ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO
FILE NOTICE OF COMPLETION FOR RED HILL AVENUE MEDIAN
LANDSCAPING FROM EDINGER AVENUE TO WALNUT AVENUE
(ClP NO. 7124)
SUMMARY
Construction of the Red Hill Avenue Median Landscaping Project (ClP No. 7124) has been
completed to th'e satisfaction of the City Engineer and is now ready for City Council acceptance.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 01-74 accepting the construction of
the Red Hill Avenue Median Landscaping Project from Edinger Avenue to Walnut Avenue and
authorizing the recordation of the Notice of Completion, and direct the City Clerk to'

Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of
recordation of the Notice of Completion; and
.
Release the Faithful Performance Bond not sooner than one year after the date of
recordation of the Notice of Completion.
Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date
of recordation of the Notice of Completion the City Council authorize payment of the final 10%
retention in the amount of $19,363.70 to S & M Landscape, Inc. This amount together with
previous payments of $174,273.30 represents 100% of the final contract cost.
FISCAL IMPACT
The final construction cost for this project was $193,637.00, which included installation of the
landscaping and irrigation within the Red Hill Avenue medians between Edinger Avenue and
Walnut Avenue. The 2000-2001 Fiscal Year Capital Improvement Program Budget provided
sufficient funding for this project.
BACKGROUND
The first phase of work on Red Hill Avenue between Edinger Avenue and Walnut Avenue was the
street rehabilitation project, which was completed in May 2000. This phase also included the
replacement of the median island curbs and the removal of the existing turf, trees and irrigation
systems.

The median landscaping project is the second phase of work and included the installation of
drought tolerant shrubs and trees. A Iow flow irrigation system was also installed to eliminate
runoff onto the street. Brick pavers were-utilized as the hardscape treatment at the ends of the
median islands. Construction has been completed to the satisfaction of the City Engineer and the
project is now ready for City Council acceptance.

RESOLUTION NO. 01-74
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR
THE RED HILL AVENUE MEDIAN LANDSCAPING FROM EDINGER
AVENUE TO WALNUT AVENUE (CIP NO. 7124)

WHEREAS, S & M Landscape, Inc. having a contract with the City of
Tustin to construct the hereinafter described public works and improvements;
and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public works and improvements hereinafter mentioned in a
manner satisfactory to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed
said public works and improvements hereinafter more particularly described
in accordance with the provisions of the contract documents and the Notice of
Completion, and acceptance of said public works and improvements should
be filed and payment of the balance due said contract authorized in
accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of. the City
of Tustin that said public works and improvements are found to be complete,
and the same is hereby accepted. Said public works and improvements are
more particularly described as follows:
RED HILL AVENUE MEDIAN LANDSCAPING FROM EDINGER AVENUE
TO WALNUT AVENUE (CIP NO. 7124)
BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin
is hereby authorized to execute and file a Notice of Completion for the
acceptance of said public works and improvements described herein as
required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the
City of Tustin held on the 16th day of July 2001.
