FIREARMS INVENTORY REDUCTION
SUMMARY
Two senior lieutenants of the Police Department are retiring and have asked to retain
their duty-issued firearms as part of their retirement. The Tustin Police Officers
Association (TPOA) desires to purchase the firearms from the City to present as gifts to
the retiring employees, as has been past practice.
RECOMMENDATION
Authorize the sale of two used duty firearms to the two retiring lieutenants of the Police
Department per Department of Justice guidelines with proceeds deposited into the
General Fund. Payment to be made on behalf of the retirees by TPOA.
FISCAL IMPACT
Estimated revenue from sale of firearms to retiring sworn personnel--$420.00.
BACKGROUND
The Tustin Police Department issues the Beretta Model 92FS 9mm semi-automatic
pistol to its sworn personnel as their duty weapon. Two long-term employees are
scheduled to retire from the Police Department in January and February 2005. The
employees have over 60 years of combined law-enforcement experience and have
served the City of Tustin in an exemplary manner. They are concluding their careers as
lieutenants and have requested to retain the duty weapons they have had issued to
them for the past twelve years when they leave.
As has been past practice with many retiring officers, the Tustin Police Officers
Association has purchased the retiring employee's firearm from the City of Tustin and
given it to the individual as a retirement gift. TPOA would like to continue this practice
for both individuals currently scheduled to retire. The transfer of ownership for the

firearms would be completed through a licensed firearms dealer per Department of
Justice guidelines as was recently done with the sale of surplus firearms approved by
Council in September of this year.
Based on the age (over 12 years) and condition (fair) of the two firearms, plus input
from a licensed dealer, a value of $210.00 per pistol has been established. TPOA
would pay for the firearms and transfer fees on behalf of the retirees with the funds for
the purchase being deposited into the General Fund of the City of Tustin. A sample "Bill
of Sale" is attached. Based on the Police Department's current inventory of firearms,
the sale of the two pistols in question will not impact the operation of the agency in any
manner.

Buyer acknowledges that the sale and transfer of the above described
goods shall be conducted through a licensed firearms dealer pursuant to
the provisions of California Penal Code &12072(d)(1) and &12082.

Buyer agrees that NO SALE OR TRANSFER to a third party of the above
described goods shall occur. Buyer further agrees to turn the above
goods over to a law enforcement agency for destruction if buyer no longer
desires to retain the goods. Buyer agrees to defend, hold harmless, and
indemnify City of Tustin, its officers, employees and agents, as to any and
all claims, judgments, liabilities or damages of any nature arising, directly
or indirectly, out of Buyer's sale or transfer of the goods purchased
hereunder to a third party in violation of this provision.
