Check in the amount of $5,000 presented to Tustin High School Chamber Orchestra by Susan Lindquist representing Tustin Legacy Community Partners . Certificate of Recognition presented to Tustin High School Chamber Orchestra FIRST PUBLIC INPUT Anthony Trujillo, praised Council on stand of Centerline project asked what the process was to be a resident board member. PUBLIC HEARING 1. LOCAL LAW ENFORCEMENT BLOCK GRANT PROGRAM Public hearing to comply with the Federal Department of Justice requirement on the acceptance of $19,434.00 plus a matching amount of $2,159.00 for a total appropriation of $21,593.00 in Local Law Enforcement Block Grant funds to be used for communication equipment. The Omnibus Appropriations Act for fiscal year 1999 (Public Law 105-119) authorizes the Director of the Bureau of Justice Assistance (BJA) to make funds available to local government under the Local Law Enforcement Block Grant City Council Meeting Action Agenda September 20,2004 Page 2 of 5 (LLEBG) programs for reducing crime and improving public safety. The Police Department proposes using the 2004-05 LLEBG funds to purchase communications equipment, specifically handheld radios. Legal Notice published in the Tustin News on September 9,2004 Public hearing opened at 7:08 p.m. There were no speakers on the subject and the public hearing was closed at 7:08 p.m. Motion: It was moved by Councilmember Davert, seconded by Councilmember Thomas, to authorize usage of funds as recommended by the Police Department. Motion carried 5-0. CONSENT CALENDAR It was moved by Councilmember Davert, seconded by Councilmember Thomas, to approve Consent Calendar items 3, 4 and 6 as recommended by staff. Motion carried 5- O. Item #2 corrected Minutes - approved Bone/Davert Item #5 wanted to comment on the project - approved Bone/Thomas 2. APPROVAL OF MINUTES - SPECIAL MEETING OF SEPTEMBER 1, 2004 AND SPECIAL AND REGULAR MEETINGS OF SEPTEMBER 7,2004 Motion: Approve the Special City Council Meeting Minutes of September 1, 2004 and the Special and Regular City Council Meeting Minutes of September 7, 2004. 3. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Motion: Approve Demands in the amounts of $1,986,653.48, $16,078.90, $640,926.68; Reversals in the amount of $274,492.93, and ratify payroll in the amount of $487,919.19 4. PLANNING COMMISSION ACTION AGENDA - SEPTEMBER 13, 2004 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Motion: Ratify the Planning Commission Action Agenda of September 13, 2004. 5. APPROVAL OF CONSULTING SERVICES AGREEMENT FOR RAILWAY City Council Meeting Action Agenda September 20, 2004 Page 3 of 5 ~ ,I QUIET ZONE EVALUATION AT THE RED HILL AVENUE/OCTA/SCRRA RAILWAY CROSSING Motion: Approve the Consultant Services Agreement with Aztec Engineering California, Inc. for the evaluation of a Quiet Zone at the Red Hill Avenue/OCTA/SCRRA railway crossing in the amount of $10,000.00 and authorize the Mayor and City Clerk to execute the Consulting Services Agreement on behalf of the City. 6. APPROVAL OF PLANS AND SPECIFICATIONS AND AUTHORIZATION TO ADVERTISE FOR BIDS FOR THE PHASE I TUSTIN LEGACY BACKBONE' INFRASTRUCTURE PROJECT (VALENCIA NORTH LOOP ROAD, ARMSTRONG AVENUE, LANSDOWNE ROAD, SEVERYNS ROAD, AND WEST CONNECTOR ROAD) (CIP NO. 7139) Motion: Adopt resolutions. RESOLUTION NO. 04-81 - A resolution of the City Council of the City of Tustin, California, finding that pursuant to Public Resources Code Section 2116 and Section 15168(c) of the State of California Environmental Quality Act (CEQA) guidelines, Phase I Tustin Legacy Backbone Infrastructure Project (Valencia North Loop Road, Armstrong Avenue, Lansdowne Road, Severyns Road, and west Connector Road) (CIP No. 7139) is within the scope of the final joint program MCAS Tustin Environmental Impact Statement! Environmental Impact Report (MCAS Tustin FEIS/EIR); that no new environmental document is required; and that applicable mitigation measures have been incorporated into the project RESOLUTION NO. 04-82 - A resolution of the City Council of the City of Tustin, California approving Plans and Specifications for the Phase I Tustin Legacy Backbone rnfrastructure Project (Valencia North Loop Road, Armstrong Avenue, Lansdowne Road, Severyns Road, and west Connector Road) (CIP No. 7139) and authorizing advertisement for bids SECOND PUBLIC INPUT - None. OTHER BUSINESS / COMMITTEE REPORTS Councilmember Davert: . Thanked Mr. Trujillo for commenting on Centerline issue and said that current newspaper articles indicated expected ridership was down yet again; . Orange County Vector Control announced Asian Tiger mosquito located in the area, however OCVC has it under control; . Tiller Days would be held in 2 weeks; and City Council Meeting Action Agenda September 20,2004 Page 4 of 5 . LA Times article praised a Huntington Beach project under the same developer that will be working on project in Old Town Tustin. Councilmember Thomas: . Discussed traffic troubles around Pioneer Middle School. Councilmember Hagen: . Agreed with Council member Thomas on traffic problems around Pioneer Middle School on Tustin Ranch Road, suggested signs be changed to 'No stopping'. Mayor Pro Tem Bone: . Orange County Vector Control, last Wednesday examined a dead crow in Tustin and found positive for West Nile virus, advised everyone to be careful; . Was invited by Orange County Transportation Authority to ride the Goal Line to Pasadena, bells and whistles were very loud; . Southern California Association of Governments is being sued by State of California Housing on housing issue; . Tustin Pride started a new CPR training class in conjunction with Doctor's Ambulance, call 1-800 420-2221 to sign up; and . Urged residents to support Proposition 1 A in support of our Cities, Police, Parks and roads. Mayor Kawashima: . Announced October 1, 2004, Councilmember Davert would become the City's new representative on the Orange County Sanitation District and Mayor Kawashima would become alternate member on the board. APPROVAL OF MINUTES - REGULAR MEETING OF SEPTEMBER 7, 2004 It was moved by Agency member Hagen, seconded by Agency member Thomas, to approve the Redevelopment Agency Minutes of September 7, 2004. Motion carried 5-0. ADJOURNMENT - 7:25 p.m. - The next regular meeting of the Redevelopment Agency was scheduled for Monday, October 4, 2004, at 7:00 p.m. in the Council Chamber at 300 Centennial Way, Tustin.
