Staff was notified that a private residence block
wall at 14412 Raintree Road was leaning and
threatening to fall onto the adjacent sidewalk.

The City’s Building Official inspected the wall
and determined it to be an imminent life-safety
concern and public nuisance in violation of
several Tustin City Codes.
Several Notices of Violation and subsequently
$2,630 in Administrative Citations were sent to
the property owner requesting
removal/replacement or repair of the wall.
The property owner refused to address the
matter.
The City Attorney attempted to obtain the property
owner’s cooperation for over four (4) months.
The City Attorney subsequently obtained a court
order allowing the City to enter the property and
replace the wall to abate the hazard.
Cost Recovery: 14412 Raintree Road
Pursuant to TCC Sections 1122(c) and 5508, the
City is entitled to recover its costs incurred to abate
the public nuisance.
The City Attorney and the Finance Department
have been unsuccessful in their requests that the
owner reimburse the City.
City staff worked through the Franchise Tax Board
to successfully recover all Code Enforcement
citation fines and penalties ($2,630.00).
TCC Section 5508 et al. authorizes the City Council
to apply a special assessment against the property
to recover the current balance of $22,555.17 in
unpaid City costs related to this matter.

RECOMMENDATION:
City Council adopt Resolution No. 18 -05:
○Approving confirming, and adopting the Report of
the total costs of the City’s nuisance abatement;
and,
○Authorizing the placement of a special assessment
on the subject property to be filed with the Orange
County Auditor and the Orange County Recorder for
recordation in order to recover those costs.
