HUSTON, CITY MANAGER FROM' PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION NO. 5 07-02-01 SUBJECT' ACCEPTANCE OF PUBLIC IMPROVEMENT AND AUTHORIZATION TO FILE NOTICE OF COMPLETION FOR CANOPY FOR STREET SWEEPER UNLOADING AREA, NPDES COMPLIANCE (ClP NO. 1036) SUMMARY Construction of the Canopy for the Street Sweeper Unloading Area (ClP No. 1036) has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 01-70 accepting the construction of the Canopy at the Street Sweeper Unloading Area and authorizing the recordation of the Notice of Completion, and direct the City Clerk to' 1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and 2. Release the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion. Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date of recordation of the Notice of Completion the City Council authorize payment of the final 10% retention in the amount of $26,420.35 to Station Equipment Leasing Corp. This amount together with previous payments of $237,783.10 represents 100% of the final contract cost. FISCAL IMPACT The final construction cost for this project was $264,203.45 which included the canopy and related sanitary sewer connection (CIP No. 1036). A savings of approximately $17,000 per year will be realized as a result of constructing this project due to the City's ability to wash the street sweeper vehicles at the Field Service Yard. The 2000-2001 Fiscal Year Capital Improvement Program Budget provided sufficient funding for this project. BACKGROUND The Canopy at the Field Services Yard was constructed in order to prevent surface water from entering the sanitary sewer. The new sanitary sewer connection was constructed because the City's National Pollution Discharge Elimination System (NPDES) Permit prohibits discharge of the wastes from the street sweeper unloading area and wash rack into the storm drain system. The waste is now directed to the sanitary sewer in compliance with Orange County Sanitation District requirements. WHEREAS, the City Council finds that said contractor has completed said public works and improvements hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvements should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvements are found to be complete, and the same is hereby accepted. Said public works and improvements are more particularly described as follows' CANOPY FOR STREET SWEEPER UNLOADING AREA, NPDES COMPLIANCE (ClP NO. 1036) BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvements described herein as required by law.
