HUSTON, CITY MANAGER FROM' REDEVELOPMENT AGENCY STAFF SUBJECT: DETERMINATION THAT A PROJECT AREA COMMITTEE WILL NOT BE FORMED IN CONNECTION WITH THE MCAS-TUSTIN REDEVELOPMENT PROJECT SUMMARY Tustin City Council approval is requested for a resolution finding and determining that a Project Area Committee ("PAC") shall not be formed in connection with the MCAS- Tustin Redevelopment Project. RECOMMENDATION Staff recommends that the City Council adopt Resolution 01-37 finding and determining that the MCAS-Tustin Redevelopment. Project does not contain a substantial number of Iow- and moderate-income persons who could be displaced or who would be subject to displacement by the Agency, and that formation of a Project Area Committee is not required, and determines that a Project Area Committee shall not be formed in connection with the MCAS Tustin Redevelopment Project. FISCAL IMPACT This action will have no fiscal impact. BACKGROUND/DISCUSSION California Community Redevelopment Law ( Health and Safety Code Section 33385 et seq.) requires that a Project Area Committee be formed in a proposed Redevelopment Project Area in either of the following situations' A substantial number of Iow-income persons or moderate-income persons, or both, reside within the Project Area, and Redevelopment Plan will contain authority for the Agency to acquire, by eminent domain, property on which any such persons reside: or The Redevelopment Plan will contain one or more public projects that will displace a substantial number of Iow-income persons or moderate-income persons, or both. Huston Determination of Project Area Committee April 16, 2001 Page 2 If a Project Area does not contain a substantial number of low- and moderate-income individuals, the Redevelopment Agency shall consult with and obtain the advice of residents and community organizations concerning those policy matters which deal with the planning and provision of residential facilities or replacement housing for those to be displaced by project activities, if any, as well as on other, policy matters which affect the residents of the project, and further requires that the proposed Redevelopment Plan be provided to such residents and community organizations prior to submitting it to the legislative body. There are currently no military, non-military individuals, or families that occupy property at the former Tustin Marine Corps Air Station. The United States Marine Corps has previously transferred and relocated these individuals and families. Therefore, there are not Iow-income or moderate-income persons residing within the proposed MCAS Tustin Project boundaries who could be displaced or who would be subject to displacement by the Redevelopment Agency. Adoption of the MCAS Tustin Redevelopment Plan will not result in displacement of a substantial number of low- and moderate-income persons, either through Redevelopment Agency property acquisition or through public projects implemented by the Redevelopment Agency. Staff will be available at the Agency's meeting to answer any questions. ,.. -'¢JJames DraL~g.~.~n Redevelopment Program Manager Attachment: Resolution No 01-37 rd ash ared\a pril 16age n cyactions\april 16citycou n cilagendare port l0 14 2O 2! 22 23 24 25 RESOLUTION NO. 01-37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN DETERMINING THAT A PROJECT AREA COMMITTEE SHALL NOT BE FORMED IN CONNECTION WITH THE MCAS-TUSTIN REDEVELOPMENT PROJECT The City Council of the City of Tustin DOES HEREBY RESOLVE as follows: A, On February 27, 1996, the City Council of the City of Irvine authorized the Tustin Redevelopment Agency to include a portion of Irvine within the scope of the MCAS Tustin Redevelopment Plan and further authorized Tustin to administer all redevelopment activities within the lrvine portion subject to a Redevelopment Cooperation Agreement between all parties. On February 14, 1996, pursuant to Section 33213 of the California Community Redevelopment Law (Health and Safety Code Section 33000 et seq.) the City of Tustin, the Tustin Community Redevelopment Agency, and the City of lrvine entered into a "Redevelopment Cooperation Agreement" ( the "Agreement"). Said Agreement was subsequently amended on November 13, 1997 by Amendment No. 1 and on April 3, 2000 by Amendment No. 2. B, C, On September 8, 1997, the Planning Commission of the City of Tustin selected the boundaries for the MCAS-Tustin Redevelopment Project ( the "Project") , adopted a Preliminary Plan for the Project, and authorized submission of the Preliminary Plan for the Project to the Tustin Community RedeveloPment Agency ("Agency") by Resolution No. 3544; and On September 15,1997, the Agency received the Preliminary Plan and directed that the Redevelopment Plan for the MCAS-Tustin Redevelopment Project be prepared by Resolution No. RDA 97-04; and Bi California .Community Redevelopment Law ( Health and Safety Code Section 33385 et seq.) requires that a project area committee be formed in a redevelopment project area in either of the following situations: 1) A substantial number of Iow-income persons or moderate-income persons, or both, reside within the project area, and the redevelopment plan as adopted will contain authority for the agency to acquire, by eminent domain, property on which any such persons reside; or 2) The redevelopment plan as adopted contains one or more public projects that will displace a substantial number of Iow-income persons or moderate- income persons, or both; and l0 14 2O Resolution No. 01-37 Page 2 E, California Community Redevelopment Law ( Health and Safety Code Section 33385 (f)) also requires that if the project area does not contain a substantial number of Iow- and moderate-income individuals, the Agency shall consult with and obtain the advice of, residents and community organizations concerning those policy matters which deal with the planning and provision of residential facilities or replacement housing for those to be displaced by project activities, if any, as well as on other policy matters which affect the residents of the project, and further requires that the proposed Redevelopment Plan be provided to such residents and community organizations prior to submitting it to the City Council; and Fi There are currently no military, non-military persons, or families that occupy property at The United States Marine Corps transferred and'relocated individuals and families within the proposed Project Area and the Site is currently no occupied; and. NOW, THEREFORE, the City Council of the City of Tustin resolves as follows: Section 1. The City Council of the City of Tustin finds and determines that the proposed MCAS-Tustin Redevelopment Project does not contain a substantial number of Iow- and moderate-income persons who could be displaced or who would be subject to displacement by the Agency, and that formation of a Project Area Committee is not required prior to the adoption of the Redevelopment Plan. The City Council further determines that a Project Area Committee shall not be formed in connection with the proposed Project. 24 Section 2. The Tustin Community Redevelopment Agency is hereby authorized and directed to consult with and obtain the advice of residents, property owners, businesses and community organizations (if any) within the MCAS-Tustin Redevelopment Project, and to provide such residents, owners, businesses and community organizations with the opportunity to review the proposed Redevelopment Plan prior to its submission to the City Council.
