BINSACK, COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: REVIEW OF OLD TOWN PERMIT PARKING PROGRAM SUMMARY: For several years, Old Town residents expressed concerns about the impacts related to an increase in on -street parking in the Old Town residential area, and the City Council directed staff to address these concerns. After conducting significant public outreach, the City Council: 1) directed staff on February 20, 2018, to implement permit parking in the Old Town residential area; 2) adopted an ordinance on March 20, 2018, establishing permit parking in the Old Town residential area; and 3) directed staff to monitor the program and to report back to the Council. RECOMMENDATION: That the City Council receive and file this report. FISCAL IMPACT: The fiscal impacts associated with establishing, implementing, and enforcing the permit parking program within the Old Town residential area are being partially offset by the annual permit parking fee of $50. Permits are issued by the Tustin Police Department, and parking enforcement is conducted by routine patrol. CORRELATION TO THE STRATEGIC PLAN: Permit parking contributes to the fulfillment of the City's Strategic Plan Goal B: Public Safety and Protection of Assets. Specifically, permit parking implements or fosters the implementation of Strategy #3, which among other items, is to ensure continuous maintenance and improvement of traffic control and transportation facilities so that Tustin can protect the health and safety and welfare of the public, including those traveling upon and parking upon City streets. City Council Report January 15, 2019 Old Town Parking Page 2 BACKGROUND: According to many Old Town residents, prior to the implementation of permit parking, Old Town had a variety of parking issues which can be summarized as follows: • Many vehicles from other areas of Tustin and from other cities were parked overnight on the residential streets of Old Town. • Many vehicles registered to properties with rental units and/or multiple family residences were parked in single family residential areas. • Vehicles frequently obstructed sidewalks and driveways. • On -street parking was further impacted when garages were used for storage rather than vehicles, and when individuals from other areas parked their vehicles in front of single family residences. • Illegal construction and/or conversions of garages or other structures to living units increased the need for additional parking. • Residents are concerned that the addition of residential units including accessory dwelling units, new condominiums, and mixed use residential projects will exacerbate the demand for on -street parking in Old Town. . To address these concerns, the City Council considered the establishment of permit parking in the Old Town residential area (Attachment A) on February 20, 2018, and directed staff to set the required ordinance for first reading, develop associated guidelines, and implement permit parking in the Old Town residential area. Ordinance No. 1494 (Attachment B) establishing permit parking in the Old Town residential area was adopted by the City Council on March 20, 2018, and became effective on April 19, 2018. The Old Town residential permit parking program was fully implemented and enforced beginning on May 7, 2018. The Old Town permit parking policy is unique to the Old Town residential area and is available to residents of single family and multiple family dwellings within Old Town, consistent with the California Attorney General's Opinion No. 14-304, which concluded that local authorities may limit the issuance of long-term preferential parking permits to residents only, but may not distinguish among residents based on the type of dwelling in which they live. All Old Town residents, including those of multiple family dwellings, need to fully utilize their on-site parking (garage and driveway) to be eligible for parking permits. The provisions of the Old Town Permit Parking Program are summarized in Table 1, and in Attachment C. As of November 7, 2018, six (6) months had passed since the implementation of the permit parking program in Old Town. DISCUSSION: Summary of Parking Permits Issued As of December 20, 2018, 171 parking permits had been issued to Old Town residents, and 163 permits were still active. The following table summarizes the parking permits issued. As indicated in the table, approximately 53 percent of the Old Town parking permits have been issued to residents of the Tustin Acres community. As expected, the number of citations has decreased dramatically since the implementation of the program. TABLE 3 — PERMIT PARKING CITATIONS ISSUED Number of permit parking citations issued 683 Number of permit parking citations issued to Tustin residents, not in Old Town 221 Number of permit parking citations issued to residents of other cities 358 Number of permit parking citations issued in May of 2018 411 Number of permit parking citations issued in December of 2018 39 Summary of Public Concerns Several Old Town residents have contacted staff in writing or by telephone to express their concems and to find out when the six (6) month review of the Old Town Residential Area Permit Parking Program would be agendized for consideration by the City Council. A few of these residents have indicated that the program should be rescinded or modified to address their concerns. Copies of written correspondence received by staff from May 2018 to December 2018 are included in Attachment D. Public concerns communicated directly to City staff since the implementation of permit parking in Old Town include: 1. There is a lack of on -street parking for residents of the Tustin Arms Apartments at 530 W. First Street, since parking on First Street is limited and Tustin Arms is not located within the defined Old Town residential area, and therefore its residents are not eligible for parking permits. 2. The inability to qualify for a permit until on-site parking spaces in the garage and driveway are fully utilized (and the inconvenience in moving cars, especially when the driveway is narrow). Some residents have requested that the Council reconsider the policy for the issuance of parking permits and allow one (1) parking permit to be issued to every Old Town residence, without first, fully utilizing all on-site parking spaces, and/or to not include driveways in the calculation of required on-site parking spaces. 3. Some residents on South B Street would like permit parking to be implemented on the east side of South B Street adjacent to Peppertree Park, the Tustin Area Senior Center and the Tustin Unified School District offices, because of noise and trash City Council Report January 15, 2019 Old Town Parking Page 5 associated with vehicles parked there overnight (see Attachment A — Old Town Residential Permit Parking Zone Map). 4. Some residents in the vicinity of Williams Street and Tustin Village Way would like to be able to have permits to park in Old Town, since on -street parking is fully utilized overnight in their neighborhood. 5. Some residents have needed assistance in obtaining visitor permits, due to not having personal access to, or not understanding how to use, the internet to set up an account with the Police Department. CONCLUSION: Since the implementation of the Old Town Permit Parking Program, 171 parking permits have been issued to Old Town residents, and 163 permits are still active. Although staff has received positive feedback from those who are pleased with the outcome of the Program, some Old Town residents have expressed concerns regarding their ineligibility to obtain parking permits, the inconvenience of fully utilizing their garages and driveways, and/or the impacts associated with individuals parking their vehicles overnight in areas where permit parking has not been implemented. That Section 22507(a) of the State of California Vehicle Code grants cities the authority to establish preferential parking on designated streets or portions thereof, during. all or certain times of the day, upon approval by the City Council of an ordinance or resolution containing provisions that are reasonable and necessary to assure the effectiveness of a preferential parking program, and after signs giving adequate notice of such regulations are placed. B. That the City Council has determined that, for a variety of reasons that differ by location in the City, parking in certain locations in the City is impacted, and at times, residents and their guests are unable to find parking spaces in convenient proximity to their residences_ A lack of adequate parking within convenient proximity to residences can have an adverse impact on safety of the traveling and pedestrian public, and may adversely affect the quality of residential living. C. That in light of the foregoing, it is beneficial to the business merchants, the residents and to the safety and welfare of the community as a whole, to establish a process for the designation of locations for preferential parking privileges to better ensure availability of adequate parking within convenient proximity to residences. D. That this Code amendment is regulatory in nature, and the City of Tustin has a substantial interest in protecting the health and safety and welfare of the public including those traveling upon and parking upon City streets. E. That the California Attorney General's Opinion No. 14-304 concluded that local authorities may limit the issuance of long-term .preferential parking permits to residents only, but may not distinguish among residents based on the type of dwelling in which they live. F. That many vehicles from other areas of Tustin and from other cities are parked on the residential streets of Old Town. Ordinance No. 1494 Page 1 of 5 am G. That illegally parked vehicles frequently obstruct sidewalks, driveways, and visibility. Now H. That many Old Town residents are concerned that new residential units in the Old Town residential area will exacerbate the demand for on -street parking in the Old Town residential area. I. To address concerns regarding on -street parking in the Old Town residential area, staff has taken several actions including: the facilitation of permit parking requests; increased enforcement; an updated overnight vehicle count; a resident survey; a community workshop; meeting with apartment managers; studying potential parking impacts in conjunction with the proposed Downtown Commercial Core Plan; outreach to the Tustin Acres community; and the distribution of an advisory ballot to property owners and tenants in the Old Town residential area. J. That on February 20, 2018, the City Council considered two (2) alternative permit parking programs for the Old Town residential area and directed staff to set the required ordinance for first reading, develop associated guidelines, and implement permit parking in the Old Town residential area in accordance with Alternative Two. r� K. That on March 7, 2018, a public meeting was duly noticed, called, and held am concerning this Code amendment. L. That the Code amendment regulates the use of existing public highways and streets for public health, safety and welfare purposes, directs a minor alteration in the operation of the City roadway system, and as such, the Class 1 Existing Facilities exemption in the California Environmental Quality Act Guidelines, Section 15301 applies. M. That the proposed amendment is reasonably necessary to protect the health, safety and welfare of the citizens of the City of Tustin. SECTION II: Subsection 5331n of the Tustin City Code is hereby amended by repealing subsection (5), amending subsection (6), and adding subsection (15) to read in its entirety as follows: 5331 STOPPING, STANDING OR PARKING RESTRICTED OR PROHIBITED .m ON CERTAIN STREETS Ordinance No. 1494 Page 2 of 5 n Parking by Permit Only The following area(s) have been designated to require a special parking permit to park vehicles on the streets between the hours of 2:00 a.m. and 6:00 a.m., seven (7) days a week. This policy Is intended to mitigate parking intrusions (spillover parking) that may impact the quality of life and affect the public safety in the Old Town residential area. Elialbility All residential uses, including single and multiple family uses, along the residential streets within the zone depicted on the attached map shall be eligible for Permit Parking in the Old Town residential area. Criteria Each household in the permit parking area who wishes to park on public streets within the designated restricted area will be required to obtain a permit to do so pursuant to the criteria outlined below. 1. All authorized Preferential Permit Parking areas will prohibit overnight on -street parking without a City -issued permit from 2am to Gam, seven (7) days a week 2. All residents in a Preferential Permit Parking Area will be subject, without exception, to all related parking regulations. 3. Each household will be issued a permit(s) upon request to the Police Department and verification of full utilization of off-street parking, Including full use of garage, carport, and driveway space. 4. Parking Permits shall be obtained In person at the Police Department. The applicant must provide proof of residency, vehicle license and registration, complete and sign a Permit Parking Application, and certify that off-street parking is fully utilized. This document will be the permanent record of the respective household's Program participation, acknowledgement and receipt of the Permit Parking Program's procedures and requirements. 5. Approved permits are issued annually, must be renewed annually, and are not transferable. -11- 1 ww 6. A maximum of 75 daily guest permits per residence may, at the discretion of the Police Department, be Issued every six (6) months. ... 7. All Parking Permits remain the property of the City and may be revoked if used contrary to the provisions of this policy. Bail Schedule The fine for violation of the Permit Parking regulations shall be as the City Council may set from time to time. Misuse of Parking Permits Any person selling, fraudulently using, reproducing or mutilating a Parking Permit issued in conjunction with the Parking . Permit Program shall be guilty of an infraction and shall be subject to a fine as the City Council may set from time to time and the forfeiture of all Parking Permits, or such other penalty as the City Council may, from time to time, set by ordinance. Program Removal 1. A Permit Parking Area or part thereof may be removed from the Permit Parking M Program by the City Council pursuant to a determination that removal from the Program is in the community interest or in the interest of public safety or at City ..r Council discretion. 2. There shall be no cost to the residents associated with removing an area from the Permit Parking Program. 3. If an existing Permit Parking Area is revoked, any request for reinstatement shall be subject to the same process as that of a new Parking Permit Area. Exceptions & Exemptions Fee To accommodate particular events or circumstances, the Police Department may, temporarily, suspend enforcement of the Permit Parking regulations. The fee for preferential Permit Parking regulations shall be as the City Council may set from time to time. Currently, resident permits ars Issued at a cost of $50 per permit per calendar year. It is greatly appreciated. However there is a problem. South B Street is only restricted on one side and now that side if filled with the same cars and problems that were present in the other parts of Old Town. I realize that side is zoned commercial and so the restrictions don't apply. My question is, are any businesses open during the hours of 2am and 6am. I don't think any are. Can the city do anything about this?? The homeowners and residents on our street now have the brunt of this problem and we are all unhappy with this development. The problems haven't changed..... trash, noise, unknown people in the area which could very well lead to crime. Someone already tried to get through our gate a couple of nights ago.I spoke to the lady writing the tickets this morning. She said the tickets are almost all for people who live in other cities, mainly Santa Ana I would imagine. Even though it is not politically correct we all know these people are likely illegal aliens, not even legal citizens. I just don't understand why South B Street is now responsible to deal with this. The vote was in favor of the permit parking in Old Town to alleviate this problem we are now saddled with it.. We are part of Old Town. It is only going to get worse for us on South B Street. I hope the street you live on doesn't have to deal with this any of this nonsense. The people parking in Old Town from other cities hadn't migrated to South B Street until the implementation of the new restrictions. And yes, we have been awakened late at night a couple times already by loud people parking and doing whatever they do late at night. The cars are coming and going late at night, nothing has changed with that part of it. Now it is occuring on South B Street. Photo was taken today about 5:50am. Are there any other streets in Old Town that have residential zoning on one side and commercial on the other? If this street is the only one, can't something be done about this now? There is parking for these people in other commercial areas in Old Town. I still don't understand why we must shoulder this burden after Old Town residents and property owners voted against this very thing. Also, is Tustin a santuary city? We have 4 cars and 4 drivers living in our home. We have a 3 car garage, which we utilize, and a typical long Old Town type driveway. Under the plan we need 3 cars in the garage and "4" cars in our driveway to be eligible for a permit. I have always believed a driveway was the thing you drove on to get in your garage. I do understand some people use them for storage. If that was my case I would understand the need to juggle "3" cars in my driveway..... however it is not. My understanding from reading articles about the problem was people complained about not being able to park in front of their own homes ....... I think this is even a bigger complaint now. I have no problem with parking permits to help the problem areas. I have no problem even paying for them. I know of friends in Old Town Orange who have even a greater problem with parking...... yet their solution seems to have been much more in line with homeowners. I hope the City Council and Planning Departments will re -think this disappointing solution. If you ever get a chance to drive around West Second before 6 am in the morning, between Pacific and A, one car will be parked on the street...... with a whole bunch stacked up in driveways, parked sideways in yards, and even on the lawns. I know there is a thread on the Next Door app and many of the the neighbors are wondering the same thing. Many of us are hopeful we can get the driveway and garage combination changed to just garage spaces. I know the concern was not being able to park in front of your own home. I have no problem with the need to regulate overnight street parking in our area. But I believe that the way the City Council has chosen to administrate it is absurd. I attended the city council meetings prior to the vote. It was obvious to all of us that the council never took into consideration the alternative plans that the residence proposed. When the consultant was asked if they had considered the type of plan we proposed, they were dumbfounded and could not answer the question. At that moment the Mayor talked over them and made an excuse. The Council did not have the integrity to consider what the people wanted. It was a very sad state for our city. I sincerely request that you reconsider the way the rule is administered. The problem is the non-residents parking in Old Town. It has never been a problem for residents to park on the street. They did not create the burden. I suggest finding a way to allow residents to park any vehicle they choose on the street. Either use a sticker for each registered vehicle or a hang tag for each registered vehicle. Residents should have the freedom to use the streets they pay for in our city. Most of the homes in our area have narrow single car driveways. It is not in anyone's best interest to have to jockey cars around every evening and morning just to solve a problem that doesn't exist any longer. I don't believe the use of the garage and number of cars in a driveway should be regulated or enforced. It never has been enforced in the past. The precedent has been set. Leave it alone. Allow the residents to choose for themselves how to use their driveway. Many of us moved here to get away from the South County type of over -regulation. Solve the problem but please do not over -regulate when it is not necessary. I appreciate your consideration and look forward to your support of revising the enforcement of parking regulations. I have lived in old town since the late 70s. My wife and I and all of our neighbors hate the fact that they cannot park in front of their house at night. Most of us are not eligible for permits as we have long tandem single car width driveways. Yes that leaves a lot of room for parking on the driveway but also make it VERY difficult juggling cars in and out of our driveways. I suggest, and all my neighbors agree, that any house that is located in old town should automatically be eligible for one permit. This will solve A LOT of the griping from residents. My thought would be to use garage space as the criteria, and not counting driveways as additional spots. The city would not even need to spend the resources, as it does now, to inspect the garages. If you have a two car garage that is two spots you can't get a permit until the third vehicle. If you have crap in your garage, you must use your driveway. The long driveways many of the residents have really make it difficult under the current plan, even though many use our garages. I know there will be exceptions. Many of the one car garage homes can't even handle a mid-size car. Those could be handled on a exception basis. It is really more than just a minor inconvenience, it is an issue we have to deal with two times each day. There is one car on our block that was able to get a permit, while every other home has cars stacked up on the driveways in front of the garages. Drive around West 2nd and A early some morning, you will see a empty street, cars stacked everywhere, and you will also see many signs in yards showing people feel the same way I do.
