Desicrn Review 96-023 APPLICANT: C.E.T ATT: CHRISTIAN FAULK 13701 SOUTH ALMA AVENUE GARDENA, CA. 90249 LANDOWNER: ATLANTIC RICHFIELD COMPANY ATT: HUBER WILSON P.O.BOX 2435 LOS ANGELES, CA. 90051 LOCATION: 14231 RED HILL AVENUE ZONING: RETAIL COMMERCIAL (100 C--1 10, 000) ENVIRONMENTAL THIS PROJECT HAS BEEN DETERMINED TO BE STATUS: CATEGORICALLY EXEMPT (SECTION 15301, CLASS 1) PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT REQUEST: INSTALLATION OF SOIL REMEDIATION EQUIPMENT Recommendation - That the Zoning Administrator approve Design ' Review 96--023 by approving Zoning Administrator Action 96-007 subject to the conditions attached as Exhibit A, as submitted or revised. Presentation: Rosa Ceja, Assistant Planner The Administrator asked if the applicant had any comments. Christian Faulk, representing the applicant, corrected the wording on page two of the staff report, stating that the filtered exhaust from the therma catalytic oxidation does not go into the soil but is .released into the atmosphere and that it is not an air sparging system but only therma catalytic oxidation. He also commented that the proposed fence would be chain link but questioned the requirement of a solid metal gate. Concerning the muffled equipment as discussed on page 3 of the staff report, he stated that if any complaints ensued, acoustical paneling would be used but is not proposed at this time. Concerning Exhibit A, Condition 1. 6, he asked if the language could be changed to reflect that the permit shall" be valid from the date finaled instead of from the date of issue. :r Zoning Administrator Action Agenda July 1, 1996 Page 3 The Administrator stated that this was standard condition language and that time frames were routinely extended when required and that he was reluctant to change the language of this condition. Christian Faulk stated that he wished to see the condition read from date finaled because ARCO is a large company, and when his consulting services are completed they will have to continue the process and he wanted ARCO to have sufficient time to complete it. Dan Fox, Senior Planner, stated it would be better to change Condition 1. 6 to read 1130 months" instead of 1124 months" since the condition is tied to the approval process and would meet the applicant ' s needs. The Administrator agreed to this language change. Christian Faulk referring to Condition 2 . 1 (D) , asked if it would be necessary to obtain clearances from both the Orange County Health Care Agency (OCHCA) -and the California Water Quality Board since the OCHCA takes care of the water issue. The Administrator stated that the condition also contained the words, as necessary, and that clearances from both agencies would not be necessary if a letter was obtained stating that OCHCA had the proper authority to take care of the water issue. Christian Faulk asked if Condition 3 .3 could read "painted to match the color of the building" instead of a neutral grey. He stated that ARCO typically purchased vapor units that were blue. He further stated that if the San Juan site was conditioned to read, "neutral grey" and it was painted blue he would see that ARCO complies with the original condition for that site. The Director asked if any calls had been received from the general public concerning this project . Rosa Cela, Assistant Planner, stated there had been no - calls. The Director approved Design Review 96-023 by adopting Zoning Administrator Action 96-007 revised as follows. Condition 1.6 to read, "All equipment related to the vapor extraction process shall be removed within thirty days of completion of the extraction and treatment process. This permit shall be valid for a period off time not to exceed 30 months from the date that building permits are issued. An extension may be granted by the Zoning Administrator should the extraction process require additional i Zoning Administrator Action Agenda July 1, 1996 Page 4 time. Said extension request shall be made to the Community Development Department at least 30 days prior to the expiration of the terms of this Design Review. " Condition 3 .1 shall read, "The remediation enclosure shall include a chain link gate with slats. The entire enclosure shall be painted to match that of the existing adjacent mini mart building. " ADJOURNMENT: The Administrator adjourned the meeting at 10:47 a.m. The date of the next regular meeting of the Zoning Administrator will be set as items are scheduled for action. t r
