TO FILE THE NOTICE OF COMPLETION FOR THE NEWPORT
AVENUE AT EL CAMINO REAL TRAFFIC SIGNAL MODIFICATION /
UPGRADE (CIP NO. 4064)
SUMMARY
Construction of the Newport Avenue at EI Camino Real Traffic Signal Modification / Upgrade
(CIP No. 4064) has been completed to the satisfaction of the City Engineer and is now ready
for City Council acceptance.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 05-07 accepting the Newport
Avenue at EI Camino Real Traffic Signal Modification / Upgrade (CIP No. 4064), and
authorizing the recordation of the Notice of Completion, and direct the City Clerk to:
1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the
date of recordation of the Notice of Completion; and
2. Release the Faithful Performance Bond not sooner than one year after the date of
recordation of the Notice of Completion; and
Assuming no claims or stop payment notices are filed, it is further recommended that the City
Council authorize payment of the final 10% retention in the amount of $18,309.56 to Steiny
and Company, Inc. thirty-five (35) days after the date of recordation of the Notice of
Completion. This amount, plus previous contract payments and one change order totals
$183,095.62, which represents 100% of the final contract cost.
FISCAL IMPACT
The final construction contract cost for the Newport Avenue at EI Camino Real Traffic Signal
Modification Upgrade Project is $183,095.62. The project was funded by Measure "M"
Turnback Funds.
Acceptance of Public Improvements and Authorization to File the Notice of Completion for the
Newport Avenue at EI Camino Real Traffic Signal Modification / Upgrade (CIP No. 4064)

Design and project construction have increased the City's infrastructure assets by $197,352.00.
The increased infrastructure valuation will be added to the City's infrastructure inventory as
required by Statement 34 of the Governmental Accounting Standards Board (GASB 34). Detailed
cost information is shown on the attached GASB 34 Infrastructure Inventory Valuation Fonm.
BACKGROUND AND DISCUSSION
The construction of the Newport Avenue at EI Camino Real Traffic Signal Modification / Upgrade
(CIP No. 4064) was completed on December 16, 2004. The signal modifications included
installation of separate left-turn phasing for EI Camino Real approaches, new safety lighting for
intersection illumination, new signal poles, mast arms and vehicle heads, new illuminated street
name signs, and the upgrading of existing curb ramps to be in compliance with federal Americans
with Disabilities Act (ADA) requirements.
All of the work for this project has been completed to the satisfaction of the City Engineer, and is
now ready for City Council acceptance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION
FOR THE CONSTRUCTION OF THE NEWPORT AVENUE AT EL CAMINO
REAL TRAFFIC SIGNAL MODIFICATION / UPGRADE (CIP NO. 4064)
WHEREAS, Steiny and Company, Inc., having a contract with the City of Tustin
to construct the hereinafter described public works and improvement; and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
works and improvement should be filed and payment of the balance due said contract
authorized in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public works and improvement is found to be complete, and the same is
hereby accepted. Said public works and improvement is more particularly described as
follows:
Newport Avenue at EI Camino Real Traffic Signal Modification / Upgrade
(CIP No. 4064)
BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 3rd day of January 2005.
