provide Insurance on your vehicles that covers theft or vandalism and
wfll provide a copy of such insurance policy fdr our hoes.

CONDITIONS OF APPROVAL
CONDITIONAL USE PERMIT 96-024
GENERAL
(1) 1.1 The proposed project shall substantially conform with the
submitted plans for the project date stamped August 19,
1996 on file with the Community Development Department,
as herein modified or as modified by the Zoning
Administrator in accordance with this Exhibit .
(1) 1.2 Unless otherwise specified, the conditions contained in
this Exhibit shall be complied with prior to the issuance
of a business license for the business, subject to review
and approval by the Community Development Department .
(1) 1.3 Conditional Use Permit approval shall become null and
void unless all required permits are issued, a business
license is obtained and operations begin within twelve
(12) months of the date of this Exhibit .
(1) 1.4 The applicant shall hold harmless and defend the City of
Tustin from all claims and liabilities arising out of the
City' s approval of the entitlement process for this °
-project .
(1) 1.5 Approval "of Conditional Use Permit 96-024 is contingent
upon the applicant and property owner signing and
returning an "Agreement to Conditions Imposed" form as
established by the Director of Community Development.
OPERATIONS/SITE CONDITIONS
(4) 2 .1 Business hours for the proposed car rental- office shall
not extend beyond the following:
Monday through Friday 7 :30 a.m. to 6 : 00 p.m.
Saturday 8 : 00 a.m. to 2 : 00 p.m.
Sunday 9 : 00 a.m. to 1: 00 p.m.
Any extension of these hours shall require approval of an
amendment to this Conditional Use Permit by the Zoning
Administrator.

(4) 2 .2 The applicant shall be limited to parking -no more than
one (1) rental car in a striped parking space located' in
the parking area north of the tenant space for a maximum
time- of three (3) hours to accommodate the transfer of
vehicles .
(4) 2 .3 No on-site storage of vehicles shall be permitted'.
Storage of vehicles on--site shall be defined as
maintaining vehicles on-site for a period over three (3)
hours .
SIGNS
(5) 3 .1 All signs, including any change of copy shall be
consistent with the City' s Sign Code and require review
and approval by the ' Community Development Department
prior. to installation.
FEES
{1} 4 .1 Within 48 hours of approval of the subject project, the
applicant shall deliver to the Community Development `
Department, a cashiers check payable to the COUNTY CLERK,
_in the.. amount_ of--thirty-eight dollars ($38 . 00) to enable
r the City to file with the County Clerk, the appropriate
environmental documentation pursuant to the California
Environmental Quality Act . If within such 48 hours
period, -the applicant has not .delivered to the Community
Development Department the above noted check, the
approval for - the project granted herein shall be
considered automatically null and void.
