CALL TO ORDER – Meeting #2451 at 7:06 p.m. PRESENTATION OF COLORS, INVOCATION AND PLEDGE OF ALLEGIANCE – American Legion PRESENTATIONS – Mayor Puckett presented a Certificate of Recognition to Deputy Police Chief Jeffrey Blair in honor of 30 Years of Service. Mayor Puckett presented a Proclamation to Outreach Assistant Stephanie Lu recognizing Fair Housing Month. Mayor Puckett presented a Proclamation to Dr. Glenn Roquemore and Trustee T.J. Prendergast III in honor of Community College Awareness Month. — CLOSED SESSION REPORT – City Attorney David E. Kendig: The City Council gave direction to its legal counsel in the pending litigation matters listed on the agenda. In addition, the City Council unanimously denied Claim No. 18-26, 19-03, and 19-06. Other than that there is no reportable action at this time. However, after the conclusion of this open session agenda, the City Council will be reconvening in closed session to discuss Items 5 and 7 on the closed session agenda and we will report out at the conclusion of that discussion as well. Motion carried: 5-0 1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: That the City Council waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES – THE REGULAR MEETING OF THE CITY COUNCIL HELD ON MARCH 5, 2019. Motion: That the City Council approve the Action Minutes of the Regular Meeting of the City Council held on March 5, 2019. 3. RATIFICATION OF PAYROLL AND DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: It is recommended that the City Council approve Payroll in the amounts of $812,803.14 and $790,604.44; and Demands in the amount of$8,325,099.36. 4. FINDING AND DETERMINING THE INDUSTRIAL DISABILITY RETIREMENT OF JAMES BRABECK Adoption of the attached Resolution will certify that James Brabeck is industrially disabled from his position of Police Sergeant and enable CaIPERS to process his industrial disability retirement. Motion: Adopt Resolution No. 19-11 finding that Police Sergeant James Brabeck is industrially disabled from performing the duties of his position. RESOLUTION NO. 19-11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT JAMES BRABECK, A LOCAL SAFETY MEMBER, IS INDUSTRIALLY DISABLED FROM HIS DUTIES AS A POLICE SERGEANT 5. AWARD CONTRACT FOR THE TUSTIN RANCH ROAD/EL CAMINO REAL IMPROVEMENT PROJECT (CIP NO. 70239) Staff is recommending that the City Council award the construction contract for the Tustin Ranch Road/EI Camino Real Improvement Project (CIP No. 70239) to the lowest responsive/responsible bidder, Hillcrest Contracting, Inc. It was moved by Mayor Pro Tern Bernstein and seconded by Mayor Puckett to award the construction contract for the Tustin Ranch Road/EI Camino Real Improvement Project (CIP No. 70239) to the lowest responsive/responsible bidder, Hillcrest Contracting, Inc., in the amount of $1,676,340.08 and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City. Motion carried: 5-0 7. AUTHORIZE A PROFESSIONAL SERVICES CONTRACT FOR TREASURY CONSULTING SERVICES INCLUDING ASSESSMENT OF BANKING SERVICES Staff is recommending that the City Council authorize a professional services contract with PFM Asset Management LLC for treasury consulting services, including an assessment of banking services and preparation of a Request for Proposal (RFP) for banking services. Motion: That the City Council: 1. Authorize a professional services contract with PFM Asset Management LLC for treasury consulting services, including assessment of banking services and preparation of an RFP for banking services; and 2. Appropriate $50,000 from Land Sale Proceeds Fund (Fund 189) reserves for the project. 8. AWARD OF BID FOR THE CITRUS RANCH PARK PICNIC SHELTER (CIP No. 20081) The bid opening for the Citrus Ranch Park Picnic Shelter project was held on March 4, 2019. This project was identified by the Community Services Commission as the City Council April 2, 2019 Meeting Minutes Page 5 of 14 next project to be completed on their seven-year Capital Improvement Project priority — list. Motion: Staff recommends that City Council award the construction contract to A2Z Construct, Inc. of Rancho Santa Margarita, California, in the amount of $138,000 subject to the approval of contract requirements by the City Attorney and final execution of the contract. 9. JOHN WAYNE AIRPORT NOISE ABATEMENT QUARTERLY REPORT This agenda report transmits the John Wayne Airport (JWA) Noise Abatement Quarterly Report for the third quarter of 2018. The average noise level measured at Tustin's monitoring station (NMS 10N), located at Columbus Tustin Middle School on Beneta Way (Figure 1), remained fairly consistent with prior quarters during this third quarter reporting period. Average noise levels during the third quarter continued to remain well below the City, County, and State criteria of 65 dB Community Noise Equivalent Level (CNEL) for residential uses. Council Member Clark requested staff to provide information regarding the EIR and how it impacts the City. It was moved by Council Member Clark and seconded by Mayor Puckett to receive and file. Motion carried: 5-0 10. PLANNING COMMISSION AS HISTORIC AND CULTURAL RESOURCES ADVISOR PROGRAM - 2019 WORK PROGRAM On April 3, 2018, the City Council received public comment from the Tustin Preservation Conservancy requesting the City Council reinstate the Historic Resources Committee (HRC) as a separate committee. Between June and November, 2018, staff provided the City Council with historical background related to the State Office of Historic Preservation (SHPO) Certified Local Government (CLG) requirements, Orange County and statewide CLG processes, and other relevant information related to historic and cultural resources. On November 6, 2018, the City Council adopted Resolution 18-78 affirming the Planning Commission as the Historical and Cultural Resources Advisor to the City Council and establishing a program defining the Planning Commission roles, responsibilities and annual work program (Attachment A). On March 26, 2019, the Planning Commission adopted Resolution 4376, approving the 2019 Planning Commission as Historic and Cultural Resources Advisor Work — Program. This report is intended to provide City Council with information of Planning Commission as Historic and Cultural Resources Advisor action related to historic resources and preservation efforts. City Council April 2, 2019 Meeting Minutes Page 6 of 14 Council Member Clark requested that staff report back to Council in one year to evaluate the success of the work program and possibly do more assessment throughout the state to see if we're following best practices in terms of the Planning Commission serving in both roles. It was moved by Council Member Clark and seconded by Mayor Puckett to receive and file the report. Motion carried: 5-0 11. AWARD OF CONTRACT FOR BIDS FOR THE POLICE DEPARTMENT EVIDENCE ROOM HVAC PROJECT CIP NO. 10032 Staff is requesting that the City Council award the construction contract for the Police Department Evidence Room HVAC Project (CIP No. 10032) to the lowest responsive/responsible bidder. Motion: It is recommended that the City Council award the construction contract for the Police Department Evidence Room HVAC Project CIP No. 10032 to the lowest responsive/responsible bidder, TBC Contractors Corporation, in the amount of $198,620.00 and authorize the Mayor and City Clerk to execute the contract documents on behalf of the City. -- REGULAR BUSINESS ITEMS 12-13 12. COMMENDATION AND TUSTIN HISTORIC REGISTER PROGRAM/PLAQUES FOR NON-HISTORIC PROPERTIES — 195 EL CAMINO REAL Planning Commission Chair Steve Kozak and Director of Community Development Elizabeth A. Binsack provided a PowerPoint presentation. The City Commendation Program recognizes an Old Town property of outstanding merit as often as every calendar quarter. The Community Development Department (CDD) nominated the property at 195 El Camino Real for a commendation and the Planning Commission as Historic and Cultural Resources Advisor, approved the commendation on March 12, 2019. This is the first non-historic building that has received a commendation in Old Town Tustin. Pursuant to the Commendation Program, following the Planning Commission's approval, the City Council would recognize the property owner and present the commendation at the next available City Council meeting. When the Planning Commission approves a commendation, the CDD acknowledges the commended property with a decorative "Outstanding Property" sign that can be displayed on the property for the quarter in which the commendation is awarded and a bronze plaque that can be permanently affixed to the building. For a historic property, the plaque bears the construction date of the building, up to two (2) lines of text, and the words "Tustin Historic Register". The question arose before the City Council April 2, 2019 Meeting Minutes Page 7 of 14 Planning Commission as to whether a historic plaque is appropriate for a non-historic building in light of the historic nature of previously awarded plaques. As a result, staff is recommending a plaque design for non-historic structures that distinguishes the property from those on the Historic Register. It was moved by Mayor Pro Tem Bernstein and seconded by Council Member Clark to commend the building at 195 El Camino Real (Del Rio Building) and its owners as a property of outstanding merit in Old Town Tustin and direct staff to initiate a plaque design for non-historic structures that distinguishes the property from those with the Historic Register Plaques. Motion carried: 5-0 13. LEGISLATIVE UPDATE Management Analystt II Ken Piguee provided a summary of state legislative activity. It was moved by Mayor Pro Tern Bernstein and seconded by Council Member Clark that the City Council: 1. Receive and file the legislative matrix. 2. Take a SUPPORT position on AB 147 (Burke-D) Use taxes: collection: retailer engaged in business in this state: marketplace facilitators. 3. Take an OPPOSE position on AB 1568 (McCarty-D) General plans: housing element: production report: withholding of transportation funds. Motion carried: 5-0 OTHER BUSINESS/CITY MANAGER AND CITY ATTORNEY Acting City Manager Matthew S. West Provided a report on the following: o There was an ordinance revision to the permit parking to add one permit to any residence without on-site utilization; starting next week, residents can take advantage of that. Staff is putting together communication to inform residents and will begin to monitor how it is affecting them. o Gave a presentation on Balloonist Pilot Engineer Julian Nott who was a world-famous pilot; Julian Nott and his team had been working in the South Hangar for a period of — time on a balloon flight. On March 20th,the City Council had the opportunity to visit Julian Nott and his new air balloon in the hangar. Two days later, Julian Nott was involved in an unfortunate accident during a recent flight and passed away a few days later. City Council April 2, 2019 Meeting Minutes Page 8 of 14 City Attorney David E. Kendiq Announced the City Council will be reconvening in Closed Session after the Regular Meeting of the City Council. COUNCILMEMBER COMMENTS AND REPORTS Councilmember Cooper Asked to defer his comments. Councilmember Lumbard Echoed sentiments of Acting City Manager Matthew S. West regarding Julian Nott and the tragedy that occurred; condolences to Julian Nott's family; requested staff to send card or letter to the family and the company offering best wishes. Commended staff and the Police Department for opening the Tustin Homeless Shelter; end result is an amazing opertation; had the opportunity to visit the shelter and spend the night before it opened to experience the operation of the facility; Tustin is on the forefront of doing something very positive to address homelessness; thanked staff for all their hard work with the project. Councilmember Clark Announced March was Women's History Month; was a speaker and attended several events including the Great American Write-in, American Association of University Women (AAUW) Tustin Chapter meeting and the Women are Powerful/Girls are Powerful Summit sponsored by the California Endowment. March 13 Attended the groundbreaking of Tustin Unified School District Magnet School. March 14 Toured the new Tustin Homeless Shelter. March 20 Had the opportunity to meet Julian Nott. March 13 and March 28 Attended the Orange County Fire Authority (OCFA) Board meeting; was unable to attend the Mayor's Dinner on March 28th due to the OCFA meeting; major news announced: Irvine will continue to be a part of OCFA, pending approval at their council meeting; Garden Grove, pending approval, will be a member of OCFA as well. Announced the retirement of Orange County Fire Authority (OCFA) Division Chief Andy City Council April 2, 2019 Meeting Minutes Page 9 of 14 Kovacs. — March 26 Was Principal for the Day at Pioneer Middle School; thanked Principal Vander Hayden and Vice Principal Mr. Fresch for their efforts; thanked the Tustin Unified School District(TUSD) Board for putting that together. Requested to close the City Council meeting in honor of balloon explorer Julian Nott. Wished Councilmember Austin Lumbard a Happy Birthday. Councilmember Cooper Echoed sentiments regarding Julian Nott; expressed interest in dedicating the meeting in his honor. March 8 Attended the American Legion meeting. March 9 Attended the Operation Warm Wishes Third Annual Enchanted Evening Gala at Wilcox Manor; congratulated TyRon Jackson on a wonderful event. March 13 o Attended the groundbreaking of Tustin Unified School District Magnet School. o Attended the United to End Homelessness Event in Costa Mesa. March 14 Attended the dry run for the Tustin Homeless Shelter and had the opportunity to spend the night there before it opened; thanked Jim Palmer, President of the Orange County Rescue Mission, for doing an amazing job running the Homeless Shelter. March 13 Attended the Chamber of Commerce Monthly Membership Breakfast; congratulated the Officers of the Month. March 20 Had the opportunity to meet Julian Nott. Mayor Pro Tern Bernstein Attended the Orange County Sanitation District Operations Committee meeting; discussed Headworks Rehabilitation of Plant No. 1. March 9 Attended the Operation Warm Wishes Third Annual Enchanted Evening Gala at Wilcox Manor; congratulated TyRon Jackson on a wonderful event. March 11 Attended the Orange County Sanitation District Legislative and Public Affairs Committee meeting; will be coordinating with Economic Development Management Analyst II Kenneth Piguee moving forward regarding legislative updates and information; budget was approved — in Washington D.C., various funds from the budget include grant money; California Senators Robert Hertzberg and Scott Wiener are pushing SB 332 and SB 200. March 13 Attended the groundbreaking of Tustin Unified School District Magnet School; congratulated staff and the Tustin Unified School District for working together on the project. March 14 Attended the soft opening for the Tustin Homeless Shelter; congratulated staff, especially the Public Works Department for doing a great job with the shelter; thanked Jim Palmer, President of the Orange County Rescue Mission, for doing an amazing job running the Tustin Homeless Shelter; is a benchmark project for homeless shelters. March 20 Attended the Newport Bay Watershed Committee meeting. March 21 Attended the Mayor's Birthday Party Fundraiser at the Tustin Boys and Girls Club; congratulated the Boys and Girls Club for a terrific event. March 27 — Attended the Orange County Sanitation District Board meeting; gave a tour of the Orange County Sanitation District and the Ground Water Replenishment Facility to a couple colleagues. Congratulated Orange County Fire Authority (OCFA) Division Chief Andy Kovacs on his retirement from the OCFA. Congratulated Tustin Police Captain Bob Wright on his promotion. Invited everyone to attend the Disaster Preparedness Expo on Saturday, April 6th at the Tustin Hangar. Wished Councilmember Austin Lumbard a Happy Birthday. March 29 Gave Federal Judge Carter a tour of the Tustin Homeless Shelter. April 2 Met with Federal Judge Carter to discuss the homeless issue in Orange County. ADJOURNED IN MEMORY OF Tomoko "Tomo" Mizusawa February 12, 1921 — March 7, 2019 The Tustin community was blessed with Tomo's presence and grace when she was hired as a part time Recreation Leader in 2002. At a young age of 81 years old, Tomo inspired her colleagues, volunteers and participants with her wealth of knowledge, experience and dedication. Tomo was a true Tustinite, graduating from Tustin High School in 1939. She was active with several sports including basketball, volleyball, hockey and softball. After school, Tomo continued to live in Tustin on her family's farm. During World War II, Tomo experienced first-hand a regretful moment in our nation's history when she was relocated from her family farm in Tustin and incarcerated in a Japanese-American internment camp in the Arizona desert. She remained there for a year and a half. During that time, she married her husband Fred and was released shortly thereafter. Over seven years of hard work and resilience, they were able to rebuild their lives and began farming on land they purchased in Garden Grove. They were blessed with three City Council April 2, 2019 Meeting Minutes Page 13 of 14 sons. However, in 1961, her husband passed away and Tomo was solely responsible for _ the farm and raising their children. Eventually, she moved her family back to Tustin in 1978. Tomo remained very active throughout her life and continued to walk two miles a day until her late 80's. Tomo will live forever in the hearts of those who encountered her. In her honor, may we all strive to emulate the poise she possessed, the drive that kept her motivated and the warmth that was sensed by all those she touched throughout her life.
