CONSENT CALENDAR: (ALL MATTERS LISTED UNDER CONSENT,'CALENDAR ARE CONSIDERED ROUTINE AND WILL BE ENACTED BY ONE MOTION. September 22, 1997 ' Page 2 PUBLIC HEARINGS: 1. Conditional Use Permit 97-0Z4 and Design Review 97-023 APPLICANT/ CINDY DALRYMPLE OWNER: 340 WEST 2ND STREET TUSTIN, CA 92780 LOCATION: 340 WEST 2ND STREET ZONING: SINGLE FAMILY RESIDENTIAL (R-1) ,. CULTURAL RESOURCES ' OVERLAY ENVIRONMENTAL THIS PROJECT HAS BEEN DETERMINED TO BE STATUS: CATEGORICALLY EXEMPT (CLASS 1) PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT REQUEST:. TO AUTHORIZE THE CONVERSION OF AN EXISTING TWO- STORY DETACHED GARAGE INTO A GUEST ROOM PER TUSTIN CITY CODE SECTION 9223 (B) (3) * AND TO CONSTRUCT A TWO-STORY GARAGE ADDITION TO AN EXISTING RESIDENCE. Recommendation - That the Zoning Administrator adopt Zoning Administrator Action 97-007 approving Conditional Use Permit 97-014 and Design Review 97-023 . Presentation: Bradley Evanson, Assistant Planner The Public Hearing opened at 10 :35 a.m. Bradley Evanson presented the staff report and related that a letter objecting to the project, written by. Mary Rivas, with a Petition signed by 18 neighborhood residents had been delivered to the Community Development Department on September 18, 1997. The Administrator introduced herself and explained the Zoning Administrator public hearing process. She asked if the existing second story garage improvements had been constructed without permits. Bradley Evanson stated his understanding was that most of the interior walls on the second level and all of the kitchen improvements were constructed without building permits by the previous owner. The existing garage structure is a non-conforming use . The maximum height for an accessory structure in that zone is 20 feet and the garage is 22 feet. S Zoning Administrator Action Agenda September 22, 1997 Page 3 The Administrator asked if there were any concerns withrespect to the expansion and intensification of the non-conforming structure. Bradley-Evanson Evanson stated there was an exterior modification to this building which would enclose the existing exterior stairway. Lot coverage with the proposed garage is under forty percent . , The Administrator asked Ms. Dalrymple if the prior owner had actually constructed all the improvements. Cindy Dalrymple, the applicant, affirmed and that at the time of purchase of the property, she was assured that the improvements had permits. The Administrator asked Ms. Dalrymple to clarify her intended use for this project. Cindy Dalrymple stated she owns her own business and needs a home office; she has a large family and wants to use her residence as the gathering place. She has owned rental property and sold it because she does not want to be a landlord. The Administrator asked what business she owned for which she would need the home office. Cindy Dalrymple stated she owns an electronics company and this location would not be used for the primary business, just overflow work with a phone, computer and files. The Administrator asked who the former owner was. Cindy Dalrymple reported that she bought the property from Al Almond, who had built the residence. She has no problem with tearing out the kitchen facilities but would like to keep the wet bar. Doris Radice, 180 South "A" Street, is concerned that the two-story addition was too large for the size of the lot. John Radice, 180 South "A" Street, stated' he has no objection to the project, that it looked like a nice job but expressed concern that the addition will block the Rivas home. He believes that, Ms. Dalrymple should be allowed to retain the shower because of the pool . Zoning Administrator Action Agenda September 22, 1997 Page 4 Rosemary Rivas Peinado objects to the project since the structure will overlook the living room on the west side of her mother, Mary Rivas ' home and she believes the project is too big for the lot . The Administrator , asked how far Mrs. Rivas, house was from the property line. Rosemary Rivas Peinado 'believes it is about five feet. Margaret Rivas, daughter of Mary Rivas, is concerned that the two-' story garage is too large a structure and that her mothers living room will be obstructed and block the sun. She believes that a walkway will have to be available to the back and she does not like the aesthetics of the structure. Connie Check, 335 W'. 3rd Street, welcomed Ms. Dalrymple to -the old Town neighborhood where she and her husband have lived for 31. years. She resides directly behind the proposed project and is concerned that a guest house may be turned .into a rental in the future. She has had a bad experiences with the neighbor next door who have a tenant and the duplex across the street with too many vehicles. Travis McWilliams 328 W. 3rd Street, stated that the reason people move to the historical district is for the quiet. He objects to the possibility of more vehicles in the neighborhood and-- also believes that the guest house could be rented out without the city knowing about it. The Administrator asked Ms.Dalrymple how many people reside at her. home with how many vehicles. Cindy Dalrymple stated she alone resides at the home but eventually her parents may move in with her. Together they have three cars. The Administrator asked if the Fire Department had adequate access to the rear structure, given the length- of the property. Daniel Fox, Senior Planner, stated that typically the Fire Department does not review the plans until the construction level . The property is 100 feet deep and 150 feet is the standard length the Fire Department requires . Connie Check, stated that she is concerned about Fire Department accessibility. Zoning Administrator Action Agenda September 22, 1997 Page 5 John Radice asked if accessibility was for Fire Department personnel or equipment. The Administrator stated that the Fire Department requires pedestrian access within 150 feet so that a hose could be hand carried. She clarified that the addition of a two-story garage would be permittable with a building permit. Travis McWilliams .stated he would like to see documentation on the numbers used to figure the percentage of lot coverage. He asked if the garage doors would be closed off if the addition is permitted z' and if' all the floor space below would be used. Cindy Dalrymple stated the space would be occupied by a game room and she has proposed two. additional doors for accessibility in case of fire. The Zoning Administrator continued the public hearing to October 6, 1997 at 1.0:30 a.m. for staff to confer with' the Fire Department and for additional review. REGULAR BUSINESS No Regular Business ADJOURNMENT: The public hearing adjourned at 11.:05 a.m. to be continued on October 6, 1997. The. date of the next regular meeting of the Zoning Administrator is scheduled for September 29, 1997 at 10 :30 a.m. in the Community Development-Department Conference Room, 300 Centennial Way, Tustin.
