A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
4 FINDING THAT THE FINAL ENVIRONMENTAL IMPACT REPORT (EIR)
s PREPARED FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL EIR 85-
2, AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS
6 AND ADDENDA) IS ADEQUATE TO SERVE AS THE PROGRAM EIR
? FOR VESTING TENTATIVE TRACT MAP 15601, DESIGN REVIEW 97-
035, AND HILLSIDE REVIEW 98-001. APPLICABLE MITIGATION
s MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT.

The City Council of the City of Tustin does hereby resolve as follows:

I. The City Council finds and determines as follows:

A. That Vesting Tentative Tract Map 15601, Design Review 97-035 and Hillside

Review 98-001 and respective development plans are considered "projects"
~4 pursuant to the terms of the California Environmental Quality Act; and,

B. That the projects are covered by a previously certified Final Environmental
~6 Impact Report 85-2, as amended, for the .East Tustin Specific Plan which
serves as a Program EIR for the proposed project.

~8 II. The East Tustin Specific Plan Final Environmental Impact Report (85-2),
previously certified on March 17, 1986, as modified by subsequently adopted
~9 supplements and addenda, was considered prior to approval of this project.
20 The City Council hereby finds: that this project is within the scope of the East
Tustin Specific Plan previously approved; the effects of this project, relating to
2~ grading, drainage, circulation, public services and utilities, were examined in the
22 Program EIR. The applicable mitigation measures and altematives developed
in the Program EIR are incorporated into this project. The Final EIR is,
23 therefore, determined to be adequate to serve as a Program EIR for this project
and satisfies all requirements of the California Environmental' Quality Act.

25 Further, the City Council finds the project involves no potential for any adverse
effect, either individually or cumulatively, on wildlife resources; and therefore,
makes a De Minimus Impact Finding related to Fish and Game Code Section
27 711.4.

4 Applicable mitigation measures identified in the Final EIR have been
5 incorporated into this project which mitigate potential significant environmental
effects thereof. The mitigation 'measures are identified as Conditions on Exhibit
6 A of Planning Commission Resolution No. 3588 approving Design Review 97-
? 035 and Hillside Review .98-001, and Resolution No. 3587 recommending
approval of Vesting Tentative Tract Map 15601.

PASSED AND ADOPTED by the City Council of the City Of Tustin, at a regular meeting
on the 4th day of May, 1998.
