A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP 15474

The City Council of the City of Tustin does hereby resolve as
5 follows:
6 I. The City Council fin~s and determines as follows:
7 A. That Final Tract Map 15474 has been submitted by
Baywood Development Group ("the Subdivider");
8
B. That a public hearing was held by the Planning
9 Commission on April 28, 1997. At this hearing, the
Planning Commission recommended that the City
10 Council approve Tentative Tract Map 15427.
Subsequentlyf the City Council approved Tentative
11 Tract Map 15427 on May 5, 1997;
12 C. That, pursuant to Section 66456.1 of the
Subdivision Map Act, the Subdivider intends to file
13 multiple final maps in relation to approved
Tentative Tract Map 15427. Final Tract Map 15474
14 is the second such final maps;
15 D. Pursuant to Section 15268(b) (Ministerial Projects)
of the California Environmental Quality Act (CEQA),
16 the Final Map is considered statutorily exempt from
the requirements of CEQA.

E. That the proposed subdivision is in substantial
1-8 conformance with the Tustin General Plan, the
Tustin Zoning Code and Subdivision Map Act;

F. The 0.4452 acres of parkland required for this
20 development were previously dedicated with
recordation of Tract 15055;

G. That the City has reviewed the status of the School
22 Facilities Agreements between the Irvine Company
and the Tustin Unified School District-for the
23 impact of Tentative Tract 15427 on School District
facilities, and changes in state law. Impacts
24 associated with this approval on School District
facilities are adequately addressed;

H. That the site is physically suitable for the type
26 of development proposed;

I. That the site is physically suitable for the
3 proposed density of development;
4 J. That the design of the subdivision or the proposed
improvements are not likely to cause substantial
5 environmental damage or substantially and avoidably
injure fish or wildlife in their habitat;

K. That the design of the subdivision or the type of
7 improvements proposed will not conflict with
easements acquired by the public-at-large, for
8 access through or use of the property within the
proposed subdivision;

Lo That the design of the subdivision or the types of
10 improvements proposed are not likely to cause
serious public health problems; and,
11
M. That the Final Map is mn substantial conformance
12 with the Vesting Tentative Tract Map.
13 II. The City Council hereby approves Final Tract Map 15474,
subject to the posting of all required bonds and
14 agreements pursuant to Exhibit A of Planning Commission
Resolution No. 3522 and final approval by the City
15 Attorney and City Engineer.
16 PASSED AND ADOPTED at a regular meeting of the Tustin City
Council, held on the 16th day of March, 1998.
