ACCESSORY DWELLING UNITS

BACKGROUND
State adopted second unit legislation in 2002.
Ordinance 1271 allowed new second residential
units on single family lots at least 12,000 square
feet in size, citywide.
Outright permitted use in the E4, R1, R2, and R3
Zoning Districts.
BACKGROUND
Many property owners expressed desire to have
and rent second residential units in Old Town.
Properties smaller than 12,000 square feet were
not eligible for second residential units.
Workshops and public hearings were held, and an
Ordinance was adopted to allow 2nd residential
units up to 600 s.f.on all lot sizes in Old Town.
PROPOSED CODE AMENDMENT
Continue to allow new accessory dwelling units of
up to 600 sq. ft. on any residentially zoned lot in
the CR District regardless of lot size.
Allow new accessory dwelling units on lots of at
least 10,000 square feet in other residential areas.
Allow new accessory dwelling units within existing
floor area of homes and existing floor area of
accessory buildings in all single family zones.
PARKING
Maximum of one parking space shall be required
per accessory dwelling unit or per bedroom .
Parking space may be covered or uncovered and
may be a tandem space.
No parking required for ADUs within existing
dwellings and existing accessory buildings.
PARKING EXCEPTIONS
Accessory dwelling units that are located within…
Existing dwellings and existing accessory buildings;
Significant historic district;
½ mile of public transit; or,
One block of a car share vehicle
…Are exempt from parking requirements.
Parking spaces will not be required for many
accessory dwelling units.
PLANNING COMMISSION ACTION
On February 28, 2017, the Planning Commission
adopted Resolution No. 4337, recommending that the
Tustin City Council adopt Ordinance No. 1479,
approving Code Amendment 2017 -002.
RECOMMENDATION
That the City Council introduce and have first reading
of Ordinance No. 1479, approving Code Amendment
(CA) 2017-002, and set a second reading for the
next City Council meeting.
