BACKGROUND AND DISCUSSION
On July 14, 1997, the Planning Commission adopted Resolution No.
3529 recommending that the City Council approve Nesting Tentative
Tract Neap 15380 for a 162 unit project bounded by Jamboree Road,
Tustin Ranch Road and Portola Parkway. The City Council .approved
Vesting Tentative Tract Map 15380 on J'UlY 21, 1997 by adopting
Resolution No. 97-58 .
Tustin City Code Section 9299 (4) d provides for the Zoning
Administrator to consider amendments to conditions of approval
imposed by the Planning Commission or City Council which are
determined to be minor in nature and do not alter the original
intent of the project .
The project is a request to amend Conditions 3 .2 and 8 .1 (P) of-
Planning

Planni ng Commission Resolution No. 3529, approving Vesting

Tentative Tract Map No. 15380 Attachment A) . The amendments will -
revise the responsibi=lity of ownership and, maintenance of the
perimeter- landscaping Lots C through J and M through P, from the
Homeowner' s association to the City' s Lighting and Landscape
P
District and require the installation of a computerized irrigation
system fully compatible with existing systems currently utilized in
other~ areas of Last Tustin, subject to approval of the -Director of
Public Works.
The City of Tustin' Landscape and Lighting District formed in 1985
maintains all Landscaping adjacent to arterial streets for
residential areas in Last Tustin. Jamboree load, Tustin Ranch load
and Portola Parkway are designated and have been constructed as
arterial highways, .consistent with the Last Tustin Specific Plan
and _Circulation Element of the Tustin General Plan. The amendments
are necessary to take the Richmond nd American project consistent with
all the other approved projects with respect to maintenance
responsibilities in East -Tustin.

All residential lots and dwellings s shall be sound
attenuated against present and projected noises,
which shall 'be the sura of all noise impacting the
project, so as. not to exceed an exterior standard
65 dB CNEL in outdoor living areas and an interior
standard of 45 dB C EL in all Nabi able rooms is
required. Evidence prepared under the supervision
of an acoustical . consultant that these standards
will be satisfied in a manner consistent with
applicable zoning regulations shall be provided.
B. ' Due to the project ' s close proximity to the
Browning Corridor, said study shall. - provide
information on single event noise measurements as
generated by helicopter flyovers for information
purposes only.

The zoning Administrator of the City of Tustin does hereby resolve
as follows: -

I. The Zoning Administrator finds and determines as follows: F
A. That on July 14, 1997, the Planning Commission adopted
7 Resolution No, 3 529 recommending that -the City Council
approve Vesting Tentative Tract Map 15380, The City
Council approved vesting Tentative Tract leap 15380 on
July 21, 1997 by adopting Resolution No. 97-58,
B. That Conditions 3 . 2 and 8,1(P) of Resolution No, 8529
10 state that landscape maintenance of all perimeter lots
shall be the responsibility of the Homeowner' F

12 C. That the amendment will revise the responsibility * f
ownership and maintenance of the perimeter landscaping

by this action, shall remain in full force and effect.
