Conditional Use Permit 97-020 APPLICANT: JOSEPHINE PINA GRUNER PINA'S BISTRO 640-C WEST FIRST STREET TUSTIN, CA 92780 } OWNER: PLAZA ON FIRST ASSOCIATES 23010 LAKE FOREST DRIVE, SUITE E LAGUNA HILLS, CA 92653 ` ATTN: DAVID MELILLI LOCATION: 640--C WEST FIRST STREET r ZONING: FIRST STREET SPECIFIC PLAN - ., COMMERCIAL AS PRIMARY USE Zoning Administrator Action Agenda October 27, 1997 Page 2 ENVIRONMENTAL STATUS: THIS PROJECT IS CATEGORICALLY EXEMPT (CLASS 1) PURSUANT TO PROVISIONS OF SECTION 15301 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. REQUEST: AUTHORIZATION FOR THE ON-SITE SALE OF BEER AND WINE (ABC LICENSE TYPE 114111 ) FOR ON-SITE CONSUMPTION IN CONJUNCTION WITH AN EXISTING RESTAURANT. Recommendation - That the Zoning Administrator adopt Zoning Administrator Action 97-010 -approving Conditional Use Permit 97- 020 . Presentation: Minoo Ashabi, Assistant Planner The Public Hearing opened at 10 :40 a.m. Josephine Pina Gruner, applicant, stated there ' definitely was a parking problem at the center. She noted that the reason she has requested the ABC license is that her customers are bringing alcohol from the 7-11, located in the center, to her restaurant to enjoy while eating and she would like to offer beer and wine on the menu. David Patterson; 640 W. First Street, #B, stated that he is the adjacent tenant and although what he had to say might seem like a personal attack on Ms . Gruner, his concern is the survival of his own business, a ladies specialty shoe store . He believes that the, additionof another ABC license in the center would ruin his business. Parking is not adequate and the landlord does not seem to care. He stated that there are only 23 available spaces with employee vehicles taking up all but 5 spaces which are left for .customer use. If cars are towed the tenants must pay for the towing. He stated that when the Bistro is filled the rest of the center is paralyzed. His own store needs only 1 or 2 spaces and he does not park in them himself . The landlord has suggested off-site parking and car pooling for employee vehicles . The 7-11 has all of their parking spaces designated for 15 minutes only but the hair salon and the restaurant customers use the spaces for up to two hours at a time. In addition, the parking lot is an obstacle course- with delivery trucks and children running through it . He believes that, based on the available space in the restaurant which is the same size as his tenant space, the number of seats inside and out is excessive. He reported that the restaurant patrons are loud and abusive and that his customers are also harassed by the restaurant owner. Another concern is the lack of cleanliness of the center especially from restaurant strewn plastic and paper. He Zoning Administrator Action -Agenda October 27, 1997 Page 3 stated he had a signed , statement, dated August 1; 1997, from a patron of the restaurant who was served wine and to such excess that they were not able to drive. The Administrator stated that the original approval for this use was for only 14 seats and he asked the applicant if there were more than that. Josephine Pine Gruner stated that she does have more than 14 seats but that she has just removed two tables outside and plans to remove the. remaining two. She stated that when she took over the restaurant, outside seating existed and she did not know until she applied for this approval that it was not allowed. She stated that she has written statements from customers who have been harassed by Mr. Patterson and that she fears him. She stated that she has just renewed her lease and hopes something can be done about the parking problem because her business is still growing. The Administrator stated that according to the existing approvals no outdoor seating is allowed and the indoor seating should be limited to 14 seats . The Public Hearing closed at 10 :50 a.m. The zoning Administrator continued this item to the meeting of November 17, 1997, so that staff may Look into the outdoor seating and parking concerns in order to make an informed decision.
