ENVIRONMENTAL THIS PROJECT HAS BEEN DETERMINED TO BE STATUS : CATEGORICALLY EXEMPT (CLASS 1) PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT REQUEST: TO AUTHORIZE THE EXPANSION OF AN EXISTING 100 PERCENT OFFICE USE IN THE CG DISTRICT FOR THE PURPOSE OF ESTABLISHING A DENTAL OFFICE. Recommendation - That the Zoning Administrator approve Conditional Use Permit 96'041 and Design Review 96-055 by adopting Zoning Administrator Action 97-0.03 . Presentation: Gregory Gubman, Associate Planner The Zoning Administrator asked the height of the existing wall. Greg Gubman stated it was 418." to 61811 at it' s highest point. Staff suggested revisions to the Conditions of Approval due to the fact that this project has been determined not subject to Tustin City Code Section 9271i (2) (a) , which requires a solid masonry wall . Nasser Sadeghi, Saba Construction, stated he had no questions about the report or Resolution. Mr. Saba stated that the owner, Mr. Kamal Amir, . was anxious to get started and asked when a permit for demolition could be requested. Staff reminded Mr. Sadeghi that there was a seven day appeal period following this hearing and it would be best to wait the seven days . The Administrator approved Conditional Use Permit 96-041 and Design Review 96-055 by adopting Zoning Administrator Action 97-003 . The approval included revisions as follows: Finding F shall read, "That this project has been determined to be not subject to Tustin City Code Section 9271i (2) (a) , which requires a solid masonry wall, six feet eight inches (6' 811) in height along the zone boundary line where a 11C11 , "M" or "Pr" abuts upon -any, residential zone, based upon the following findings: 1. The subject property is presently developed as a non-residential use. . 2 . The proposed modifications are relatively minor, as discussed in Finding I.D.2 . Zoning Administrator Action Agenda February 3 , 1997 Page 3 3 . The subject property is already buffered from the adjacent residential use by a solid wall ranging in height between four feet eight inches (418") and six feet eight inches (618"") , and by an existing carport wall exceeding six feet eight inches (61811) , at the property lines . " Condition 2 . 6 is to be eliminated and the conditions renumbered accordingly. REGULAR BUSINESS No Items for regular business .
