Marcraret Rivas -inquired as to how she could receive a copy of the
City' s Second Dwelling Unit Ordinance.
The Administrator noted that she would provide a copy.

ENVIRONMENTAL THIS PROJECT HAS BEEN DETERMINED TO BE
STATUS : CATEGORICALLY EXEMPT (CLASS 1) PURSUANT TO THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT
REQUEST: TO AUTHORIZE THE CONVERSION OF AN EXISTING TWO-
STORY DETACHED -GARAGE INTO A GUEST ROOM PER TUSTIN
CITY CODE SECTION 9223 (13) (3) AND TO CONSTRUCT A
TWO-STORY GARAGE ADDITION TO AN EXISTING RESIDENCE.
Recommendation - That the Zoning Administrator adopt Zoning
Administrator Action 97-007 approving Conditional Use Permit 97--01.4
and Design Review 97-023 .

The Public Heating opened at 10 : 30 a.m.
The Administrator stated that she still had concerns with long term
or second residence use of the guest house . She instructed the
applicant that if it were ever found that the guest house was used
as a separate dwelling unit with kitchen facilities, even for
members of her own family, that criminal prosecution would ensue.
The Administrator asked if Ms. Dalrymple understood this .
Cindy Dalrymple, applicant, stated-that she did understand.
The Administrator stated that she had visited the site and that
adjacent residences are even closer to the property lines than this
project and that Ms . Dalrymple had provided a larger setback and
had met all of the minimum requirement standards. The
Administrator stated she would approve the Conditional Use Permit
with a modification to Condition 2 .1 adding the words, rent or
trade to the condition. The Administrator defined . "by trade" as
meaning "in exchange for anything else" . She also explained the
' - appeal period and process and provided the fee amount for appeal .

The Public Hearing closed at 10 :35 a.m.
The Administrator approved. Conditional Use Permit 097-014 and
Design Review 97-023 by adopting Administrator Action 97-007 with
Condition 2 .1 modified to read, "The property owner shall execute
and record a deed restriction in a form acceptable to the Community
Development Department and City Attorney to ensure that the guest
room and. room addition shall not be used for leasing, rent or
trade, nor shall kitchen and/or cooking facilities be installed.
The deed restriction shall be recorded with the office of the
County Recorder prior to the issuance of any permits and shall be
binding on all future owners or interested parties of the
property"

CALIFORNIA ENVIRONMENTAL QUALITY ACT.
REQUEST: AUTHORIZATION FOR THE ESTABLISHMENT OF A TEMPORARY
USE OF A MOBILE MINI-STORAGE UNIT LOCATED AT THE
BACK OF THE SUBJECT PROPERTY.
Recommendation - That the Zoning Administrator adopt Zoning
Administrator Action 97-009 approving the proposed Temporary Use
Permit .

The Administrator asked what Ms . Formaneck' s plans were for future
use of the temporary storage unit.

Debra Formaneck, the applicant, stated that she has been looking
for a new location for six months and not able to find one and with
holidays at hand she wants to concentrate on her business . She
plans to resume looking for a larger facility after Christmas .
The Administrator stated that her only concern was that a temporary
solution might turn into a permanent use . She asked Ms . Formaneck
if she had reviewed and understood all of the conditions of
approval . The Administrator explained the appeal period.
Debra Formaneck indicated she had read the report and understood
the conditions .
The Public Hearing closed at 10 :40 a.m.
The Administrator approved the Temporary Use Permit for a mobile
mini-storage by adopting Resolution No. 97-009 .
