SUMMARY
Approval of a Consultant Services Agreement between the City of Tustin and RJM
Design Group, Inc., to provide the City with architectural design, construction
documents and plans and specifications for the improvements to Citrus Ranch Park,
Project No. 2046.
RECOMMENDATION
1. Authorize the City Manager to execute a Consultant Services Agreement with the
firm of RJM Design Group, Inc., for the Citrus Ranch Park project in an amount not
to exceed $328,515.00.
2. Approve a supplemental appropriation of $250,000 from the 2004/05 Fiscal Year
Park Development Fund into the Capital Improvement Program for Project No. 2046
for Final Design.
FISCAL IMPACT
The 2004-2005 FY Capital Improvement Program includes the development of plans,
specifications and construction documents for the Citrus Ranch Park. The total
appropriation for the project is $3.6 Million. The Consultant Services Agreement of
$328,515.00 is just below 10% of the total projected cost. These funds have been
allocated and are identified in the Park Development Fund for the preparation of plans
and specifications.
BACKGROUND
The Tustin City Council adopted the Parks Seven-Year Capital Improvement Plan for
FY 2004/05, which included the preparation of construction and bid documents for the
Citrus Ranch Park. Three firms responded to the City's Request for Proposal for
Architectural and Construction Drawings. The proposals were evaluated and RJM
Design Group of San Juan Capistrano was selected. This decision was based upon the
firm's strong background in recreation and park planning, extensive local experience in
working with municipal agencies and the submittal of the lowest cost of all those who
submitted proposals. RJM Design Group, Inc., created the master plan for Citrus

Ranch Park in 2001. The negotiated fee for the agreement is fair and reasonable. The
City Attorney has approved the Consultant Services Agreement as to form.

CONSULTANT SERVICES AGREEMENT
This Agreement for Consultant Services (herein "Agreement"), is made and
entered into by and between the CITY OF TUSTIN, a municipal corporation ("City"), and
RJM Desian GrouP. Inc. ("Consultant").
WHEREAS, Consultant is qualified to provide the necessary services and has
agreed to provide such services; and
WHEREAS, Consultant has submitted to City a proposal, dated Julv 29. 2004 ,
a copy of which is attached hereto as Exhibit "A", and is by this reference incorporated
herein as though set forth in full hereto (the "Proposal").
NOW, THEREFORE, in consideration of the premises and mutual agreements
contained herein, City agrees to employ and does hereby employ Consultant and
Consultant agrees to provide consulting services as follows:
1.
SERVICES OF CONSULTANT
1.1 Scope of Services. In compliance with all terms and conditions of
this Agreement, Consultant shall provide those services specified in the "Proposal and
Scope of Services" attached hereto as Exhibit "A" and incorporated herein by this
reference, (the "services" or the "work"). Consultant represents that all services shall be
performed in a competent, professional and satisfactory manner in accordance with
normal standards prevalent in the industry. In the event of any inconsistency between the
terms contained in Exhibit "A" and the terms set forth in the main body of this Agreement,
the terms set forth in the main body of this Agreement shall govern.
1.2 Compliance with Law. All services rendered hereunder shall be
provided in accordance with applicable laws, ordinances, resolutions, statutes, rules, and
regulations that are in force at the time work is performed of the City of Tustin and of any
federal, state or local governmental agency of competent jurisdiction.
1.3 Licenses and Permits. Consultant shall obtain at its sole cost and
expense such licenses, permits and approvals as may be required by law for the
performance of the services required by this Agreement.
1.4 Familiaritv with Work. By executing this Contract, Consultant
represents that Consultant (a) has investigated and considered the work to be performed,
(b) has investigated the site of the work and become fully acquainted with the conditions
there existing, (c) has carefully considered how the work should be performed, and (d)
fully understands the facilities, difficulties and restrictions attending performance of the
work under this Agreement. Should the Consultant discover any latent or unknown
conditions materially differing from those inherent in the work or as represented by the
City, Consultant shall immediately inform City of such fact and shall not proceed with any
work except at Consultant's risk until written instructions are received from the Contract
Officer.

1.5 Care of Work. Consultant shall adopt and follow reasonable
procedures and methods during the term of the Agreement to prevent loss or damage to
materials, papers or other components of the work, and shall be responsible for all such
damage until acceptance of the work by City, except such loss or damages as may be
caused by City's own negligence.
1.6 Additional Services. Consultant shall perform services in addition to
those specified in the Proposal when directed to do so in writing by the Contract Officer,
provided that Consultant shall not be required to perform any additional services without
compensation. Any additional compensation not exceeding ten percent (10%) of the
original Contract sum must be approved in writing by the Contract Officer. Any greater
increase must be approved in writing by the City Manager.
1.7 Special Requirements. Any additional terms and conditions of this
Agreement, are set forth in Exhibit "B" and are incorporated herein by this reference.
2.
COMPENSATION
2.1 Compensation of Consultant. For the services rendered pursuant to
this Agreement, the Consultant shall be compensated and reimbursed only such amount
as are prescribed in Exhibit "B", in an amount not to exceed $328.515.00
2.2 Method of Pavment. In any month in which Consultant wishes to
receive payment, Consultant shall no later than the first working day of such month,
submit to City in the form approved by City's Director of Finance, an invoice for services
rendered prior to the date of the invoice. City shall pay Consultant for all expenses stated
thereon which are approved by City consistent with this Agreement, no later than the last
working day of said month.
2.3 Chanaes. In the event any change or changes in the work is
requested by City, the parties hereto shall execute an addendum to this Agreement,
setting forth with particularity all terms of such addendum, including, but not limited to, any
additional Consultant's fees. Addenda may be entered into:
A. To provide for revisions or modifications to documents or
other work product or work when documents or other work product or work is required by
the enactment or revision of law subsequent to the preparation of any documents, other
work product or work;
B. To provide for additional services not included in this
Agreement or not customarily furnished in accordance with generally accepted practice in
Consultant's profession.
2.4 Pavment for Chanaes. Changes approved pursuant to an
Addendum shall be compensated at the personnel hourly rates prescribed in Exhibit "B"
hereto.

3.
PERFORMANCE SCHEDULE
3.1
Time of Essence. Time is of the essence in the performance of this
Agreement.
3.2 Force Majeure. The time for performance of services to be rendered
pursuant to this Agreement may be extended because of any delays due to
unforeseeable causes beyond the control and without the fault or negligence of the
Consultant, including, but not restricted to, acts of God or of a public enemy, acts of the
government, fires, earthquakes, floods, epidemic, quarantine restrictions, riots, strikes,
freight embargoes, and unusually severe weather if the Consultant shall within ten (10)
days of the commencement of such condition notify the Contract Officer who shall
thereupon ascertain the facts and the extent of any necessary delay, and extend the time
for performing the services for the period of the enforced delay when and if in the
Contract Officer's judgment such delay is justified, and the Contract Officer's
determination shall be final and conclusive upon the parties to this Agreement.
3.3 Term. Unless earlier terminated in accordance with Section 7.7 of
this Agreement, this Agreement shall continue in full force and effect until satisfactory
completion of the services but not exceeding one (1) year from the date hereof, unless
extended by mutual written agreement of the parties.
4.
COORDINATION OF WORK
4.1 Representative of Consultant. The following Principal of the
Consultant is hereby designated as being the principal and representative of Consultant
authorized to act in its behalf with respect to the work specified herein and make all
decisions in connection therewith: Larrv Rvan. Principal
It is expressly understood that the experience, knowledge, capability
and reputation of the foregoing Principal is a substantial inducement for City to enter into
this Agreement. Therefore, the foregoing Principal shall be responsible during the term of
this Agreement for directing all activities of Consultant and devoting sufficient time to
personally supervise the services hereunder. The foregoing Principal may not be
changed by Consultant without the express written approval of City.
4.2 Contract Officer. The Contract Officer shall be the Parks &
Recreation Director of City unless otherwise designated in writing by the City Manager of
City. The Co-Contract Officer shall be the Recreation Superintendent. It shall be the
Consultant's responsibility to keep the Contract Officer, or the Co-Contract Officer in the
Contract Officer's absence, fully informed of the progress of the performance of the
services and Consultant shall refer any decisions which must be made by City to the
Contract Officer. Unless otherwise specified herein, any approval of City required
hereunder shall mean the approval of the Contract Officer or the Co-Contract Officer.
4.3 Prohibition Aaainst Subcontractina or Assianment. The experience,
knowledge, capability and reputation of Consultant, its principals and employees were a

substantial inducement for the City to enter into this Agreement. Therefore, Consultant
shall not contract with any other entity to perform in whole or in part the services required
hereunder without the express written approval of the City. In addition, neither this
Agreement nor any interest herein may be assigned or transferred, voluntarily or by
operation of law, without the prior written approval of City.
4.4 Independent Contractor. Neither the City nor any of its employees
shall have any control over the manner, mode or means by which Consultant, its agents
or employees perform the services required herein, except as otherwise set forth herein.
Consultant shall perform all services required herein as an independent contractor of City
and shall remain at all times as to City a wholly independent contractor with only such
obligations as are consistent with that role. Consultant shall not at any time or in any
manner represent that it or any of its agents or employees are agents or employees of
City. Consultant shall be solely responsible for compliance with State and Federal Law
with respect to the wages, hours, benefits, and working conditions of its employees,
including requirement for payroll deductions for taxes. Employees or independent
contractors of Consultant are not City employees.
5.
INSURANCE 1 INDEMNIFICATION
5.1
Insurance.
A. Consultant shall maintain in full force and effect during the
term of these Agreement policies of commercial general liability and automobile liability
insurance (each of which shall include property damage and bodily injury) and each with
limits of at least $1 ,000,000 combined single limit coverage per occurrence.
B. Consultant shall maintain in full force and effect during the
term of this Agreement a policy of professional liability insurance coverage in the amount
of at least $1,000,000. If Consultant provides claims made professional liability
insurance, Consultant shall also agree in writing either (1) to purchase tail insurance in
the amount required by this Agreement or to cover claims made within five (5) years of
the completion of Consultant's service under this Agreement, or (2) to maintain
professional liability insurance coverage in the amount required by this Agreement for at
least five (5) years after completion of Consultant's services under this Agreement.
Consultant shall also provide evidence to the City of the purchase of the required tail
insurance or continuation of the professional liability policy by executing the attached
Letter Agreement on Consultant's letterhead.
C. Consultant shall carry and pay for such workers'
compensation insurance as is required to fully protect Consultant and its employees
under California Worker's Compensation Insurance Law. The insurance company shall
agree to waive all rights of subrogation against the City for losses paid under the policy,
which losses arose from the work performed by the named insured.
D. Other applicable insurance requirements are: (1) Name the
City, its officials and employees as an additional insured on the commercial, general and
automobile policies. (2) The insurance shall be issued by a company authorized by the
Insurance Department of the State of California and rated A, VII or better (if an admitted

carrier) or A-, X (if offered, by a surplus line broker), by the latest edition of Best's Key
Rating Guide, except that the City will accept workers' compensation insurance rated B-
VIII or better or from the State Compensation Fund. (3) The Insurance shall not be
cancelled, except after thirty (30) days written prior notice to the City; only 10 days for
non-payment of premium, and (4) The commercial general and automobile liability
insurance shall each be primary as respects the City, and any other insurance maintained
by the City shall be in excess of this insurance and not contribute to it.
E. Upon execution of this Agreement, Consultant shall provide to
City certificates of insurance and insurer endorsements evidencing the required
insurance. Insurer endorsements (or a copy of the policy binder if applicable) shall be
provided as evidence of meeting the requirements of Subsections (1 )(3) and (4) of
Section 7D above and the waiver of subrogation requirement in Section C above. If self-
insured for worker's compensation, Consultant shall submit to City a copy of its
certification of self-insurance issued by the Department of Industrial Relations.
5.2 Indemnification. The Consultant shall defend, indemnify and hold
harmless the City, its officers and employees, from and against any and all actions, suits,
proceedings, claims, demands, losses, costs, and expenses, including reasonable legal
costs and attorneys' fees, for injury to or death of person or persons, for damage to
property, including property owned by City, arising from errors and omissions of
Consultant, its officers, employees and agents, and arising out of or related to
Consultant's performance under this Agreement, except for such loss as may be caused
by City's negligence or that of its officers or employees.
The Consultant shall also indemnify and hold the City harmless from
any claims or liability for City health and welfare, retirement benefits, or any other benefits
of part-time or fulltime City employment sought by Consultant's officers, employees, or
independent contractors, whether legal action, administrative proceeding or pursuant to
State statue.
6.
RECORDS AND REPORTS
6.1 Reports. Consultant shall periodically prepare and submit to the
Contract Officer such reports concerning the performance of the services required by this
Agreement as the Contract Officer shall require.
6.2 Records. Consultant shall keep such books and records as shall be
necessary to properly perform the services required by this Agreement and enable the
Contract Officer to evaluate the performance of such services. The Contract Officer shall
have full and free access to such books and records at all reasonable times, including the
right to inspect, copy, audit and make records and transcripts from such records.
6.3 Ownership of Documents. All drawings, specifications, reports,
records, documents and other materials prepared by Consultant in the performance of
this Agreement shall be the property of City and shall be delivered to City upon request of
the Contract Officer or upon the termination of this Agreement, and Consultant shall have
no claim for further employment or additional compensation as a result of the exercise by
City of its full rights or ownership of the documents and materials hereunder. Consultant

may retain copies of such documents for its own use.

6.4 Release of Documents. All drawings, specifications, reports,
records, documents and other materials prepared by Consultant in the performance of
services under this Agreement shall not be released publicly without the prior written
approval of the Contract Officer.
7.
ENFORCEMENT OF AGREEMENT
7.1 Califomia Law. This Agreement shall be construed and interpreted
both as to validity and to performance of the parties in accordance with the laws of the
State of California. Legal actions concerning any dispute, claim or matter arising out of or
in relation to this Agreement shall be instituted in the Superior Court of the County of
Orange, State of Califomia, or any other appropriate court in such county, and Consultant
covenants and agrees to submit to the personal jurisdiction of such court in the event of
such action.
7.2 Disputes. In the event of any dispute arising under this Agreement,
the injured party shall notify the injuring party in writing of its contentions by submitting a
claim therefor. The injured party shall continue performing its obligations hereunder so
long as the injuring party cures any default within ninety (90) days after service of the
notice, or if the cure of the default is commenced within thirty (30) days after service of
said notice and is cured within a reasonable time after commencement; provided that if
the default is an immediate danger to the health, safety and general welfare, the City may
take immediate action under Section 7.6 of this Agreement. Compliance with the
provisions of this Section shall be a condition precedent to any legal action, and such
compliance shall not be a waiver of any party's right to take legal action in the event that
the dispute is not cured.
7.3 Waiver. No delay or omission in the exercise of any right or remedy
of a non-defaulting party on any default shall impair such right or remedy or be construed
as a waiver. No consent or approval of City shall be deemed to waive or render
unnecessary City's consent to or approval of any subsequent act of Consultant. Any
waiver by either party of any default must be in writing and shall not be a waiver of any
other default concerning the same or any other provision of this Agreement.
7.4 Riahts and Remedies are Cumulative. Except with respect to rights
and remedies expressly declared to be exclusive in this Agreement, the rights and
remedies of the parties are cumulative and the exercise by either party of one or more of
such rights or remedies shall not preclude the exercise by it, at the same or different
times, of any other rights or remedies for the same default or any other default by the
other party.
7.5 Leaal Action. In addition to any other rights or remedies, either party
may take legal action, in law or in equity, to cure, correct or remedy any default, to
recover damages for any default, to compel specific performance of this Agreement, to

obtain injunctive relief, a declaratory judgment or any other remedy consistent with the
purposes of thjs Agreement.
7.6 Termination Prior to Expiration of Term. The City reserves the right
to terminate this Agreement at any time, with or without cause, upon thirty (30) days
written notice to Consultant, except that where termination is due to the fault of the
Consultant and constitutes an immediate danger to health, safety and general welfare,
the period of notice shall be such shorter time as may be appropriate. Upon receipt of the
notice of termination, Consultant shall immediately cease all services hereunder except
such as may be specifically approved by the Contract Officer. Consultant shall be entitled
to compensation for all services rendered prior to receipt of the notice of termination and
for any services authorized by the Contract Officer thereafter.
7.7 Termination for Default of Consultant. If termination is due to the
failure of the Consultant to fulfill its obligations under this Agreement, City may take over
the work and prosecute the same to completion by contract or otherwise, and the
Consultant shall be liable to the extent that the total cost for completion of the services
required hereunder exceeds the compensation herein stipulated, provided that the City
shall use reasonable efforts to mitigate damages, and City may withhold any payments to
the Consultant for the purpose of set-off or partial payment of the amounts owed to City.
7.8 Attornevs Fees. If either party commences an action against the
other party arising out of or in connection with this Agreement or its subject matter, the
prevailing party shall be entitled to recover reasonable attomeys' fees and costs of suit
from the losing party.
8.
CITY OFFICERS AND EMPLOYEES; NON-DISCRIMINATION
8.1 Non-Liability of City Officers and Emplovees. No officer or employee
of City shall be personally liable to the Consultant, or any successor-in-interest, in the
event of any default or breach by the City or for any amount which may become due to
the Consultant or its successor, or for breach of any obligation of the terms of this
Agreement.
8.2 Covenant Aaainst Discrimination. Consultant covenants that, by and
for itself, its heirs, executors, assigns, and all persons claiming under or through them,
that there shall be no discrimination or segregation in the performance of or in connection
with this Agreement regarding any person or group of persons on account of race, color,
creed, religion, sex, marital status, national origin, or ancestry. Consultant shall take
affirmative action to insure that applicants and employees are treated without regard to
their race, color, creed, religion, sex, marital status, national origin, or ancestry.
9.
MISCELLANEOUS PROVISIONS
9.1 Notice. Any notice, demand, request, consent, approval, or
communication either party desires or is required to give to the other party or any other
person shall be in writing and either served personally or sent by pre-paid, first-class mail

to the address set forth below. Either party may change its address by notifying the other
party of the change of address in writing. Notice shall be deemed communicated forty-
eight (48) hours from the time of mailing if mailed as provided in this Section.

9.2 Intearated Aareement. This Agreement contains all of the
agreements of the parties and cannot be amended or modified except by written
agreement.
9.3 Amendment. This Agreement may be amended at any time by the
mutual consent of the parties by an instrument in writing.
9.4 Severabilitv. In the event that anyone or more of the phrases,
sentences, clauses, paragraphs, or sections contained in this Agreement shall be
declared invalid or unenforceable by valid judgment or decree of a court of competent
jurisdiction, such invalidity or unenforceability shall not affect any of the remaining
phrases, sentences, clauses, paragraphs, or sections of this Agreement, which shall be
interpreted to carry out the intent of the parties hereunder.
9.5 Corporate Authoritv. The persons executing this Agreement on
behalf of the parties hereto warrant that they are duly authorized to execute this
Agreement on behalf of said parties and that by so executing this Agreement the parties
hereto are formally bound to the provisions of this Agreement.

RJM Design Group, Inc. in collaboration with our Design Team is pleased to submit our
proposal for the preparation of the construction documents and bid specifications for the Citrus
Ranch Park.
The unique site area combined with its agricultural character creates an opportunity to develop a
very special and unique park facility. Our previous experience with the City of Tustin combined
with our involvement in the development of the Master Plan for this project provides both
inspiration and motivation to continue our assistance in the development of this project.
Based upon our previous experience with the Community, Council and Commission Members
and our collaboration with City Staff, we are genuinely excited about the opportunity to again
work with the City of Tustin.
We believe our team's prior experience and familiarity with this project will provide valuable
assistance and serve to facilitate timely information exchange, goal and policy assessment and a

Methodology
Scope of Work
The City of Tustin has an opportunity to provide its community with a
variety of recreational activities and outdoor events with the develop-
ment of the Citrus Ranch Park Project. The p~ervation of the citrus
grove will be a lasting landmark in the City of Tustin, which will reflect
the significance of the agricultural history in the City and Orange
County. Another unique opportunity exists in the development of the
park to create a theme of the past history, and provide interpretive dis-
plays to describe and illustrate what life was like back in that era.
Coordinaôon with Staff
RJM's Design Team, individually and collectively, has directed many in-
terdisciplinary planning and design projects. We have found that team-
work and close coordination between the client, consultants and agen-
cies is essential to a successful project. We recognize that the design

Methodology
A "QualitY Assurance Pwgnun" for the pwject
The specific scale, schedule, and complexity of each project will
require an organizational &amework, which breaks the work down
into manageable product-oriented phases. The Principal Landscape
Architect will be ultimately responsible for all work produced under
his direction. A constant review process is implemented in all phases
of the work. Our office work environment is designed for this
process; we utilize an open, studio approach to the design process.
We believe that effective communications are vitally important to
the success of every project. Team meetings will be held at regular
intervals during the early phases of the project and then on an as-
needed basis thereafter. Our offices depend on e-mail, fax, and tele-
phone communications as primary sources. Written documentation

the services of a qualified professional consulting £inn to prepare the
construction documents and bid specifications for the Citrus Ranch Park

PART I
PHASE 1.0 - PRELIMINARY DESIGN
A. Kick-off meeting with City staff to review goals and objectives of
the approved Master PIan, review scope of work, work schedule and
construction budgets.
B. Review all base infonnation previously provided by the City and
make request of any other required documents. Prepare base pIan
from aerial topographic survey at 1" = 20' scale with 1 foot contour
intervals. (Tide report / boundary survey to be provided by the
City).
C. Prepare geotechnical analysis and report.
D. Conduct field reconnaissance to ascertain overall health/vigor of
the existing citrus grove and provide overall care and maintenance
schedule.
E. Conduct Phase II Environmental Site Assessment (phase II ESA)
to evaluate the site with regard to subsurface soil impacts from the
historic use of the site as a citrus orchard. This phase includes
collection of soil samples for testing and analysis.
A follow-up Human Health Risk Assessment (HRA) would be
conducted should there be a presence of any toxic chemicals posing
a health risk with recommendations for remediation. (HRA is not a
part of this scope of work and fee schedule)
F. Prepare preliminary architectural design for restroom/maintenance
building, picnic shelter, overlook shade structure, and knoll shade
structure.

Ths phase of the project consists of the preparation of the construction
documents to include final drawings, specifications, calculations, and final
cost estimates. Our proposal includes complete landscape architectural,

required to execute the project. Construction drawings will be submitted at
50% complete for review, revised, submitted again at 90% complete for re-
view, revised, and £inally 100% complete construction drawings will be sub-
mitted for city review and approval. At each step of construction drawing
submittal, a revised cost estimate will also be submitted. Upon approval of
construction drawings, the consultant will provide the city with original re~

PHASE 5.0 - CONSTRUcnON OBSERVATION/
ADMINISTRATION
The Consultant Design Team shall attend job site meetings as requested by
the City for an anticipated 9 month construction period to generally review
and evaluate the construction schedule, monitor perfonnance, review qual-
ity control standards, and provide assistance for any clarification or revision
to the contract for construction. Shop drawings and related submittals shall
be reviewed and returned to the consultant for appropriate action. The
Contractor's requests for information, proposal requests, and related com~
munications shall be attended to on a regular basis. Assist the City in re-
view of contractor's pay requests on a monthly basis in accordance with the
amount of work completed and in accordance with the contract documents.
During the Construction Administration Phase of the project, the following
services shall be furnished:
A. Pre-construction Conference
A pre-construction conference shall be organized and conducted to
brief all parties concerned with general and special requirements of
the contract for construction. Procedural matters, routing of infor-
mation, and project representatives shall be defined. Attendees shall
include representatives from the City's staff, the Consultant, the
Contractor, and all major subcontractors.
B. Job Site Meeting
We have allowed at total of twenty-four (24) job site meetings, as
requested by the City. Scheduling, coordination, requests for infor-
mation, and changes to the contract for construction are routinely
monitored. The Consultant shall publish and distribute a field ob-
servation report, documenting the progress of construction, and
specifically noting current and delinquent action items. City to re~
cord job site meeting minutes.
C. Submittal and Sho~ Drawing Review
The Consultant shall review all required shop drawings and related
submittals as required by the contract documents.

Mr. Moore has over 25 years experience with a specialization within.the land development and
public works area. He has managed and designed numerous subdivisions, condominiums,
apartments, hospitals, commercial/industrial developments and recreational projects. He has
extensive experience in all phases of planning, map preparation and processing, grading,
horizontal controls, flood control, boundary analysis, earthwork analysis, hydrology/hydraulics,
waterlsewer and street improvements for projects throughout Southern California.
In addition to his vast development experience, Mr. Moore has managed a significant number of
large public works and municipal projects. This unique blend of a wide range of technical
expertise and privatelpublic work provides valuable experience in managing all types ofprojects.
Mr. Moore has lived and worked in the area for the past 20 years and is extremely familiar with

. Linde Recreation 'Center - Claremont: A multipurpose building with a gymnasium on the
campus of Harvey Mudd College in the city of Claremont. The project included grading,
utilities, topography, drainage and off site improvements.
. Hedgpeth Cultural Site - Phoenix, AZ - US Army Corps of Engineers: A cultural and
interpretative center including a building constructed over an existing flood control channel.
Design goals included minimization of environmental impacts to the surrounding vegetation
while creating a passive interpretive center.
. Mayfield School Recreation Center - Pasadena: A multipurpose building with a
gymnasium on the campus of Mayfield Junior School in the city of Pasadena. The project
included grading, utilities, topography, drainage and off site improvements.
. Harriet Weider Regional Park - Huntington Beach: Development of a Master Plan for
the 106-acre parking the Bolsa Chica reserve in the County of Orange. Assignment included
topography, conceptual grading, utilities, earthwork analysis and final report preparation.

I have 20 years of environmental management and consulting experience. My experience ranges
from commercial building sites to small industrial sites to large Superfund sites. I have worked
on and directed environmental investigations, assessments, remediations, risk assessments, and
wetlands delineations for private sector, municipal and military clients throughout the United
States. I have designed and implemented investigations at diverse sites such as landfills, dry
cleaning facilities, agricultural chemical manufacturers, gasoline stations, metal plating facilities,
anned services depots and bases; and managed multiple-site portfolios of over 1,250 sites.
PROJECT MANAGEMENT EXPERIENCE:
I have managed projects that have used risk assessments to evaluate the impacts to human health
or the environment of chemicals released via air borne emissions, from end-of-pipe discharges,
from spills resulting from emergency releases, and from retro-fit or demolition activities. I have
conducted risk assessments to derive appropriate cleanup goals at Superfund sites, and for
remedial actions. Presented below are a few examples ofprojects I have managed.
. Working as part of team of consultants for a municipality that obtained USEP A funding for
Brownfields redevelopment of a 56-acre oil fields site. The project requires both an EIR and
EIS. The objective of the work scope is to ensure the site is safe for the future intended use
using human health risk-based clean up goals. The site requires investigation, assessment
and possibly remediation.

. Worked as part of a team of consultants in an oversight capacity for a municipality that is
redeveloping an II-acre parcel fonnerly used in the aerospace industry. The project required
an EIR. The applicant's consultants and the municipality's consultants worked together to
ensure the final work product is acceptable to all stakeholders. The site requires remediation
prior to development.
. Working for two municipalities on several fonner industrial sites less than I-acre in size
slated for redevelopment. The objective is to investigate, assess and possibly remediate using
hwnan health risk-based clean up goals to obtain regulatory agency sign-off.
. Worked as part of a team of consultants retained by a commercial real estate developer in
Northern California. A residential development was under construction on an old Army
Airfield base when it became apparent that volatile organic compounds (VOCs), in addition
to methane, were migrating from a landfill adjacent to the planned residential development
into the development. Participated in the investigation and assessment of the soil vapor.
Assessed the risk to hwnan health of the VOCs. Participated in several homeowner's
meetings.
. Managed two proposed school sites through the California Environmental Protection Agency,
Department of Toxic Substances Control (DTSC) School Investigation Unit, Preliminary
Endangennent Assessment (PEA) Process. Worked with the school district and the
regulators to ensure the sites were appropriate for the construction of new schools.
. Managed a Brownfields Pilot Project for a municipality that obtained funding from the
USEPA. The objective was to locate environmentally-impacted sites within the
municipality's jurisdiction that are attractive for redevelopment as green space or commercial
enterprises and conduct environmental investigations, assessments and remediations such that
the sites are viable redevelopment projects.
. Worked with a team of consultants to provide environmental services for a municipality
regarding the sale and redevelopment of a IOO-acre parcel used for the manufacture of
airplanes for over 75 years. Negotiated the structure of the report to assess risk to
construction workers, onsite commercial workers, post-redevelopment, and off-site receptors
during construction activities. Involved in public meetings as part of the CEQA process.
Challenge was to negotiate the diverse interests of the parties involved and have a docwnent
that is defensible, credible, acceptable and that accurately presents the potential health risks.
Routes of exposure include fugitive dusts, air emissions, inhalation, ingestion and dennal
contact.

Conducted two brownfield redevelopment projects in downtown Los Angeles. Both projects
involved demolition of existing structures, excavation of footings, foundations and impacted
soils and obtaining risk-based closure from California Environmental Protection Agency
Department of Toxic Substance Control (DTSC). The sites were enrolled in DTSC's
voluntary cleanup program and risk-based closure was obtained by following the preliminary

endangennent assessment guidelines. The chemicals of concern included metals in soils to a
depth of 25 feet below ground surface.
. Managed a project that used risk assessment techniques to obtain risk-based closure for a
fonner pesticide manufacturing facility in Orange County. Remediation was conducted to
remove soil containing elevated concentrations of contaminants. Resultant risk assessment
conducted in accordance with DTSC's voluntary cleanup program indicated cleanup was
complete and the site no longer posed an unacceptable risk to hwnan health. Future intended
use of the property is a retirement community.

Managed several projects that used DTSC's preliminary endangennent assessment guidance
in accordance with DTSC's voluntary cleanup program to obtain risk-based closure for
fonner dry cleaning sites in Los Angeles County and Orange County.
. Managed a project that used a statistical risk assessment to derive exposure concentrations
and ultimate impacts to hwnans through the inhalation exposure route for an airborne release
fröm a refinery in Northern California. The chemicals of concern included a known hwnan
carcinogen, the frequency of exposure was very low (the release was acute) and the release
although widespread was diffuse, as the wind direction was variable throughout the release.

Risks of exposure to total petrolewn hydrocarbons, benzene, toluene, ethylbenzene, total
xylenes, polycyclic aromatic hydrocarbons, chlorinated volatile organic compounds and
metals for hwnan receptors and groundwater quality were evaluated in accordance with
DTSC and USEP A guidelines at a state Superfund site in Southern California. Chemical fate
and transport models were used to predict the migration of the chemicals in soil to
groundwater and to air. Health risks for industrial use of the site were detennined to be
below acceptable levels.

Reviewed and provided comments on the risk assessments prepared for the Palos Verdes
Shelf Superfund project. The chemicals of concern included DDT and metals. The impacted
mediwn is sediments and the impacted receptors are fish, invertebrates and shellfish.

Managed the project that used ecological risk assessment techniques at Naval Air Station
(NAS) Moffett Field. The risk assessment included a site-wide ecological assessment of the
air station. The assessment endpoints included protection of surface water and wetland
habitats and protection of individual special status species. The chemicals of potential
concern included organochlorine pesticides, heavy metals, petrolewn products and
polynuclear aromatic hydrocarbons.

Prepared the work plan for the ecological risk assessment at Defense Depot Region West
(DDRW) Tracy on behalf of the Anny Corps of Engineers. The risk assessment followed a
phased approach that allowed the risk assessor to evaluate whether next steps are required
during implementation of the risk assessment process.

The chemicals of concern were heavy metals, the ecological receptors were birds of prey,
and the assessment endpoint was to evaluate the potential chemical effects emanating from
the refmery on the terrestrial ecosystem.
. Perfonned an ecological risk assessment at a fonner pesticide fonnulation facility in Georgia.
The Superfund site was active in the 1950s through the 1970s and was a fonnulation facility
of organochlorine pesticides (including DDT), organophosphate pesticides, and chlorinated
herbicides in addition to handling solvents (including toxaphene). The effects of the
chemicals of concern on two distinct terrestrial habitats on-site were evaluated.

communication skills and project management skills to clients requiring litigation support

grew in her ceiling as a result of plumbing leaks and this mold caused health effects in her
teenage son.

. Provided expertise for the defendant in Carson, California. The defendant released a
scrubbing mixture from their stacks for three days. Sensitive populations potentially
impacted by the air emission release included schools, nursing homes and hospitals.
Community meetings were held to communicate the risks of the release to the residents and

. Provided expertise for a case in Alameda, California. Defendant was a fonner site owner.
Plaintiff was seeking damages from defendant associated with defendant's past disposal
practices of paint sludges. Plaintiff alleged that past practices by defendant caused
diminution in property value and environmental liability. Evaluated toxicological risk to
workers health and safety, and toxicological risk to terrestrial and aquatic organisms.
. Provided expertise for plaintiff in Northridge, California. Plaintiff was on-site during
maintenance of the pump and treat remediation system installed by the defendant's
contractors to cleanup groundwater contaminated by the defendant. Plaintiff was exposed to
volatile organic compounds (VOCs) from the unsecured wellhead. Plaintiff was not briefed
by defendant prior to entering the site that potential exposure to VOCs may occur. Although
the risk to the plaintiffs health was negligible due to exposure to VOCs from the unsecured
wellhead, proper protocol regarding dissemination of toxic infonnation and the health and
safety plan was not followed by the defendant.
. Perfonned a health risk assessment for a residential homeowner with an autoimmune disorder
in Mission Viejo, California. Fonner property owner had applied chlordane to the property
as a fonn of ant control mitigation. Current homeowner was concerned that residual
concentrations of chlordane may be contributing to the autoimmune disorder she suffered and
may place others in contact with the soil, such as, gardeners, visitor's children, and pets, at
risk.
. Provided expert services for the municipality (the plaintiff) in a case involving an assessment
of the effects of stonnwater runoff carrying waste from dairy fann waste storage lagoons into
Lake Elsinore, California. Evaluated the laboratory analytical methodology, the sampling
strategy used to collect the data and the data results. Specifically examined the data collected
by the municipality from Lake Elsinore for trends reflecting nutrient-loading in excess of the
carrying capacity of the lake.

SCOPE OF THE CONSULTANT 1 ENGINEER SERVICES AGREEMENT
The City requires the services of Consultant, Engineer and Civil Engineer services to
furnish the necessary construction documents and construction management services for
Citrus Ranch Park. The selected firm will be requested to enter into a consultant services
agreement.
The scope of services shall include participation at plan check meetings, generation and
verification of support information, documentation and reports, and all tasks necessary
for the preparation and acquisition of any environmental permits necessary for the
project. It shall also include tasks necessary for the preparation of plans and
specifications and architectural and engineering construction oversight.

approval and records.
The City will require final reproducible plans to be produced on a Mylar base with the
City Title Block. The City will require the preliminary design drawings and final
contract drawings be prepared on a CAD system compatible with the City's software.
Drawings will be submitted to the City for review in electronic disk form as well as hard
copy form.
The final specifications must be prepared and submitted to the City in electronic disk
form which is compatible with the City's word processing software as well as hard copy

Billings for all time and materials and contract extension work shall be in accordance with the
level of work performed and will be broken into the categories listed above.
Fees will be escalated each August 1st in accordance with any increase in the Consumer's Price
Index or other mutually agreed upon cost index, beginning with August 1, 2005
All provisions for fee escalation pertain to all contract extensions and additional work.
