NE KIRKLAND, WA 98033 LOCATION: 2655 EL CAMINO REAL ZONING: PLANNED COMMUNITY MIXED USE - EAST ' TUSTIN SPECIFIC PLAN ENVIRONMENTAL STATUS: THIS PROJECT ' HAS BEEN DETERMINED TO BE CATEGORICALLY EXEMPT CLASS 1 PURSUANTTO SECTION 1530.1 OF THE CALIFORNIA ENVIORNMENTAL QUALITY ACT. REQUEST: MODIFICATION .TO CONDITIONS OF APPROVAL TO ALLOW A ONE YEAR TTME' EXTENSION TO' THE EXPIRATION DATE OF DESIGN REVIEW 95=027. uRECOMMENDATION That the boning Adminstrator adopt Zoning Administrator Action 97- 00.5 granting a one year (12 month) time extension through March 25, 1998 . BACKGROUND AND DISCUSSION On September 25, 1995,- the Planning Commission adopted Resolution No.. 3395 approving DR, 95-027 . The approved proj•ect .consists of a 2, 880 sq.ft . addition for the purpose of remodeling the tire center on the south elevation of the existing Costco building ..(Attachment A) . i Zoning Adminstrator Report Time Extension for DR. 95-.027 April 7, 1997 Page 2 Condition No. 1 .3 of Planning Commission Resolution No. 3395 specifies that DR 95-027 would become null and void unless building permits were issued and substantial construction was completed within 18 months of the project ' s approval date. The expiration date for DR 95-027 was March 25, 1997. On March 1.0, 1997, the Community Development Department received a letter from Angie Yusuf of Mulvanny Partnership on behalf of Price/ Costco Inc. , requesting a one year time extension to the Design Review approval (Attachment B) . Ms. Yusuf states that they were unable to submit for a building permit prior to the expiration date because an agreement with , the developer has not been reached regarding details and landscaping. She concludes that Mulvanny Partnership needs additional time to finalize the plans. City Code Section 9299b4b provides the Zoning Administator authority to consider time extension requests up to 12 months. There has been no change to the East Tustin Specific Plan development standards since the original approval which would necessitate any project revisions. MP# 94-13 8 CITY #: DR 95-027 Dear Mr. Fox: The purpose of my letter is to request a time extension for the planning approval which was initially received onSeptember 25, 1995. The approval will expire on March 25 1.997. 1 would like to extend the planning approval for one year, to. expire on March 25, 1998. The reason for this request is that we are unable to submit for builing permit, or even finalize our plans until we have reached an agreement with the developer regarding the building details,and landscaping. Tustin does 4 hereby resolve as- follows : 5 I . The Zoning Administrator finds and determines as follows : 6 A. That on September 25, 1995, the Planning 7 Commission adopted Resolution No. , 3395 approving Design Review 95-027 for a 2 , 880 8 square foot addition to an existing retail -building located at 2655 El Camino Real . 9 B. That a proper application was filed by 10 Mulvanny Partnership on behalf of Price/Costco requesting a 12 month time extension to the 11 approval of Design Review 95-027 . 12 C. That the Zoning Administrator may consider requests for time extensions for up to 12 13 months on Design Review applications pursuant to City Code Section 9299b4b. 14 D. That the time extension is need to allow the 15 applicant to continue to work with the property owner to finalize details and working 16 drawings for the project . 17 11. The Zoning Administrator hereby approves a 12 month time extension to March 25, 1998 for Design Review - 18 95-027 for a 2, 880 square foot addition to an existing retail building located at 2655 El Camino 19 Real.
