HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: ADOPTION OF RESOLUTION NO. 05-14 ORDERING THE PREPARATION OF THE ENGINEER'S REPORT FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT LEVY OF ANNUAL ASSESSMENTS FOR FISCAL YEAR 2005-2006 SUMMARY Resolution No. 05-14 orders the preparation of the Engineer's Report for the Tustin Landscape and Lighting District Levy of Annual Assessments for Fiscal Year 2005-2006. The purpose of the Engineer's Report is to set forth findings and the engineering analysis to levy assessments in the Tustin Landscape and Lighting District for the 2005-2006 Fiscal Year. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 05-14 ordering the preparation of the Engineer's Report for the Tustin Landscape and Lighting District Levy of Annual Assessments for Fiscal Year 2005-2006. FISCAL IMPACT None. All City costs will be recovered through the levy of the annual assessments for the District. BACKGROUND This action is the initial phase of the process to levy annual assessments for Fiscal Year 2005-2006 in the Tustin Landscape and Lighting District. Resolution No. 05-14 orders the preparation of the Engineer's Report. The District provides funding for the maintenance of the perimeter landscaping on the arterial highways within the Tustin Ranch area, and for the operation and maintenance of the street lighting on the public streets within the Tustin Ranch area. For Fiscal Year 2005- 2006, the last phase of the Peters Canyon Regional Trail between Peters Canyon Road and Lower Lake Drive will be added to the landscaped area. A copy of the latest Landscape and Lighting District Assessment Diagram is attached for reference. Preparation of the Engineer's Report for the Tustin Landscape and Lighting District Levy of Annual Assessments for Fiscal Year 2005-2006 January 17, 2005 Page 2 Three future City Council resolutions will be required as the process proceeds: . Adoption of a resolution approving the Engineer's Report is tentatively scheduled for April 18, 2005. . Adoption of a resolution declaring the City Council's intention to provide an annual levy of assessments is also tentatively scheduled for April 18, 2005 along with a resolution setting the date for a public hearing on May 16, 2005. . Adoption of a resolution ordering the levy of annual assessments outlined in the Engineer's Report for the 2005-2006 Fiscal Year. Kasdan Engineering Services Manager Attachments: Resolution 05-14 Landscape and Lighting District Assessment Diagram S:ICity Councilltems\2005 CouncilltemslPreparation of Eng Rpt for TL&L 05-06 & Reso 05,14.doc RESOLUTION NO. 05-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA ORDERING THE PREPARATION OF AN ENGINEER'S REPORT FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT LEVY OF ANNUAL ASSESSMENTS FOR FISCAL YEAR 2005-2006 WHEREAS, it is the intention of the City Council of the City of Tustin to levy annual assessments for the 2005-2006 Fiscal Year for the Tustin Landscape and Lighting District; and WHEREAS, no changes in street light facilities or subdivided parcels have occurred, but changes in improvements including new landscaped areas to be maintained by said District have occurred; and WHEREAS, Harris and Associates, is under contract to provide professional engineering services in connection with said District under the direction of the Director of Public Works/City Engineer. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that the Director of Public Works/City Engineer is hereby ordered to prepare and file, through Harris and Associates, the Engineer's Report for the Tustin Landscape and Lighting District Levy of Annual Assessments for Fiscal Year 2005-2006. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 1th day of January 2005.
