REQUEST: INSTALLATION OF SOIL REMEDIATION EQUIPMENT
RECOMMENDATION
That the Zoning Administrator approve Design Review 96-023 by
adopting Zoning Administrator Action 96-007.
BACKGROUND
The applicant is requesting authorization to install soil vapor
extraction equipment at the existing ARCO gasoline service station
located at 14231 Red Hill Avenue. The vapor extraction system is
needed to remove hydrocarbons found in the soil, and is required by
the Orange County Health Care Agency.
The ,subject site is located on the northwest corner of Red Hill
Avenue and Mitchell Avenue . Adjacent land uses include a shopping
center to the north and west, and residential uses to the south,
and east of the project site .

PROJECT DESCRIPTION
The proposed soil remediation system is a self-contained unit
designed to treat contaminated sites by extracting hydrocarbon
vapors from the soil. During the initial phase of the remediation,
the vapor extraction system will employ a therma/catalytic
oxidation process which burns the hydrocarbons then releases the
filtered exhaust into the soil. The air sparging system which
returns the exhaust is intended to enhance vapor recovery and
natural bioremediation. Phase I remediation will be carried out
for as long as the Total Petroleum Hydrocarbon (TPH) concentration
in the inf luent, air stream is substantial.
In the closing phase of the process, the vapor extraction system
will use carbon-filled canisters to filter and remove vapors
extracted from the soil. The vapors will be routed through the
carbon vessels before . discharging to the atmosphere. This
remediation phase will be continued until the site soil is
remediated to achieve compliance with State regulations. The
system will operate 24 hour a day and is anticipated to be needed
on the site for approximately two (2) years.
The remediation equipment will be located on the north side of the
existing mini mart building. The applicant proposes to construct
an eight (8) foot high mesh galvanized steel fence with plastic
slats to enclose the remediation equipment. A Condition of
approval has been added requiring that the enclosure be secured
with a locked solid metal ; gate. A vent stack will project
approximately four (4) feet above the top of the eight (8) foot
high steel fence.
The location of the proposed equipment will not obstruct any
required parking spaces or impede on-site circulation. To provide
compatibility with the site and surrounding area, Conditions of
Approval have been included to require the applicant to paint the
fence and gates to match the adjacent mini mart building, and the
exposed portion of the vent stack to be painted by the manufacturer
a neutral light grey.
NOISE AND SAFETY J
Issues associated with the proposed application include noise and
public safety. These are discussed as follows:
Noise -. Section 4614 (a) of the Noise Ordinance indicates that uses
on commercially zoned properties shall not exceed 60 dBa at any
time: The nearest residential property is approximately 100 feet
southwest of the project site across from Mitchell Avenue.

To ensure that the operation of the remediation equipment conforms
to the requirements of the City Noise Ordinance, proposed Condition
of Approval No. 3 .7 would require the applicant to muffle the
equipment, as necessary, to meet the 60 dBa noise standard. In
addition, the applicant will be required to perform a 24-hour noise
test in . accordance with the City's Noise Ordinance to verify that
the muffled equipment does not exceed 60 dBa at any time. - The
applicant would be required to increase muffler devices should
noise levels exceed the Noise Ordinance requirements.
Proposed Condition No. 3 .4 has also been included to require the
installation of a small sign indicating a contact phone number in
the event of a problem with noise or the equipment.
Public Safety - The Orange County Health Care Agency -permits and
monitors all soil remediation procedures in the county. As lead
agency, the Orange County Health Care Agency would certify when the
soil remediation procedure has been successfully completed.
The applicant states that the equipment manufacturer is in the
process of obtaining necessary permits/licenses from the South
Coast Air Quality Management District (SCAQMD) certifying the soil
remediation equipment at the project site.
Some of the vapors which will be present at the soil remediation
site are considered volatile. Any risk of fire or explosion caused
by the soil remediation equipment would be enhanced by the
proximity to the existing gasoline service station operation. The
applicant will be required to provide written notification to the
Fire Authority regarding the start-up date of the remediation
equipment, and the estimated completion date.

3 The Zoning Administrator of the City of Tustin does hereby
resolve as follows:

I. The Zoning Administrator finds and determines as follows:

A. That a proper application, Design Review 96-023,
6 was filed by C.E.T. to authorize the temporary
installation of soil remediation equipment on the
7 property located at ,14231 Red Hill Avenue.
8 B. That establishment, maintenance, and operation of
the use applied for will not, under the
9 circumstances of this case, be detrimental to the
health, safety, morals, comfort, or general. welfare
10 of the persons residing or working in the
neighborhood of such proposed use, nor to the
11 'general welfare of the City of Tustin as evidenced
by the following findings:

1. The removal and treatment of contaminated
13 vapors in the soil from the property located
at 14231 Red Hill Avenue is a necessary
,4 process required by public health care
agencies. Removing contaminates from the soil
z5 will benefit the environment, thus enhancing
the health, safety, morals, comfort, or
16 general welfare of the persons residing or
working in the neighborhood of the temporary
17 soil remediation equipment.
18 2 . The installation of the extraction and
treatment equipment to be located on the
19 subject site is temporary and will be removed
upon completion of the process. The temporary
20 equipment will be located approximately 100
feet from the nearest residentially zoned
21 property. Potential adverse impacts related
to aesthetic, noise or general safety of the
22 temporary location of the equipment will be
mitigated by Conditions of Approval referred
23 to herein as Exhibit A. The installation and
operation of the soil remediation equipment is.
24 subject to monitoring by the Orange County
Health Care Agency, the South Coast Air
25 Quality Management District, and the Orange
County Fire Authority.

C. That the proposed project is categorically exempt
(Class 1) pursuant to the California Environmental
Quality Act 15301.

CONDITIONS OF APPROVAL

JULY 11 1996
GENERAL
(1) 1.1 The proposed project shall substantially conform with the
submitted plans, date stamped July 1, 1996, on file with
the Community Development Department, as herein modified
or as modified by the Zoning Administrator in accordance
with this Exhibit.
(1) 1.2 Unless otherwise specified, the conditions contained in
the Exhibit shall be complied with prior to the issuance
of any building permits for the project, subject to
review and approval by the Community Development
Department.
(1) 1.3 Design Review approval shall become null and void unless
all building permits are issued within eighteen (18)
months from the date of this Exhibit.
-•� (1) 1.4 The applicant shall sign and return an Agreement to
Conditions Imposed form prior to issuance of building
permits.
(1) 1.5 The applicant and property owner shall hold harmless and
defend the City of Tustin from all claims and liabilities
arising out of the City's approval of the entitlement
process for this project.
(1) 1.6 All equipment related to the vapor extraction process
shall be removed within thirty days of completion of the
extraction and treatment process. This permit shall be
valid for a period of time not to exceed 24 months from
the date that building permits are issued. An extension
may be granted by the Zoning Administrator should the
extraction process require additional time. Said
extension request shall be made to the Community
Development Department at least 30 days prior to the
expiration of the terms of this Design Review.

2. 1 At building plan check submittal:
(5) A.' Provide manufacturers listings and requirements for
structural support of the remedial equipment.
(5) B. Provide site plan(s) showing the location and
elevation of contamination and the required piping.
(5) C. Provide a list describing the .work and method of
performing the work.
(5) D. Provide clearances from the Orange County Health
Care Agency, the South Coast Air Quality Management
District and the California Water Quality Control
Board, as necessary.
(3) E. Provide preliminary technical details and plans for
all utility installations including water and
electricity. Additionally, a note on plans shall
be included stating that no field changes shall be
made without corrections submitted to and approved
.by the Building Official. Requirements of the
Uniform Building Plumbing, Mechanical and
Electrical Codes shall be complied with, as
approved by the Building Official.
(5) F. Provide information to ensure compliance with
Articles 79 and 82 of the Uniform Fire Code and all
requirements of the Orange County Fire Authority
pertaining to treatment and handling of flammable,
volatile and/or hazardous substances, including but
not limited to the following:
1. soil. remediation tanks, if any, shall be
self-contained in design to accommodate 1000
of contents in event of a leak/spill.
2 . All dispensing systems shall be secure and
meet Fire Marshal. standards.
3 . All pumps shall be U.L. approved.

4. The applicant shall provide the following
written notifications:
a. Anticipated start-up and completion
dates, prior to commencement of
operations; and
b. Actual completion of operations.
5. The applicant shall obtain applicable permits
for hazardous operations.
6. The applicant shall file all applicable
hazardous material disclosure statements with
the Fire and Health Care Agency.
(5) G. Fire Authority final inspection is required.

advance at (714) '832-1011.
(5) H. A licensed Mechanical Engineer shall stamp and wet
sign all sheets of plans. A valid license
expiration date shall be appropriately indicated.
SITE AND BUILDING CONDITIONS
(4) 3.1 The remediation enclosure shall include a solid metal
gate. The entire enclosure shall be painted to match
that of the existing adjacent mini mart building.
(2) 3.2 Note on plans that the gate on the enclosure shall be
locked.
(4) 3.3 Any equipment, piping or vent extending above the height
of the remediation compound or enclosure shall be painted
a neutral grey, subject to final approval by the
Community Development Department.
(1) 3.4 A minimum 24-inch by 24-inch sign noting a telephone
number with hours of operation for complaints on the
vapor recovery extraction system shall be provided on the
exterior wall of the remediation enclosure.
(2) 3.5 All areas, -especially paved circulation areas, disturbed
by trenching for the purpose of installing piping and
vapor extraction wells, shall be repaired and replaced to
match the existing surrounding areas.

(5) 3 . 6 Any utility connections within the public right-of-way
will require a permit- from the Public Works Department
/Engineering Division.
(2) 3 .7 The applicant shall install muffling devices to meet City
Noise Ordinance requirements prior to operation of the
soil remediation equipment . Immediately upon installation
the applicant shall perform a 24-hour noise test to
verify that the muffled equipment complies with the
City' s Noise Ordinance requirements for commercially
zoned property of a maximum of 60 dBa at any time
(Section 8414 (a) .
FEES
(1) 4 .1 All building permit and plan check issuance fees shall be
paid to the Community Development Department prior to
building permit issuance. Payment will be required based
upon those rates in effect at the time of payment and are
subject to change.
(1) 4 .2 Within 48 hours of approval of the subject project, the
applicant shall deliver to the Community Development
Department, a cashiers check payable to the COUNTY CLERK,
in the amount of thirty eight ($38 . 00) to enable the City
to file with the County Clerk, the appropriate
environmental documentation pursuant to 'the California
Environmental Quality Act . If within such 48 hours
period, the applicant has not delivered to the Community
Development Department the above noted check, the
approval for the project granted herein shall be
considered automatically null and void.
