FIRST PUBLIC INPUT
Anthony Trujillo, praised Council on stance related to the Centerline Project and asked
what the process was to be a resident board member of OCT A.
PUBLIC HEARING
1.
LOCAL LAW ENFORCEMENT BLOCK GRANT PROGRAM
Public hearing to comply with the Federal Department of Justice requirement
on the acceptance of $19,434.00 plus a matching amount of $2,159.00 for a
total appropriation of $21,593.00 in Local Law Enforcement Block Grant funds
to be used for communication equipment.
The Omnibus Appropriations Act for fiscal year 1999 (Public Law 105-119)
authorizes the Director of the Bureau of Justice Assistance (BJA) to make funds
available to local goyernment under the Local Law Enforcement Block Grant

(LLEBG) programs for reducing crime and improYing public safety. The Police
Department proposes using the 2004-05 LLEBG funds to purchase
communications equipment, specifically handheld radios.

Public hearing opened at 7:08 p.m.
There were no speakers on the subject and the public hearing was closed at
7:08 p.m.
Motion: It was moved by Council member Davert, seconded by Councilmember
Thomas, to authorize usage of funds as recommended by the Police Department.
Motion carried 5-0.
CONSENT CALENDAR
Mayor Pro Tern Bone pulled items 2 and 5 for separate action. It was moved by
Councilmember Davert, seconded by Councilmember Thomas, to approye Consent
Calendar items 3, 4 and 6 as recommended by staff. Motion carried 5-0.

APPROVAL OF MINUTES - SPECIAL MEETING OF SEPTEMBER 1, 2004
AND SPECIAL AND REGULAR MEETINGS OF SEPTEMBER 7,2004
Mayor Pro Tern Bone requested that the vote on item 1 of the Minutes of Special
Meeting held September 7 reflect Bone voting for Nuñez and Kawashima for Lee
Motion: It was moved by Mayor Pro Tern Bone, seconded by Councilmember
Dayert, to approve the Special City Council Meeting Minutes of September 1,
2004 and the Special and Regular City Council Meeting Minutes of September 7,
2004with changes as noted. Motion carried 5-0.

APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Motion: Approve Demands in the amounts of $1,986,653.48, $16,078.90,
$640,926.68; Reversals in the amount of $274,492.93, and ratify payroll in the
amount of $487,919.19

PLANNING COMMISSION ACTION AGENDA - SEPTEMBER 13, 2004
All actions of the Planning Commission become final unless appealed by the City
Councilor member of the public.
Motion: Ratify the Planning Commission Action Agenda of September 13, 2004.

APPROVAL OF CONSULTING SERVICES AGREEMENT FOR RAILWAY

QUIET ZONE EVALUATION AT THE RED HILL AVENUE/OCTNSCRRA
RAILWAY CROSSING
Mayor Pro Tern Bone commented on the project and noted that the quiet zone
in the area is much needed
Motion: It was moved by Mayor Pro Tern Bone, seconded by Councilmember
Thomas, to approve the Consultant Services Agreement with Aztec
Engineering California, Inc. for the evaluation of a Quiet Zone at the Red Hill
AvenuelOCTNSCRRA railway crossing in the amount of $10,000.00 and
authorize the Mayor and City Clerk to execute the Consulting Services
Agreement on behalf of the City. Motion carried 5-0.
6.
APPROVAL OF PLANS AND SPECIFICATIONS AND AUTHORIZATION TO
ADVERTISE FOR BIDS FOR THE PHASE I TUSTIN LEGACY BACKBONE
INFRASTRUCTURE PROJECT (VALENCIA NORTH LOOP ROAD,
ARMSTRONG AVENUE, LANSDOWNE ROAD, SEVERYNS ROAD, AND
WEST CONNECTOR ROAD) (CIP NO. 7139)
Motion: Adopt resolutions.
RESOLUTION NO. 04-81 - A resolution of the City Council of the City of
Tustin, California, finding that pursuant to Public Resources Code
Section 2116 and Section 15168(c) of the State of California
Environmental Quality Act (CEQA) guidelines, Phase I Tustin Legacy
Backbone Infrastructure Project (Valencia North Loop Road, Armstrong
Avenue, Lansdowne Road, Severyns Road, and west Connector Road)
(CIP No. 7139) is within the scope of the final joint program MCAS
Tustin EnYironmental Impact Statement! Enyironmental Impact Report
(MCAS Tustin FEIS/EIR); that no new enyironmental document is
required; and that applicable mitigation measures have been
incorporated into the project
RESOLUTION NO. 04-82 - A resolution of the City Council of the City of
Tustin, California approving Plans and Specifications for the Phase I
Tustin Legacy Backbone Infrastructure Project (Valencia North Loop
Road, Armstrong Avenue, Lansdowne Road, Severyns Road, and west
Connector Road) (CIP No. 7139) and authorizing adyertisement for bids

Councilmember Davert:
. Thanked Mr. Trujillo for commenting on Centerline issue and said that current

newspaper articles indicated expected ridership was down yet again;
. Orange County Vector Control announced Asian Tiger mosquito located in the area,
but it appears that OCVC has it under control;
. Tiller Days will be held in 2 weeks; and
. LA Times article praised a Huntington Beach project under the same deyeloper that
will be working on project in Old Town Tustin.
Councilmember Thomas:
. Discussed traffic troubles around Pioneer Middle School.
Councilmember Hagen:
. Agreed with Councilmember Thomas on traffic problems around Pioneer Middle
School on Tustin Ranch Road, suggested signs be changed to 'No Stopping'.
Mayor Pro Tern Bone:
. Orange County Vector Control, last Wednesday examined a dead crow in Tustin and
found positive for West Nile virus, advised everyone to be careful;
. Was inyited by Orange County Transportation Authority to ride the Gold Line to
Pasadena, bells and whistles were very loud;
. Southern California Association of Governments is being sued by State of California
Housing on housing issue;
. Tustin Pride started a new CPR training class in conjunction with Doctor's Ambulance,
call 1-800 420-2221 to sign up; and
. Urged residents to support Proposition 1A in support of our Cities, Police, Parks and
roads.
Mayor Kawashima:
. Announced October 1, 2004, Council member Davert would become the City's new
representative to the Orange County Sanitation District and he would become alternate
member on the board.
ADJOURNMENT - 7:25 p.m. - The next regular meeting of the City Council was
scheduled for Monday, October 4, 2004, at 7:00 p.m. in the Council Chamber at 300
Centennial Way, Tustin.
