HomeMy WebLinkAboutCC RES 98-40~ RESOLUTION NO. 98-40 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING 4 VESTING TENTATIVE TRACT MAP NO. 15601 LOCATED AT THE NORTHERLY TERMINUS OF TOWNSHIP DRIVE (LOT 26 AND A PORTION OF LOTS 13 AND 24 s OF TRACT 13627). The City Council of the City of Tustin does hereby resolve as follows: ? !. The City Council finds and determines as follows: 8 9 A. That Vesting Tentative Tract Map No. 15601 was submitted to the Planning Commission and City Council by Warmington Homes California for ]0 consideration; B. That a public hearing was duly called, noticed and held for said map on April 12 13, 1998 by the Planning Commission and May 4, 1998 by the City Council; C. That Environmental Impact Report 85-2, as modified' by supplements and addenda, for the East Tustin Specific Plan, has been certified in conformance with the requirements of the California Environmental Quality Act for the subject project; D. That' the proposed subdivision is in conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, Development Agreement. as amended and Subdivision Map Act as it pertains to the development of single-family dwellings; 20 E. The 0.5544 acres of parkland required for this development was previously 2~ dedicated with recordation of Tract 13627; 22 F. That the City has reviewed the status of the School Facilities Agreement 23 between the !rvine Company and the Tustin Unified School District, for the impact of Vesting Tentative Tract 15601 on School Distdct facilities, and 24 changes in state law. The impacts associated with this approval on School 25 District Facilities are adequately addressed; 26 G. That the site is physically suitable for the type of development proposed; 27 :8 H. That the site is physically suitable for the proposed density of development; 29 Resolution No. 98-4.0 Page 2 3 4 I.. That the design of-the subdivision or the proposed improvements are not 5 likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat; 6 ?' J. That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public, for access through or use -of the property within the proposed subdivision;. K. That the design of the subdivision or the types of improvements proposed ]0 are not likely to cause serious public health problems; ~2 L. The proposed project has been reviewed for conformity with the provisions of the Orange County Congestion Management Program, and it has been ~3 determined that the additional traffic generated by the proposed project onto the CMP Highway System does not cause the system to exceed established 14 level of service standards; and, ]5 M: The proposed project has been reviewed for conformity with the provisions ]6 of Measure M/Growth Management Program, and it has 'been determined ~7 that the estimated project generated traffic does not cause the roadway system to exceed established level of service standards. 29 N. That the project has been reviewed for consistency with the Air Quality Sub- Element of the City of Tustin General plan and has been determined, or 20 conditioned, to be consistent with the Air Quality Sub-Element. II. The City Council hereby approves Vesting Tentative Tract Map No. 15601 located 22 at the northerly terminus of Township Drive (Lot 26 and a portion of Lots 13 and 24 23 of Tract 13627), subject to the conditions contained in Planning Commission Resolution No. 3587, incorporated herein by reference. 24 25 26 27 28 29 ~ Resolution No. 9840 · Page 3 2 3 4.
