City Attorney David E. Kendig: The City Council
unanimously denied Claim Nos. 18-18, 18-20 and 18-25. Other than that, there was no
reportable action.

THE FIRST ITEM TO BE CONSIDERED
City Manager Jeffrey C. Parker Report: The City received a letter from Jamboree Housing
requesting to consider continuing the item to a future meeting, specifically December 4,
2018. Earlier today staff met with Jamboree Housing to address concerns with the structure
of the development agreement and its relationship with the funding associated with the
project relative to the prior approval by Orange County with regards to the Mental Health
Services Act funds. Staff is inconcurrence with continuing the item however based on staff
needing time to review and modify the DDA, it would be anticipated that this item will come
back to the Council in the first quarter of 2019.
11. DISPOSITION AND DEVELOPMENT AGREEMENT (DDA) WITH JHC-
ACQUISITIONS LLC (AKA JAMBOREE HOUSING CORPORATION) FOR PARCEL 1A
SOUTH AT TUSTIN LEGACY
Request for authorization to approve the DDA between JHC-Acquisitions LLC (Developer)
and the City for the development of a one hundred fourteen (114) unit affordable housing
development: fifty-four (54) affordable rental units for families (Phase I); and sixty (60)
City Council November 20, 2018

permanent supportive affordable rental units for the homeless (Phase II) on Parcel 1A
South. The DDA outlines the terms and conditions under which the City property,
approximately 3.55 acres, will be ground lease conveyed and developed by JHC-
Acquisitions LLC. Financing for the project is dependent upon multiple sources including
tax credits approved by the State. A 55-year ground lease, referenced in the DDA, must be
negotiated prior to conveyance that will be submitted to Council for consideration.

6. JOHN WAYNE AIRPORT NOISE ABATEMENT QUARTERLY REPORT
This agenda report transmits the John Wayne Airport (JWA) Noise Abatement
Quarterly Report for the second quarter of 2018. The average noise level
measured at Tustin's monitoring station (NMS 1ON), located at Columbus Tustin
Middle School on Beneta Way (Figure 1), remained fairly consistent with prior
quarters during this second quarter reporting period. Average noise levels during
the second quarter continued to remain well below the City, County, and State
criteria of 65 dB Community Noise Equivalent Level (CNEL) for residential uses.

7. AWARD OF BID FOR THE CLIFTON C. MILLER COMMUNITY CENTER

The bid opening for the Clifton C. Miller Community Center Auditorium
Renovation project was held on November 6, 2018. The Auditorium Renovation
was identified by the Community Services Commission as the next project to be
completed on their seven-year Capital Improvement Project priority list.

LEGACY PARK IMPROVEMENTS PROJECT, CIP NO. 20043
Staff is recommending that the City Council award the construction contract for
the Veterans Sports Park at Tustin Legacy Park Improvements Project, CIP No.
20043 to the lowest responsive/responsible bidder, Los Angeles Engineering, Inc.
It was moved by Mayor Murray and seconded by Councilmember Puckett to:
1. Deny the bid protest submitted by Ohno Construction; and
2. Award the construction contract for the Veterans Sports Park at Tustin
Legacy Park Improvements Project, CIP No. 20043 to the lowest
responsive/responsible bidder, Los Angeles Engineering, Inc., in the amount
of $19,445,493 (including the water play feature) adjusted for the bid
alternative and deductive items and authorize the Mayor and the City Clerk to
City Council November 20, 2018

execute the contract documents on behalf of the City; and appropriate the
following:
1. $1,500,000 from anticipated revenue in the Capital Improvement
Program-General Fund (Fund 200) for use of grant funds awarded for
this project,
2. $333,000 from anticipated revenue in the Capital Improvement
Program-General Fund (Fund 200) for reimbursable T-Mobile
expenses,
3. $1,500,000 from the MCAS Tax Allocation Bond Fund (Fund 561), and
4. $454,000 from the General Fund Reserves (Fund 100) for the water
play feature.

Attended the Emergency Medical Committee meeting; following items were discussed:
The Point of Dispensing (POD) Drill; was held at Irvine Regional Park in October; the

exercise served over 1,000 people in 2 hours.
Influenza A Orange County is asking hospitals to report any hospitalizations for the

flu; the FDA approved a new single dose medication to be administered within 48

hours of onset.
West Nile Virus ten reported cases in the County and one death.
Î
Typhus there is an increase in Los Angeles County but not very many cases in
Î
Orange County.
Recent study was done to examine the use of a continuous chest compression

device rather than personnel providing CPR; device will assist with continuous chest
compressions rather than manual compressions which must be stopped when the
patient is intubated or loaded into an ambulance; based on the favorable outcomes,
all ambulance providers will be required to have the device in 2019.
An upcoming study will require that any high risk 911 pediatric calls (drowning,
Î
seizures, sepsis) will require the base station to interface with a pediatric trauma
surgeon and pediatric nurse; when pilot is finished, the data will be examined to
determine if policy changes are needed.
Current legislation is calling severely injured police dogs to be transported by
Î
ambulance for care
EMS personnel should become mandatory reporters for adult/child abuse
