1481 EDINGER AVENUE.
RECOMMENDATION
That the Zoning Administrator approve Design Review 96-024 by
adopting Zoning Administrator Action 96-006, as submitted or
revised.

BACKGROUND/PROJECT DESCRIPTION
The applicant is requesting authorization to add a patio cover to
the outside seating area at the existing Cookie' s Cafe restaurant
located at 1481 Edinger Avenue. The restaurant is part of the
Pacific Commerce Center located at the northwest corner of the
intersection of Red Hill Avenue and Edinger Avenue and is within
the South Central Redevelopment Project Area. The site is bounded
by commercial development to the east, west, and south, and by a
flood control channel, rail line and fire station to the north.
The subject property is zoned PC (Planned Community) - Pacific
Center East Specific Plan., Since the project- is located in the
South Central Redevelopment area, final Design Review approval
rests with the Redevelopment Agency. However, City Code Section
9299 (b) (3) (c) grants authority to the Zoning Administrator to
approve Design Review applications within the City' s Redevelopment
Areas in lieu of the Redevelopment Agency.
The proposed patio cover will be located over a previously approved
outdoor seating area located on the southeast side of the Cookie ' s
Cafe restaurant facing Red Hill Avenue. On February 14, 1994, the
Planning Commission approved Conditional Use Permit 93-040 to allow
outdoor seating for the existing restaurant . The applicant is
proposing to maintain the same number of seats as previously
approved. Other aspects of the outdoor seating area previously
approved will not be affected.
The patio cover will have a total area of 400 square feet and will
be partially enclosed by a 42" - high antique red cultured brick
wall. The cover will be supported by white roman Boric columns and
will include fascia molding to match existing restaurant design.
The design of the patio cover, color and materials is compatible
with the existing restaurant . The patio cover will not be located
in close proximity to sensitive uses, nor will it affect the
pedestrian or vehicular circulation on the site.

The Zoning Administrator of the City of Tustin does
4 hereby resolve as follows : '
5 I . The Zoning Administrator finds and determines as
follows :

A. That a proper application, Design Review 96-
7 024, was filed by Steve Tsirtsis to authorize
the addition of a patio cover to the outside
8 seating area at the existing restaurant
located at 1481 Edinger Avenue .

B. That the project is located within the South
10 Central Redevelopment area. Pursuant to City
Code Section 9299 (b) (3) (c) , the Zoning
11 Administrator has the authority to approve
Design Review applications within the City' s
12 Redevelopment Areas .
13 C. Pursuant to Section 9272 of the Tustin
Municipal Code, the 'Zoning Administrator finds r
14 that the architectural features, materials and
colors will not impair the orderly and
15 harmonious development of the area, the
present or future development therein, or the .
16 occupancy as a whole. In making such
findings, the Zoning Administrator has
17 considered at least the following items:
18 1 . Setbacks and site planning.
2 . Exterior materials and colors .
19 3 . Landscaping, parking area design and
traffic circulation.
20 4 . Location, height and standards of
exterior illumination.
21 . 5 . Physical relationship of proposed
structures to existing structures in the
22 neighborhood.
6 . Appearance and design relationship of
23 proposed structures to existing
structures and possible future structures
24 in the neighborhood and public
thoroughfares .
25 7 . Development Guidelines and criteria as
adopted by the City Council.

2 3 D. That the proposed project- is categorically
exempt (Class 1) pursuant to the California
3 Environmental Quality Act Section 15301 .
4 11 . The Zoning Administrator hereby approves Design
Review 96-024 to authorize the addition of a
5 partially enclosed patio cover to the existing
restaurant located at 1481 Edinger, subject to the
6 conditions contained in Exhibit A, attached hereto.

PASSED AND ADOPTED at a regular meeting of the Tustin
8 Zoning Administrator, held on the 17th day of June, 1996 .

EXHIBIT A
CONDITIONS OF APPROVAL
DESIGN REVIEW 96-024
JUNE 17, 1996
GENERAL
(1) 1.1 The proposed project.shall substantially conform with the
submitted plans dated stamped June 17, 1996 on file with
the Community Development Department- as herein modified
or as modified by the Director of Community Development
in accordance with this Exhibit .
(1) 1.2 Unless otherwise specified, the conditions contained in
the Exhibit shall be complied with prior to the issuance
of any building permits for the project, subject to
review and approval of the Community Development
Department .
(1) 1.3 Design Review approval shall become null and void unless
all building permits are issued within eighteen (18)
months of the date of this Exhibit .
(1) .1 .4 The applicant shall sign and return an Agreement to
Conditions Imposed form prior to issuance of building
permits .
(1) 1 .5 The applicant and property owner shall hold harmless and
defend the City of Tustin from all claims and liabilities
arising out of the City' s approval of the entitlement
process for this project.
PLAN SUBMITTAL
(1) 2 .1 At plan check submit three (3) sets of construction plans
and two (2) sets of structural calculations. Requirements
of the Uniform Building Code shall be complied with as
approved by the Building Official. No field changes
shall be made without corrections submitted to and
approved by the Community Development Department.
FEES
(1) 3 .1 Payment of all Building plan check and permit fees shall
be made prior to the issuance of any building permits in
accordance with the Tustin City Code .
