A RESOLUTION.OF THE C1TY COUNCIL OF THE CITY OF TUSTIN,
3 CALIFORNIA OPPOSING THE "GOVERNMENT COST SAVINGS AND
TAXPAYER PROTECTION AMENDMENT" INITIATIVE

WItEREAS, State, regional and local governments are currently allowed the
6 flexibility to contract with private firms, on a competitive basis to design .public projects; and
7 WHEREAS, This process allows government at all levels the ability to use private
firms to deliver a project on-time and cost effectively; and

9 WItE~S, The "Government Cost Savings and Taxpayers Protection Amendment"
to the California Constitution completely changes the process by giving the state bureaucracy
10 a virtual monopoly on design every project; and
11 WltEREAS, This state constitutional amendment will force cities, counties, schools,
special districts, regional governments and many private businesses to use the state
12 bureaucracy to design roads, parks, hospitals, health clinics, schools, water treatment facilities,
13 flood control facilities, and other critical structures, including all engineering design,
geological and environmental work; and

WHEREAS, The initiative gives one elected official, the State Controller, enormous
15 power to decide who gets tens of thousands of proposed contracts per year potentially worth
billions of dollars; and

17 WHEREAS, The state controller would have to analyze tens of thousands of
proposed contracts per year costing taxpayers hundreds of thousands of dollars, if not millions,
18 in additional expenses; and
19 WHEREAS, To meet potential workload demands, hundreds, if not thousands, of
20 additional state employees would be required to perform the tasks required to implement this
initiative; and

WltEREAS, Local governments would not be able to hold the state bureaucracy
22 accountable; and
23 WHEREAS, The initiative would likely result in the delay of hundreds of local,
24 regional and state projects.
25 NOW, TItEREFORE, BE IT RESOLVED by the City Council of the City of
Tustin

1. Opposes the "Government Cost Savings and Taxpayers Protection Amendment" due
27 to the potential economic costs to loc~ government and taxpayers and
1 2. Directs the City Manager to forward this resolution tO the League of California Cities
and other individuals and organizations deemed appropriate.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
3 Tustin held on the 16th day of March 1998.
