November 17, 1997 Page 2 ENVIRONMENTAL STATUS: THIS PROJECT IS CATEGORICALLY EXEMPT (CLASS 1) PURSUANT TO PROVISIONS OF SECTION 15301 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. REQUEST: AUTHORIZATION FOR THE ON-SITE SALE OF BEER AND WINE (ABC LICENSE TYPE 114111) FOR ON-SITE CONSUMPTION IN CONJUNCTION WITH AN EXISTING RESTAURANT. Recommendation - That the Zoning Administrator adopt Zoning Administrator Action 97-010 approving Conditional Use Permit 97- 020 . Presentation: Minco Ashabi, Assistant Planner The Public Hearing was continued at 10 :32 a.m. Josephine Pina Gruner, applicant, stated that she was surprised at the comments made at the previous meeting. The ABC license is important to'the growth of her business and she will see that it is administered in an appropriate and responsible manner. The Public Hearing. closed at 10 :34 a.m. The Administrator stated that correspondence had been received in opposition to the project from David Patterson, 640 West First Street, ##B, Tustin. This letter was added to the official record. The Administrator adopted Zoning Administrator Action No. 97-010 approving Conditional Use Permit 97-020. The Administrator explained the appeal process . 2 . Conditional Use Permit 97-018 APPLICANT: SUZAY K. CHA MONDU SUZAY OWNER: FIDELITY NATIONAL TITLE COMPANY LOCATION: 13931 CARROLL WAY, SUITE A ZONING: RETAIL COMMERCIAL - PARKING OVERLAY (C-1 P) ENVIRONMENTAL STATUS : THIS PROJECT IS CATEGORICALLY EXEMPT (CLASS 1) PURSUANT TO, PROVISIONS OF SECTION 15301 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. Presentation: Bradley J1 Evanson, Assistant Planner The Public Hearing opened at 10 :40 a.m. Suzan K. Cha, the applicant, stated that she .has redecorated the restaurant with soothing colors and was pleased with the results. She believes that the decor, along with the proposed jazz and classical music, is in good taste and will be a pleasant atmosphere for the residents of Tustin to enjoy. The Administrator asked if there was any opposition to the project . Bradley-Evanson, stated there was no written or oral opposition. The Public Hearing closed at 10 :41 a.m. The Administrator adopted Zoning Administrator Action No. 97-011 approving, 'Con.ditional Use Permit 97-018 . 3 . Amendment to the Conditions of Approval for Tentative Tract Map 15380 APPLICANT: RICHMOND AMERICAN HOMES, INC. APPLICANT/ OWNER: THE IRVINE COMPANY LOCATION: LOT 27 OF TRACT 13627; WEST SIDE OF' JAMBOREE ROAD BETWEEN TUSTIN RANCH ROAD AND PORTOLA PARKWAY ZONING: MEDIUM-LOW DENSITY RESIDENTIAL ENVIRONMENTAL STATUS: FINAL ENVIRONMENTAL IMPACT REPORT 85--2, IN CONJUNCTION WITH THE EAST TUSTIN SPECIFIC PLAN, AS AMENDED AND ADDENDA, PURSUANT TO THE REQUIREMENTS OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT ADDRESSES ENVIRONMENTAL CONSIDERATION ASSOCIATED WITH THIS PROJECT Zoning Administrator Action• Agenda November 17, 1997 Page 4 REQUEST: AMENDMENT TO THE CONDITIONS OF APPROVAL TO CHANGE MAINTENANCE RESPONSIBILITY OF THE PERIMETER LANDSCAPE LOTS FROM THE HOMEOWNER' S ASSOCIATION TO THE TUSTIN LANDSCAPING AND LIGHTING DISTRICT. Recommendation - That the Zoning Administrator adopt Zoning Administrator Action 97-012 approving Amendment to the Conditions of Approval for Tentative Tract Map 15380 . Presentation: Minoc Ashabi, Assistant Planner The Public Hearing opened at 10 :45 a.m. Douglas Anderson, Traffic Engineer, representing .the Public Works Department, requested that Zoning Action finding I-C be amended to remove reference to City ownership. He expressed concern and requested that Richmond America be contacted to disclose this change so that they are clear that ownership remains with the Homeowner' s Association. The Public Hearing closed at 10 :47 a.m. The Administrator adopted Zoning Administrator Action No. 97-012 approving Amendment to the Conditions of Approval for Tentative Tract Map 15380 with Section I, Item C revised to read, "That the amendment will revise the responsibility of maintenance of the perimeter landscaping of Lots C through J and M through P from the Homeowner' s Association to the City' s Landscape and Lighting District, consistent with the requirements for the District to maintain landscape adjacent to arterial highways.
