HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: APPROVAL OF AMENDMENT NO.1 TO COOPERATIVE AGREEMENT NO. 12-367 (CONSTRUCTION) WITH THE STATE OF CALIFORNIA FOR THE NEWPORT AVENUE EXTENSION/SR-55 RAMP RECONFIGURATION PROJECT (CIP NO. 7130) SUMMARY The proposed amendment to Cooperative Agreement No. 12-367 between the City of Tustin and the State of California (Caltrans) modifies the existing agreement to include surveying and monumentation requirements. Cooperative Agreement No. 12-367 is for the construction phase of the Newport Avenue Extension / SR 55 Ramp Reconfiguration Project (CIP No. 7130). RECOMMENDATION It is recommended that the City Council approve Amendment No.1 to Cooperative Agreement No. 12-367 with the State of California (Caltrans) and authorize the Mayor and City Clerk to execute the document on behalf of the City. FISCAL IMPACT Funds to accomplish the construction work items designated as Tustin's responsibilities in the subject agreement are funded within the current CIP No. 7130 budget in the amount of $11,041,838. This project is funded from a combination of Measure "M" Turnback funds, Measure "M" Competitive funds, Water Capital Improvement Program funds, Developer Bond funds, Developer Cash Payment funds, and Tustin Community Redevelopment Agency-South Central funds. BACKGROUND Cooperative Agreement No. 12-367 provides coordination between the State of California and the City for the Newport Avenue Extension/SR55 Ramp Reconfiguration Project (CIP 7130). The Cooperative Agreement outlines the specific areas of responsibility for the construction phase of the project. Approval of Amendment No.1 to Cooperative Agreement No. 12-367 (Construction) with the State of California for the Newport Avenue Extension/SR55 Ramp Reconfiguration Project (CIP No. 7130) January 3, 2005 Page 2 A description of proposed project improvements is as follows: . Extension and widening of Newport Avenue south approximately 1,800 lineal feet from Edinger Avenue to Valencia Avenue. The proposed Newport Avenue extension will be a six (6) lane Major Arterial. The proposed features include three (3) lanes in each direction, raised medians, sidewalks, and bike lanes. Extended double left turn lanes and a separate right turn lane to the SR-55 on ramps will be provided. . Realignment of Del Amo Avenue to intersect with the SR-55 ramps and Newport Avenue, Del Amo Avenue will also be widened to allow for four (4) lanes and provide and added access route to SR-55. A portion of Del Amo Avenue no longer needed for street purposes will be vacated after the project. The realignment of Del Amo Avenue will also necessitate the relocation of a Southern California Edison 66kv Transmission Line that is currently located along Del Amo Avenue. The line is proposed to be under grounded. . Reconstruction of the SR-55 northbound ramps. The current loop ramps at SR-55 and Edinger Avenue will be removed and replaced by hook ramps approximately 1,200 lineal feet south of Edinger Avenue. This configuration offers many advantages including an improved level of service and a reduced weaving pattern on the freeway. A land exchange is planned between Caltrans and the City for the ramp locations that are delineated in Cooperative Agreement No. 12-238, previously entered into between the City and Caltrans. . Widening of the north side of Valencia Avenue from the new intersection with Newport Avenue easterly 350 feet to the existing railroad spur line tracks. . Construction of a new Edinger Avenue and Newport Avenue intersection and widening of Edinger Avenue around the intersection. Edinger Avenue at Newport Avenue will be lowered approximately three (3) feet to accommodate design requirements for the Newport Avenue extension to the north (Phase II). As part of a separate project, Edinger Avenue will be widened to three (3) lanes in each direction to major arterial status. The widening of Edinger Avenue is a part of the Orange County Transportation Authority's Measure "M" Smart Street Program. . New signalized intersections will be provided along Newport Avenue at Edinger Avenue, SR-55 ramps/Del Amo Avenue and Valencia Avenue. The existing signalized intersection at Del Amo Avenue/Edinger Avenue will be modified to accommodate the widened roadways. Provision for a future signal at a mid-block commercial driveway on Newport Avenue north and south of the SR-55/Del Amo Avenue intersection will be made. Existing landscaping affected by the construction will be replaced in-kind and new landscaping will be provided adjacent to the reconstructed SR-55 northbound ramps. A separate Cooperative Agreement (Agreement No. 12-238) to cover responsibilities and funding for the environmental, design and right-of-way phases of this project was approved by the City Council on August 3, 1998 and by Caltrans on October 15, 1998. The original termination date of this Agreement was December 31, 2000. This Agreement has been amended to reflect a termination date of December 31, 2004. As a separate agenda item, staff is recommending approval of an amendment to extend this Agreement (No. 12-238) to December 31,2007. DISCUSSION Cooperative Agreement No. 12-367 was approved by the City Council on September 15, 2003 and by Caltrans on November 10, 2003. Caltrans is requesting a minor modification to the Agreement to address project surveying and survey monumentation requirements. General Civil Engineering practice in the State of California is to preserve and perpetuate existing survey monuments that may be damaged or removed during construction of a project. The amendment requested by Caltrans will require the City to preserve any existing monumentation, such that when construction is completed, all existing monumentation is restored to their original condition. The City's practice on all capital improvement projects is to require the contractor to adhere to this State mandated practice. The attached amendment also requires the City to forward to Caltrans all survey documents related to the project. The City will obtain these documents from the design consultant and their sub-consultants and provide copies to Caltrans. The City Attorney has reviewed this amendment and approved it as to form. TO AGREEMENT, ENTERED INTO EFFECTIVE ON , 2005, is between the STATE OF CALIFORNIA, acting by and through its Department of Transportation, referred to herein as STATE, and CITY OF TUSTIN A body politic and a municipal Corporation of the State of California, referred to herein as "CITY". District Agreement No. 12-367 A-1 RECITALS 1. The parties hereto entered into an Agreement (Document No. 15701) on November 10, 2003, said Agreement defined the terms and conditions for construction and contract administration of a project to reconstruct the northbound on and off ramps on SR-55 at Edinger Avenue, hereinafter referred to as PROJECT. 2. The purpose of this Amendment No.1 is to add clauses for surveying that were not included in the original Agreement to make CITY responsible for assuring that surveying, mapping, and monumentation for PROJECT will conform to STATE's latest standards. IT IS THEREFORE MUTUALLY AGREED: 1. The new Articles shall now be added into Section I of the original Agreement to read as follows: 20. All aerial photography and photog ram metric mapping shall conform to STATE's latest standards. 21. A copy of all original survey documents resulting from surveys performed for PROJECT, including original field notes, adjustment calculations, final results, and appropriate intermediate documents, shall be delivered to STATE and shall become property of STATE. For aerial mapping, survey documents to be furnished are one set of contract prints, a complete photo index and the original electronic topographic mapping in Microstation format. 22. To preserve and perpetuate the existing survey monuments along PROJECT pursuant to the Board of Registration for Professional Engineers and Land Surveyors Policy Resolution #97-02 addressing the practice of land surveying relative to monument preservation and perpetuation and Section 8771 of the Business and Professions Code. To rehabilitate points obliterated by PROJECT pursuant to the Board of Registration for Professional Engineers and Land Surveyors Policy Resolution #97-01 addressing the practice of land surveying relative to monument durability and identification and to file all necessary documents as required by Sections 8762, 8773 and 8773.3 of the Business and Professions Code. 24. CITY shall require its contractor or a surveyor/engineer licensed by the State of California to file all monumentation documentation (Records of Surveyor Corner Records) with the County Surveyor in conformance with State laws and regulations. CITY shall require its contractor or a surveyor/engineer licensed by the State of California to meet with the Caltrans Survey Mapping section prior to performing monumentation work. CITY shall require its contractor or a surveyor/engineer licensed by the State of California to submit said documents to the Caltrans Survey Mapping section for review and approval prior to submittal to the County Surveyor for recordation. 2. All other terms and conditions of said Agreement (Document No. 15701) shall remain in full force and effect. 3.
