LIPHOLDING THE PLANNING COMMISSION'S ACTION TO

APPROVE CONDITIONAL USE PERMIT 98-012 AUTHORIZING
4 SPORTS FEILD LIGHTING AT THE HERITAGE WAY
NEIGHBORHOOD PARK LOCATED AT 2350 KINSMAN CIRCLE.

The City Council does hereby resolve as follows:

I. The City Council finds and determines as follows:

9 A. That a proper application for Conditional Use Permit 98-012 was filed by
The City of Tustin Parks and RecreatiOn Services Department to request
~0 authorization of sports field lighting on the roller hockey and basketball
courts at Heritage Way Park located at 2350 Kinsman Circle.

~2 B. That the proposed field lighting is subject to approval of a conditional use
permit pursuant to Section 3.9.2.A. 8ofthe East Tustin Specific Plan (ETSP).

~4 C. That a public heating was duly called, noticed and held on said api~lication
on May 11, 1998 by the Planning Commission at which time the Planning
~s Commission adopted Resolution No. 3590 approving the project.

D. That on May 18, 1998, an appeal was filed by Nancy Lawrence and Jean L.
~7 Van Camp.
~s E. That a public hearing was duly called, noticed and held on said appeal on
~9 June 1, 1998 by the City Council.
20 F. That Environmental Impact Report (EIR 85-02), as modified by supplements
and addenda, for the East Tustin Specific Plan has been previously certified
2~ in conformance with the requirements of the California Quality Act for this
22 project.
23 G. That the sports field lighting operation will not,~ under the circumstances of
24 this case, be detrimental to the health, safety, morals, comfort, or general
welfare of the persons residing or working in the neighborhood of such
2s proposed use, nor be injurious or detrimental to the property and
improvements in the neighborhood of the subject property, or to the general
26 welfare of the City of Tustin, as evidenced by the following findings:
27
1) The proposed use, as conditioned, will not be detrimental to
28 surrounding properties in that the lighting is designed to provide
direct and focused light on the courts and minimize spillover on the
29 adjacent residential properties.

2) The proposed use, as conditioned, will not have a negative effect on
4 surrotmding properties, in that the proposed improvements are for the
general use and enjoyment of the surrounding properties and the
s general welfare of the City.

3) The proposed use is consistent with the City/s General Plan,
7 especially the goals and policies of the Conservation/Open
s space/Recreation Element.
9 H. The City Council finds that the proposed lighting will not impair the orderly
and harmonious development of the area, the present or future development
~0 therein, or the occupancy as a whole.

I. That the project has been reviewed for consistency with the Air Quality Sub-
~2 element of the City of Tustin General Plan and has been determined to be
consistent with the Air Quality Sub-element.

II. The City Council hereby approves Conditional Use Permit'98-012 to authorize the
~5 use of sports lighting on the roller hocke3~ and basketball courts at Heritage Way
Park located at 2350 Kinsman Circle, subject to the conditions contained in Exhibit

A attached hereto.

CONDITIONS OF APPROVAL

GENERAL
(1) 1.1 The proposed project shall substantially conform with the submitted plans
for the project date stamped June 1, 1998, on file with the Community
Development Department, except as herein modified, or as modified by the
Director of 'Community Development in accordance with this Exhibit. The
Director of Community Development may also approve minor modifications
to plans during plan check if such modifications are to be consistent with the
provisions of the Tustin City Code.
(1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be
complied with as specified or prior to the issuance of any building permits
for the project, subject to review and approval by the Community
Development Department.
PLAN SUBMITTAL
(4) 2.1 Three (3) sets of construction plans shall be prepared in accordance with
applicable Building Code and submitted for review and approval by the
Community Development Department. Compliance with approved plans
shall be inspected by the Community Development Department during
construction and prior to final inspection.
(4) 2.2 Plans and calculations for the structural details of the foundation for the light
poles and electrical loading shall be submitted for Building and Electrical
Permits.
Lighting
(1) 3ol All lights shall be installed at the locations indicated on the submitted plans.
Any modifications to the location or light fixture type shall be subject to
approval by the Community Development Department Director.

(2) 3.2 The field lighting for the roller hockey. and basketball courts shall be turned
off no later than 10:00 p.m. consistent with the park hours.
(2) 3.3 The lighting fixtures shall be installed so that fixtures are directed downward
in such a manner to ensure that no negative impact to adjacent properties.
Prior to final completion of the park, .the field lighting for the roller hockey
and basketball courts shall be reviewed by the Community Development
Department and Parks and Recreation Services Department to determine
final fixture adjustments to ensure that direct light rays are oriented away
from the adjacent residential properties.
