HomeMy WebLinkAboutCC RES 98-22 1 RESOLUTION NO. 98-22 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP 15420 LOCATED ON LOT 4 OF TRACT 12870, NORTH OF TOWNSHIP 4 DRIVE OPPOSITE OF CLEARY COURT. 5 6 The City Council of the City of Tustin does hereby resolve as follows: 7 8 I. The City Council finds and determines as follows: 9 A. That Final Tract Map 15420 has been submitted by John Laing Homes ("the Subdivider"); 10 B. That a public hearing was held by the Planning 11 Commission on October 27, 1997. At this hearing, the Planning Commission recommended that the City 12 Council approve Vesting Tentative Tract Map 15420. Subsequently, the City Council- approved Vesting 13 Tentative Tract Map 15420 on November 3, i997; 14 C. Pursuant to Section 15268(b) (Ministerial Projects) of the California Environmental Quality Act (CEQA), 15 the Final Map is considered statutorily exempt from · the requirements of CEQA. 16 D. That the proposed subdivision is in substantial 17 conformance with the Tustin General Plan, the Tustin Zoning Code and Subdivision Map Act; 18 Eo The 0.9450 acres of parkland required for this 19 development was previously dedicated with recordation of Tract 12870; 20 F. That the City has reviewed the status of the School 21 'Facilities Agreements between .the Irvine Company and the Tustin Unified School District for the 22 impact of Vesting Tentative Tract 15420~on School District facilities, and changes in state law. 23 Impacts associated with this approval on School District facilities are adequately addressed; 24 G. That the site is physically suitable for the type 25 of development proposed; 26 H. That the site is physically suitable for the proposed density of development; 27 28 Resolution No. 98-22 Page 2 1 2 I. That the design of the subdivision or the proposed improvements are not likely to cause substantial 3 environmental damage or substantially and avoidably injure fish or wildlife in their habitat; 4 J. That the design of the subdivision or the type of 5 improvements proposed will not conflict with easements acquired by the public-at-large, for 6 access through or use of the property within the proposed subdivision; 7 K. That the design of the subdivision or the types of 8 improvements proposed are not likely to cause serious public health problems; and, 9 L. That the Final Map is in substantial conformance 10 with the Vesting Tentative Tract Map. 11 II.
