9. DECLARING RESULTS OF NOVEMBER 6, 2018 GENERAL
MUNICIPAL ELECTION
REVISED RESOLUTION AND ORDINANCE WITH CERTIFIED ELECTION RESULTS
RESOLUTION NO. 18-92
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, DECLARING THE RESULTS OF THE GENERAL MUNICIPAL
ELECTION HELD ON NOVEMBER 6, 2018, AND OTHER SUCH MATTERS AS
PROVIDED BY LAW
WHEREAS, the City's General Municipal Election was consolidated with the
Statewide General Election held and conducted in the City of Tustin, California, on
Tuesday, November 6, 2018, as required by law; and
WHEREAS, notice of the election was given in time, form and manner as provided
by law; voting precincts were properly established; election officers were appointed and in
all respects the election was held and conducted and the votes were cast, received and
canvassed and the returns made and declared in time, form and manner as required by
the provisions of the Elections Code of the State of California for the holding of elections in
general law cities; and
WHEREAS, the County Election Department canvassed the returns of the election
and has certified the results to the City Council, the results are received, attached and
made a part hereof as "Exhibit A."
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That the whole number of ballots cast in the precincts, excluding vote -
by -mail ballots, was 9,215; the whole number of vote -by -mail ballots cast in the City was
14,965; that the whole number of ballots cast in early voting was 511, making a total of
24,691 ballots cast in the City.
SECTION 2. That the names of persons voted for at the election for Member of the
City Council are as follows: Austin Lumbard, Barry W. Cooper and Sherri Loveland.
SECTION 3. The measure voted upon at the election is as follows:
Shall the measure to provide police, fire, emergency
medical and rescue protection, to prevent fires and power YES
outages, to maintain parks and roads, and to provide other
local services and improvements in the community by
raising the transient occupancy tax (paid by short-term NO
hotel and other guests) from 10% to 13% until ended by
voters, providing approximately $480,000 annually, with
audits, all funds only for Tustin, be adopted?

SECTION 4. That the number of votes given at each precinct and the number of
votes given in the City to each of the persons above named for the respective offices for
which the persons were candidates are listed in "Exhibit A" attached.
SECTION 5. The City Council does declare and determine that: Austin Lumbard
and Barry W. Cooper were elected as Members of the City Council for the full term of four
years.
SECTION 6. As a result of the election, a majority of the voters voting on the
measure relating to an increase in the Uniform Transient Occupancy Tax did vote in favor
of it, and that the measure was carried, and shall be deemed adopted and ratified.
SECTION 7. That the City Clerk shall enter on the records of the City Council of the
City of Tustin a statement of the result of the election showing: (1) The whole number of
votes (ballots) cast in the City; (2) The names of the persons voted for; (3) For what office
each person was voted for; (4) The number of votes given at each precinct to each
person; and (5) The total number of votes given to each person.
SECTION 8. The City Clerk shall immediately make and deliver to each of the!
persons so elected a Certificate of Election signed by the City Clerk and authenticated; the
City Clerk or authorized person shall also administer to each person elected the Oath of
Office prescribed in the Constitution of the State of California and shall have them
subscribe to it and file it in the office of the City Clerk. Each and all of the persons so
elected shall then be inducted into the respective office to which they have been elected.
SECTION 9. That the City Clerk shall certify to the passage and adoption of this,
resolution and enter it into the book of original resolutions.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin on the 4th day of December, 2018.

INITIATIVE ORDINANCE NO. 1499
AN ORDINANCE OF THE PEOPLE OF THE CITY OF
TUSTIN, CALIFORNIA, AMENDING SECTION 2703 OF THE
TUSTIN CITY CODE TO INCREASE THE TRANSIENT
OCCUPANCY TAX
The People of the City of Tustin hereby ordain as follows:
WHEREAS, a measure to increase the transient occupancy tax was put before the voters
at a general municipal election held on November 6, 2018; and
WHEREAS, the measure received the requisite votes for adoption.
NOW, THEREFORE, the people of the City of Tustin do ordain as follows:
Section 1. Section 2703 of the Tustin City Code, entitled "Tax Imposed" is amended to
provide as follows:
"For the privilege of occupancy in any hotel, each transient is subject to and shall
pay a tax in the amount of thirteen percent (13%) of the rent charged by the
operator. The tax constitutes a debt owed by the transient to the City which is
extinguished only by payment to the operator or to the City. The transient shall pay
the tax to the operator of the hotel at the time the rent is paid. If the rent is paid in
installments, a proportionate share of the tax shall be paid with each installment.
The unpaid tax shall be due upon the transient ceasing to occupy space in the
hotel. If for any reason the tax due is not paid to the operator of the hotel, the City
Treasurer may require that such tax shall be paid directly to the City Treasurer."

ORDINANCE NO. 1499
I, Erica N. Yasuda, City Clerk and ex -officio Clerk of the City Council of the City of
Tustin, California, do hereby certify that at the regular meeting held on December 4,
2018, the City Council adopted Resolution No. 18-92 declaring the results of the
General Municipal Election held on November 6, 2018. The ballots cast for Initiative
Ordinance No. 1499 (Measure CC) are as follows:
o Yes: 14,244
o No: 8,958
In accordance with California Elections Code section 9217, this Ordinance will take effect
ten (10) days after approval of Resolution 18-92 declaring the results of the election.
