WEST, ACTING CITY MANAGER SUBJECT: PROPOSED ORDINANCE AND RESOLUTIONS AMENDING THE CITY'S PREFERENTIAL PERMIT PARKING PROGRAM TO PROVIDE EACH ELIGIBLE RESIDENCE REQUESTING A PERMIT AT LEAST ONE PARKING PERMIT. SUMMARY: At its January 15, 2019 meeting the City Council directed City staff to prepare proposed revisions to the City's permit parking program to allow one permit, per residence, without inspection, for the Council's consideration, and to coordinate a workshop regarding City-wide parking issues. The workshop will occur at a future meeting. This item would ensure that eligible residences would receive at least one parking permit. The proposed amendments to the City's Preferential Permit Parking Program would assure each eligible residence in existing and future permit parking areas (both inside and outside of Old Town) one (1) parking permit upon request, whether or not that residence makes full utilization of its off-street parking. RECOMMENDATION: Staff recommends that the City Council: (1) Conduct first reading by title only of Ordinance No. 1500 amending Tustin City Code section 5331(n) and adding new Tustin City Code section 5331(o); and (2) Approve Resolution No. 19-09 amending the Policies and Procedures for Preferential Permit Parking on Public Streets Within the Old Town Residential Area; and (3) Approve Resolution No. 19-10 amending the Policies and Procedures for Preferential Permit Parking on Public Streets Outside the Old Town Residential Area. 134065 8.2 AGENDA REPORT: PERMIT PARKING PROGRAM AMENDMENTS February 19, 2019 Page 2 FISCAL IMPACT: Fiscal impacts associated with the proposed amendments to the Preferential Permit Parking Program and the issuance of additional parking permits and related enforcement costs will be partially offset by the existing permit fee of fifty dollars ($50) per year for permits issued in the Old Town Area. Consideration whether to increase that fee and expand it to areas outside Old Town will be an issue for consideration at the workshop later this year. STRATEGIC PLAN: Approval of the proposed amendments to the Preferential Permit Parking Program will advance Strategic Plan Goal B, Public Safety and Protection of Assets: "Ensure Tustin is an attractive, safe and well-maintained community in which people feel pride." BACKGROUND AND DISCUSSION: Currently, to obtain a permit to park on designated permit parking streets, eligible Tustin residents must demonstrate that they are fully utilizing their off-street parking, including full use of their garage/carport and driveway space. Tustin City Code section 5331(n) lists the designated public streets within the City that require a special parking permit. Section 5331(n) also references a separate policy and procedure that addresses permit parking on designated public streets in Old Town Residential Areas. The proposed amendment to Tustin City Code section 5331(n) and the proposed addition of Tustin City Code section 5331(o) would, if adopted, remove unnecessary and outdated language, and would update the reference to Policies and Procedures for the Preferential Permit Parking Program. The proposed Resolutions 19-09 and 19-10 would, if adopted, approve two sets of updated Policies and Procedures for Preferential Permit Parking on public streets: Resolution 19-09 approves the policies and procedures that apply within Old Town; and Resolution 19-10 approves the policies and procedures that apply outside of Old Town. Finally, the proposed amendments to both sets of Policies and Procedures would ensure that each eligible residence in each existing permit parking area would, upon request, receive one (1) parking permit regardless of that residence's utilization of off-street parking. Permits would be made available on the same basis that permits are currently available, except that full utilization of off-street parking would not be required in order to obtain the first permit for that residence. Redline version of Policies and Procedures for Preferential Permit Parking on Public Streets Outside the Old Town Residential Area, showing proposed revisions to the current policy 1340658.2 ATTACHMENT A ORDINANCE NO. 1500 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING TUSTIN CITY CODE SECTION 5331 (STOPPING, STANDING OR PARKING RESTRICTED OR PROHIBITED ON CERTAIN STREETS), SUBSECTION "N" (PARKING BY PERMIT ONLY); AND ADDING A NEW SUBSECTION "O" TO SECTION 5331 OF THE TUSTIN CITY CODE REGARDING THE CITY'S PERMIT PARKING PROGRAM. THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, HEREBY FINDS AND DETERMINES AS FOLLOWS: WHEREAS, Section 22507(a) of the State of California Vehicle Code grants cities the authority to establish preferential parking on designated streets or portions thereof, during all or certain times of the day, upon approval by the City Council of an ordinance or resolution containing provisions that are reasonable and necessary to assure the effectiveness of a preferential parking program; and WHEREAS, Section 5331(n) of the Tustin City Code currently designates public streets within the City that require a special parking permit to park vehicles between the hours of 2:00 a.m. and 6:00 a.m., seven (7) days a week; and WHEREAS, an amendment to Tustin City Code section 5331(n) will remove unnecessary language that refers to an outdated City Council Resolution; and WHEREAS, the adoption of Tustin City Code section 5331(o) will refer readers to newly amended Policies and Procedures for Preferential Permit Parking on public streets both within and outside the Old Town Residential Areas; and WHEREAS, the proposed code amendment and adoption are reasonably necessary to protect the health, safety, and welfare of the citizens of the City. THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Recitals. The above recitals are true and correct, and are incorporated herein by reference. SECTION 2. Section 5331, subsection "n(15)" of the Tustin City Code is hereby amended to read in its entirety as follows: 1384734.1 Ordinance No. 1500 Page 2 "(15) A Street, Myrtle Avenue, and Pasadena Avenue between First Street and Main Street; west side of B Street between First Street and its terminus at Interstate 5; east side of B Street and west side of C Street from Sixth Street to 300 feet north of Sixth Street; California Street; Main Street from State Route 55 to B Street; Pacific Street between First Street and Sixth Street; Second Street between Pasadena Avenue and Myrtle Avenue and between Pacific Street and B Street; Third Street between Myrtle Avenue and B Street; north side of Sixth Street between C Street and its terminus at Interstate 5; and south side of Sixth Street between B Street and 670 feet west of B Street." SECTION 3. Section 5331 is hereby amended to add a new subsection "o" to read as follows: "o Policies and Procedures for Parking by Permit Only" "(1) The Policies and Procedures for Preferential Permit Parking on Public Streets Within the Old Town Residential Area, as those streets are designated in subsection n(15), are set forth in City Council Resolution No. 19-09, as the same may be amended from time to time." "(2) The Policies and Procedures for Preferential Permit Parking on Public Streets Outside the Old Town Residential Area, as those streets are designated in subsections n(1) through n(14) and n(16), shall be set forth in City Council Resolution No. 19-10, as the same may be amended from time to time." SECTION 4. CEQA. Public Resources Code § 21065 defines "project" as "an activity which may cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment." The proposed Ordinance does not have the potential to result in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, as the Ordinance does not call for any change in the existing environmental conditions within the City. The proposed Ordinance merely revises existing law granting eligible residents special parking permits and does not authorize new programs or activities. Accordingly, the Ordinance is not a "project" subject to CEQA. (Public Resources Code § 21065; CEQA Guidelines § 15378(a).) 1384734.1 Ordinance No. 1500 Page 3 Even if the Ordinance could be construed to be a project subject to CEQA, the proposed Ordinance is exempt. CEQA's Class 1 Exemption applies to the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use at the time of the lead agency's CEQA determination. (CEQA Guidelines, § 15301.) Because the proposed Ordinance merely revises existing law granting eligible residents special parking permits and does not authorize new programs or activities, the proposed Ordinance calls for the continued operation of existing public or private facilities involving no expansion of the existing uses. As a result, the proposed Ordinance is exempt from CEQA pursuant to the Class 1 exemption. SECTION 5. This Ordinance shall take effect the 31 st day following the adoption of this Ordinance by the City Council. Upon the effective date of this Ordinance, the provisions hereof shall supersede any inconsistent or conflicting provisions of the Tustin City Code. SECTION 6. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more section, subsection, subdivision, sentence, clause, phrase, or portion thereof be declared invalid or unconstitutional. Yasuda, City Clerk 1384734.1 ATTACHMENT B RESOLUTION NO. 19-09 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING AMENDED POLICIES AND PROCEDURES FOR PREFERENTIAL PERMIT PARKING ON PUBLIC STREETS WITHIN THE OLD TOWN RESIDENTIAL AREA The City Council of the City of Tustin finds: WHEREAS, Section 22507(a) of the State of California Vehicle Code grants cities the authority to establish preferential parking on designated streets or portions thereof, during all or certain times of the day, upon approval by the City Council of an ordinance or resolution containing provisions that are reasonable and necessary to assure the effectiveness of a preferential parking program; and WHEREAS, the City of Tustin maintains a Preferential Permit Parking Program for public streets within the Old Town residential area, as set forth in Tustin City Code section 5331(n); and WHEREAS, the City of Tustin also maintains Policies and Procedures for Preferential Permit Parking on Public Streets Within the Old Town Residential Area that provide for the criteria, evaluation, administration, and fees of permit parking as applicable to those public streets. These policies and procedures are intended to mitigate parking intrusions that may impact the quality of life and affect the public safety in the Old Town residential area; and WHEREAS, the existing Policies and Procedures for Preferential Permit Parking on Public Streets Within the Old Town Residential Area require residents to demonstrate that they are fully utilizing their off-street parking, including full use of their garage, carport, and driveway space, before obtaining one or more parking permits; and WHEREAS, the City Council of the City of Tustin desires to amend the Policies and Procedures for Preferential Permit Parking on Public Streets Within the Old Town Residential Area to ensure each eligible residence in the existing parking area receives, upon request and payment of the required fee, one (1) parking permit whether or not that residence makes full utilization of its off-street parking; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that: 1. YASUDA City Clerk Resolution No. 19-09 Page 2 of 2 1384735.1 TUST I N BUILDING OUR FUTURE HONORING OUR PAST EXHIBIT 1 CITY OF TUSTIN POLICY AND PROCEDURES FOR PREFERENTIAL PERMIT PARKING ON PUBLIC STREETS WITHIN THE OLD TOWN RESIDENTIAL AREA Adopted by City Council Resolution No. 19-09 on February 19, 2019 The following Policy and Procedures provide for the criteria, evaluation, administration, fees and implementation of Permit Parking as applicable to public streets within the Old Town residential area. This policy is intended to mitigate parking intrusions (spillover parking) that may impact the quality of life and affect the public safety in the Old Town residential area. Eligibility All residential uses, including single and multiple family uses, along the residential streets within the zone depicted on the attached map shall be eligible for Permit Parking in the Old Town residential area. Criteria Each household in the permit parking area who wishes to park on public streets within the designated restricted area will be required to obtain a permit to do so pursuant to the criteria outlined below: All authorized Preferential Permit Parking areas will prohibit overnight on -street parking without a City -issued permit from the hours of 2:00 a.m. to 6:00 a.m., seven (7) days a week. 2. All residents in a Preferential Permit Parking Area will be subject, without exception, to all related parking regulations. 3. Upon request to the Police Department and payment of the then -applicable fee, each eligible household shall receive one (1) parking permit regardless of that residence's utilization of off-street parking. Any additional parking permits requested after the first parking permit will only be issued upon verification of full utilization of off-street parking, including full use of garage, carport, and driveway space, and the need for more than one permit, and payment of the then -applicable fee. 4. Parking Permits shall be obtained in person at the Police Department. The applicant must provide proof of residency, vehicle license and registration, complete and sign a Permit Parking Application, and, when required by Section 3 above, certify that off-street parking is fully utilized. This document will be the 1384740.1 Page 1 of 3 permanent record of the respective household's Program participation, acknowledgement and receipt of the Permit Parking Program's procedures and requirements. 5. Approved permits are issued annually, must be renewed annually, and are not transferable. 6. A maximum of 75 daily guest permits per residence may, at the discretion of the Police Department, be issued every six (6) months. 7. All Parking Permits remain the property of the City and may be revoked if used contrary to the provisions of this policy. Bail Schedule The fine for violation of the Permit Parking regulations shall be as the City Council may set from time to time. Misuse of Parking Permits Any person selling, fraudulently using, reproducing or mutilating a Parking Permit issued in conjunction with the Parking Permit Program shall be guilty of an infraction and shall be subject to a fine as the City Council may set from time to time and the forfeiture of all Parking Permits, or such other penalty as the City Council may, from time to time, set by ordinance. Program Removal 1 A Permit Parking Area or part thereof may be removed from the Permit Parking Program by the City Council pursuant to a determination that removal from the Program is in the community interest or in the interest of public safety or at City Council discretion. 2. There shall be no cost to the residents associated with removing an area from the Permit Parking Program. 3. If an existing Permit Parking Area is revoked, any request for reinstatement shall be 1subject to the same process as that of a new Parking Permit Area. Exceptions & Exemptions To accommodate particular events or circumstances, the Police Department may, at the discretion of the Police Chief, temporarily suspend enforcement of the Permit Parking regulations. 1384740.1 Page 2 of 3 Fee The fee for preferential Permit Parking regulations shall be as the City Council may set from time to time. Currently, resident permits are issued at a cost of $50 per permit per calendar year. These policies and procedures are intended to mitigate parking intrusions that may impact the quality of life and affect the public safety outside the Old Town residential area; and WHEREAS, the Policies and Procedures for Preferential Permit Parking on Public Streets Outside the Old Town Residential Area require residents to demonstrate that they are fully utilizing their off-street parking, including full use of their garage, carport, and driveway space, before obtaining a parking permit; and WHEREAS, the City of Tustin seeks to amend the Policies and Procedures for Preferential Permit Parking on Public Streets Outside the Old Town Residential Area to guarantee each eligible resident in the existing parking area one (1) parking permit regardless of that residence's utilization of off-street parking; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that: 1. The amended Policies and Procedures for Preferential Permit Parking on Public Streets Outside the Old Town Residential Area attached hereto as Exhibit 1 are hereby approved; and 2. This Resolution shall take effect on the date that Ordinance1500 takes effect. YASUDA City Clerk Resolution No. 19-10 Page 2 of 2 1384736.1 TUSTIN BUILDING OUR FUTURF HONORING OUR PAST EXHIBIT 1 CITY OF TUSTIN POLICY AND PROCEDURES PREFERENTIAL PERMIT PARKING ON PUBLIC STREETS OUTSIDE THE OLD TOWN RESIDENTIAL AREA Adopted by City Council Resolution No. 19-10 on February 19, 2019 The Tustin City Council adopts the following Policy and Procedures for the criteria, application, evaluation, administration, fees and implementation of Permit Parking as applicable to public streets within the City. This policy is intended to mitigate parking intrusions (spillover parking) that may impact the quality of life and affect the public safety in single family detached neighborhoods. Criteria 1. Only residential streets in single family detached neighborhoods shall be eligible for Permit Parking. 2. Permit Parking, if approved, shall be limited to a designated area, not less than one block. 3. Permit Parking in an area will be considered by the City Council given: A. Any one household within a potential Permit Parking Area makes an application to the Public Works Department for the establishment thereof. B. A parking analysis/evaluation is completed by the Public Works Department. 4. The City Council may, at its sole discretion, review and approve or deny any application for Permit Parking in the interest of community benefit or public safety. Application 1. An application for Permit Parking shall contain a description of the problem, the time the problem is occurring, the general area affected by the parking intrusion, and the applicant's name, home address and telephone number(s). 2. The City Engineer shall determine the exact limits of the general area. 3. The applicant or designee shall be the contact person for the City staff. Permit Process 1. The City Engineer shall prepare an agenda report to be considered by the City Council. 13 84738.1 A. The report shall state the facts pursuant to the request for permit parking consideration. The applicant shall be provided a copy of the staff report. 2. If a permit parking area is approved by the City Council, each household in the permit parking area who wishes to park within the designated restricted area will be required to obtain a permit to do so pursuant to the permit issuance outline below. 3. If the request for Permit Parking is denied, a second analysis of the same or similar general area will not be conducted for a minimum of twelve months unless there is a significant, identifiable change in parking characteristics as determined by the City Engineer. Subsequent analysis of the same general area will be subject to the same requirements and procedures as the initial request. Permit Issuance 1. All authorized Preferential Permit Parking will prohibit overnight parking between the hours of 2:00 a.m. to 6:00 a.m., seven (7) days a week, unless approved otherwise by City Council. 2. All residents in a preferential Permit Parking Area will be subject, without exception, to all related parking regulations. 3. Upon request to the Police Department and payment of the then -applicable fee, each eligible household shall receive one (1) parking permit regardless of that residence's utilization of off-street parking. Any additional parking permits requested after the first parking permit will only be issued upon verification of full utilization of off-street parking including full use of garage, carport, and driveway space, and the need for more than one permit, and payment of the then -applicable fee. 4. Currently, permits are issued at no fee. 1384738.1 TUSTIN BUILDING OUR FUTURE HONORING OUR PAST ATTACHMENT D CITY OF TUSTIN POLICY AND PROCEDURES FOR PREFERENTIAL PERMIT PARKING ON PUBLIC STREETS WITHIN THE OLD TOWN RESIDENTIAL AREA Adopted by City Council Resolution No. 19-09 on February 19, 2019 The following Policy and Procedures provide for the criteria, evaluation, administration, fees and implementation of Permit Parking as applicable to public streets within the Old Town residential area. This policy is intended to mitigate parking intrusions (spillover parking) that may impact the quality of life and affect the public safety in the Old Town residential area. Eligibility All residential uses, including single and multiple family uses, along the residential streets within the zone depicted on the attached map shall be eligible for Permit Parking in the Old Town residential area. Criteria Each household in the permit parking area who wishes to park on public streets within the designated restricted area will be required to obtain a permit to do so pursuant to the criteria outlined below: 1. All authorized Preferential Permit Parking areas will prohibit overnight on -street parking without a City -issued permit from the hours of 2:00 a.m. to 6:00 a.m., seven (7) days a week. 2. All residents in a Preferential Permit Parking Area will be subject, without exception, to all related parking regulations. 3. Upon request to the Police Department and payment of the then -applicable fee, each eligible household shall receive one (1) parking permit regardless of that residence's utilization of off-street parking. Any additional parking permits requested after the first parking permit will only be issued upon verification of full utilization of off-street parking, including full use of garage, carport, and driveway space, and the need for more than one permit, and payment of the then -applicable fee. 4. Parking Permits shall be obtained in person at the Police Department. The applicant must provide proof of residency, vehicle license and registration, complete and sign a Permit Parking Application, and, when required by Section 3 above, certify that off-street parking is fully utilized. Approved permits are issued annually, must be renewed annually, and are not transferable. 6. A maximum of 75 daily guest permits per residence may, at the discretion of the Police Department, be issued every six (6) months. 7. All Parking Permits remain the property of the City and may be revoked if used contrary to the provisions of this policy. Bail Schedule The fine for violation of the Permit Parking regulations shall be as the City Council may set from time to time. Misuse of Parking Permits Any person selling, fraudulently using, reproducing or mutilating a Parking Permit issued in conjunction with the Parking Permit Program shall be guilty of an infraction and shall be subject to a fine as the City Council may set from time to time and the forfeiture of all Parking Permits, or such other penalty as the City Council may, from time to time, set by ordinance. Program Removal 1. A Permit Parking Area or part thereof may be removed from the Permit Parking Program by the City Council pursuant to a determination that removal from the Program is in the community interest or in the interest of public safety or at City Council discretion. 2. There shall be no cost to the residents associated with removing an area from the Permit Parking Program. 3. If an existing Permit Parking Area is revoked, any request for reinstatement shall be subject to the same process as that of a new Parking Permit Area. Exceptions & Exemptions To accommodate particular events or circumstances, the Police Department may, at the discretion of the Police Chief, temporarily suspend enforcement of the Permit Parking regulations. 1384740.1 Page 2 of 3 Fee ATTACHMENT D The fee for preferential Permit Parking regulations shall be as the City Council may set from time to time. There is no fee for guest permits. 1384740.1 Page 3 of 3 TUSTIN BUILDING OUR FUTURE HONORING OUR PAST ATTACHMENT E CITY OF TUSTIN POLICY AND PROCEDURES PREFERENTIAL PERMIT PARKING ON PUBLIC STREETS OUTSIDE THE OLD TOWN RESIDENTIAL AREA Adopted by City Council Resolution No. 19-10 on February 19, 2019 The Tustin City Council may adopts the following Policy and Procedures for the criteria, application, evaluation, administration, fees and implementation of Permit Parking as applicable to public streets within the City. This policy is intended to mitigate parking intrusions (spillover parking) that may impact the quality of life and affect the public safety in single family detached neighborhoods. Criteria 1. Only residential streets in single family detached neighborhoods shall be eligible for Permit Parking. 2. Permit Parking, if approved, shall be limited to a designated area, not less than one block. 3. Permit Parking in an area will be considered by the City Council given: A. Any one household within a potential Permit Parking Area makes an application to the Public Works Department for the establishment thereof. B. A parking analysis/evaluation is completed by the Public Works Department. 4. The City Council may, at its sole discretion, review and approve or deny any application for Permit Parking in the interest of community benefit or public safety. Application 1. An application for Permit Parking shall contain a description of the problem, the time the problem is occurring, the general area affected by the parking intrusion, and the applicant's name, home address and telephone number(s). 2. The City Engineer shall determine the exact limits of the general area. 3. The applicant or designee shall be the contact person for the City staff. Permit Process 1. The City Engineer shall prepare an agenda report to be considered by the City Council. 1384738.1 Page 1 of 3 ATTACHMENT E A. The report shall state the facts pursuant to the request for permit parking consideration. The applicant shall be provided a copy of the staff report. 2. If a permit parking area is approved by the City Council, each household in the permit parking area who wishes to park within the designated restricted area will be required to obtain a permit to do so pursuant to the permit issuance outline below. 3. If the request for Permit Parking is denied, a second analysis of the same or similar general area will not be conducted for a minimum of twelve months unless there is a significant, identifiable change in parking characteristics as determined by the City Engineer. Subsequent analysis of the same general area will be subject to the same requirements and procedures as the initial request. Permit Issuance 1.
