RECOMMENDATION
That the Planning Commission adopt Resolution No. 3959 approving an amendment to
Conditional Use Permit 04-015 amending the partial master sign program and
establishing a complete master sign program for The District at Tustin Legacy.
BACKGROUND
The "District at Tustin Legacy" has been approved by the Planning Commission and
City Council and includes 1,006,100 square feet of commercial development to be
located on approximately 111.77 gross acres within Planning Areas 16, 17, and 19 of
the MCAS Tustin Specific Plan. The site is bounded by future Warner Avenue to the
north, future Tustin Ranch Road to the west, the existing Army Reserve site to the
southwest, Barranca Parkway to the south, and Jamboree Road to the east.
On July 26, 2004, the Planning Commission approved a partial master plan for the center
(Attachment B). As a condition of approval, a complete master sign program that
includes exhibits, graphics, and criteria for all sign types (Le. pylon, monument, wall,
photographic "lifestyle images," directional, etc.) was required to be submitted. The
applicant has submitted a complete master sign program that includes deviations from
the Tustin City Code in accordance MCAS Tustin Specific Plan Section 3.12.1.C, which
requires a master sign program is required for new multi-tenant developments.
Section 9404.b.6 of the Tustin City Code provides for a process in which a conditional use
permit could be considered by the Planning Commission for a master sign program with
elements that deviate from standards contained in the City's Sign Code provided that the
project is located within a center with at least thirty thousand (30,000) square feet of
building area; The District at Tustin Legacy is approved for up to 1 ,006,100 square feet of
building area.
DISCUSSION
The complete master sign program is included as Attachment C. The following table
identifies sign elements that are generally the same as the previously approved partial
sign program:

The following wall signs have been added to the partial master sign program:

Major Tenant Primary Storefront Identify Sians: Each major tenant that occupies
more than 20,000 square feet would be allowed one (1) primary sign on the
storefront that is 1 .25 square feet of signage per linear foot of storefront, up to a
maximum of 350 square feet.
Major Tenant Secondary Identify Sians: Each major tenant that occupies more
than 20,000 square feet would be allowed up to two (2) secondary signs that are
1.25 square feet of signage per linear foot of a rear or side wall (only for corner
tenants), up to a maximum of 300 square feet.
Non-Major Tenant Primary Storefront Identity Sians: Each non-major tenant that
occupies less than 20,000 square feet would be allowed one (1) primary sign that
is 1 .25 square feet of signage per linear foot of storefront, up to a maximum of
225 square feet.
Non-Major Secondary Sians: Each non-major tenant that occupies less than
20,000 square feet would be allowed up to two (2) secondary signs on a rear and
side wall (only for corner tenants) up to a maximum of 175 square feet.

These signs would deviate from the provisions of the Tustin City Code, which allows
individual tenant wall signs up to a maximum of seventy-five (75) square feet and
secondary wall signs up to twenty-five (25) square feet.
In addition, wall signs are typically calculated as a percentage of the attached wall
elevation (15 percent for primary elevations and 5 percent for secondary elevations),
with a maximum square footage as previously noted. However, the proposed wall signs
would be calculated by multiplying the linear feet of the applicable wall by 1.25. Given
an average height of thirty (30) feet for the buildings within the center, this method
generally results in generally less than five (5) percent of the wall face. Due to the
nature of the project as a regional attraction and large size of the buildings, allowing the
signs to exceed the maximum square frontage of the Tustin City Code and allowing

1.25 square feet per linear foot of wall area would be appropriate and ensure that the
signs are in scale with the buildings.
In addition, a number of sign types are proposed that are not addressed by the Tustin
Sign Code:
. Lifestyle Center Portal Identity Wall Sign - An eighteen (18) foot tall and thirty-
eight (38) foot wide center identification wall sign with internally illuminated panel
with dimensional letters and graphics would be located on the northern elevation
of the Lifestyle Center above the portal entry into the Lifestyle Center;
Blade Signs:
0 Lifestyle Center Blade Sign - A 8'-8" wide by 34'-10" tall center
identification sign attached to the east elevation of the Lifestyle Center,
positioned perpendicular to the wall face approximately fifteen (15) fee
above the ground;
Tenant Blade Sign - Specific tenants, as identified in the master sign
program, will be allowed a sign to be placed perpendicular to the store
front, at a height of nine (9) feet above the ground, at a maximum size of
one (1) square foot per linear foot of store frontage;
Pedestrian Directional Sign - Informational signs will be placed
perpendicular to building walls throughout the center at a height of ten (10)
feet, at a maximum size of 2'-5" wide by 3'-3" high;
Awning Signs - Non-major tenants will be allowed one (1) awning sign where
architecturally appropriate, with a maximum of eight (8) inch letters on the top
sloping edge of a fabric valance over the storefront, as shown in the master sign
program;
Canopy Signs - Non-major tenants will be allowed one (1) canopy sign where
architecturally appropriate, with a maximum of 1 '-8" freestanding letters on a
metal canopy over the storefront, as shown in the master sign program;
Lifestyle Super Graphics - Large, non-tenant specific wall graphics will be place
in designated "frames" on wall elevations shown in the master sjgn program.
Advertising will not be permitted in the images since they are intended to simply
enhance the overall center design and energy. They will be maintained by the
Landlord and per the specifications included in the master sign program
While these sign types are not defined by the Tustin Sign Code, they would be an
integral part of creating a lively pedestrjan atmosphere jn a large scale retaj and
entertainment center and would be compatible with the architecture of the buildings.

FINDINGS
Findings to approve the master sign program are contained wjthjn Resolutjon 3959 for the
Planning Commission's consideration. To ensure that the master sign program can be

successfully implemented, a number of conditions of approval are included in Resolution
3959 that require minor refinements to the master sign program. The sign program will be
recorded with the covenants, conditions, and restrictions (CC&Rs) for the project.

1 INTRODUCTION
11 This master sign program / criteria establishes
requirements for the design and fabrication of all
signage at The District at Tustin Legacy, including
primary identification signs, secondary identification
signs and directional/informational signage. The
objective is to create unique and high quality signage,
which is an integral part of the architecture and
image of The District. The intent of this criteria is to
insure that tenant signage in the District is designed
and executed in a manner which will achieve these
objectives while providing superior identification of
tenants and tenants' business, including incorpora-
tion of brand identification. All tenant signage shall be
subject to landlord's prior written approval as provided
in this criteria where consistent with this criteria. All
signage must comply with all applicable codes and
standards.
2. TENANT SIGN CRITERIA
21 The following outline are works to be provided by the
tenant and or landlord. Tenant signage shall be de-
signed, fabricated and installed by the tenant at their
own expense. Tenant signage must be constructed
from durable materials and shall be maintained by the
Tenant.
22 Please refer to the Key Plan (pages 8-13) on each
exhibit for sign locations. Specific criteria may apply
based on the location of your Tenancy. Tenants are
encouraged to be creative with the development of
environmental graphics as a part of their image. Full
size mock-ups of all signs may be required. Mock-ups
may be constructed from foam core or illustration
board. The Landlord reserves the right to test the Ten-
ant's Mock-up sign in relationship to site conditions,
prior to approvals. All Tenants are required to supply
material and paint samples to Landlord and Designer
for approval. In some instances a partial or full size
prototype of the Tenant's sign may be required also.
J. SIGN TYPES (GENERAL)
3.1 DISTRICT & COMMUNITY IDENTITIY PORTAL SIGNS
SIGN TYPE 1
The District at Tustin Legacy shall be identified with
three (3) primary (monument style) signs positioned
along Barranca Parkway, Tustin Ranch Road, and
Warner Avenue. Content of these signs shall be limited
to "The District" and "Tustin Legacy" names only.
These signs serve as the principal project identifiers.
32 MULTI-TENANT PYLON SIGN
SIGN TYPE 2
A total of four (4) 25-foot high freestanding pylon
signs will be allowed along Jamboree Road, and three
(3) multi-tenant freestanding 25-foot high pylons allowed
along Tustin Ranch Road. Each pylon sign will accom-
modate up to three (3) tenants per sign, per face.
The seven (7) multi-tenant signs will allow for up to
twenty-one (21) unique tenant names total.
u SINGLE AND MULTI-TENANT PYLON SIGNS
SIGN TYPE 3
Four (4) 14-foot high single tenant pylons located along
The South Loop Road shall be allowed. All signs are

Six (6) single tenant monument signs will be allowed.
These signs shall be positioned along The South Loop
Road (3) to the north and (3) to the south.

SIGN TYPE 5
Eight (8) freestanding, vehicular directional signs
strategically positioned on property will serve to guide
and inform patrons of The District. These signs shall
include both generic verbiage, and tenant names as
appropriate by location.

SIGN TYPE 6
The District at Tustin Legacy will offer up to eigh-
teen (18) special feature graphics which embellish
the palm trees along an East / West axis of the
project. These signs display lifestyle, and project
identity media.
3.7 LIFESTYLE CENTER BLADE SIGN
SIGN TYPE 7
A principal identity sign will establish the Eastern
entry portal to the lifestyle center. This Sign will be
limited to the project name 1 logo only. Refer to page
36 for specific design criteria.

Throughout The Center there are certain areas
designated for large scale lifestyle graphics. These
graphics are maintained by The Landlord. The visual
content will vary by location and is subject to approval
by the City of Tustin.
Jill PEDESTRIAN DIRECTIONAL SIGN
SIGN TYPE 10
Within The District at Tustin Legacy Lifestyle Center
there will be (6) six directional & informational signs
required. These signs will be strategically located to
aid in the circulation of pedestrian traffic. The signs
will display public facilities & some generic retail
information. Refer to pp 14 -16.
3.11 DIRECTORY SIGN
SIGN TYPE 11
Four (4) freestanding directories will be allowed for
at The District at Tustin Legacy. These directories will
contain custom map art and changeable tenant name
and listings. Some advertising components may also
be incorporated. Refer to pages 11,13,14 & 17 for
specific locations.
:\12 WEST ARRIVAL WALL IDENTIFICATION
SIGN TYPE 12
One Wall sign consisting of individual letters which
read: The District will be integrated into an illuminated
architectural feature at the West arrival porte-cochere.
3.13 PRINCIPAL WATER FEATURE SIGN
SIGN TYPE 13
Large freestanding individual letters which read The
District at Tustin Legacy shall be incorporated into
a principal masonry water feature occurring at the
corner of Barranca Parkway and Jamboree Road. This
sign shall be illuminated internally and indirectly.
4. SIGN TYPES (TENANT)
4.1 MAJOR TENANT PRIMARY STOREFRONT IDENTITY
Major tenants are defined as any tenant occupying a
minimum of 20,000 square feet.
4.1 Major tenants are allowed one primary sign or graphic
treatment at their primary storefront entry. The sign
shall be limited to the business name or brand logo.
Major Tenants are allotted a total of 1.25 square feet
of signage per each linear foot of storefront. Maxi-
mum sign area for any major tenant not to exceed
350 square feet unless approved otherwise. Ad-
ditionally, Major tenants will be allowed one or more
secondary identity signs.
4.2 The Primary Sign, including structure and graphic
elements, shall be within the limits of the approved
sign types which vary from building to building. Ten-
ant signage shall conform to the application of their
specific zone. Sign Letter-height may vary but shall
fall within the limits of the maximum sign area. Sign
elements may project a maximum of 2'-0" beyond
lease line.
4.3 MAJOR TENANT SECONDARY IDENTITY
Major tenants shall be allowed a second identification
sign on the back side of their building facing either
Jamboree Road or Tustin Ranch Road. End Tenants
are allowed up to two (2) secondary signs. Unless
otherwise approved Secondary signs shall be limited
to 1.25 square feet of signage per each linear foot
of storefront. Maximum sign area not to exceed 300
square feet.
4.4 LIFESTYLE GRAPHICS
Major tenants are allowed one or more Lifestyle
graphics on their building exterior. These graphics
may vary in size and will be limited to a maximum of
250 square feet. Refer to architectural elevations and
pages 38 & 39 for specific criteria.
4.5 NON-MAJOR PRIMARY
TENANT STOREFRONT IDENTITY
Non-major tenants are defined as any tenant occupy-
ing less than 20,000 square feet.
4.6 Non-major tenants are allowed one primary sign or
graphic treatment at their principal storefront entry.
The sign shall be limited to the business name or
brand logo. Non-major tenants are allotted a total
of 1 .25 square feet of signage per linear foot of
storefront. Maximum sign area for any non-major ten-
ant not to exceed 225 square feet unless approved
otherwise. Additionally, Non-major tenants will be
allowed a secondary identity sign if they are situated
on a corner.
4.7 The primary sign shall not impede Landlord's Neutral
Piers more than 2'-0". Sign elements may project a

maximum of 2'-0" beyond lease line. No electrical or
structural members shall penetrate the "Shell Build-
ing" including Bulkhead and neutral piers. Additional
structural upgrades will require written approval by
Landlord and will be designed by Landlord's structural
engineer at Tenant's expense.
4B NON-MAJOR TENANT SECONDARY IDENTITY
Non-major tenants shall be allowed a second iden-
tification sign if their building is situated on a corner
or has multiple storefronts. Maximum sign area for
any non-major tenant not to exceed 175 square feet
unless approved otherwise.
4[¡ TENANT BLADE SIGN
Blade signs are required within specific zones. Refer
to plan exhibits for location (pages 12-17). Specific
Tenants shall be allowed one custom blade sign
designed by the owner's sign consultant on a Tenant
by Tenant basis. These signs will be limited to one
(1.25) square feet per each linear foot of storefront.
All blade signs will have internal or indirect illumina-
tion. The sign panel must maintain a clearance height
of 9'-0" from the finished floor.
4.10 AWNING
Non-major tenants shall be allowed one awning sign
where applicable to their storefront. Awning is a sign
which is displayed directly on the top sloping edge
of the fabric and or fabric valance. The tenant will be
allowed to display their logo or logotype only on the
sloping awning. Lettering only will be allowed on the
valance and may not exceed 8" in height. The maxi-
mum allowable sign area is limited to 1.5 square feet
per each lineal foot of awning. Signs and graphics that
are not permitted on the fabric awning:
.. Pressure sensitive graphics
» Illuminated or pin-mounted letter-form
" Eradicated (cut out).
4,11 Tenants are encouraged to bring a sculptural & di-
mensional quality to their signs. Letters and graphics
using depth will be looked upon more favorably than
less dimensional graphics, Maximum of three signs or
graphic treatments are allowed per tenancy.
4,12 following signs are permitted within the limits of the
established sign areas for specific buildings:
4,11 WINDOW SIGN & GRAPHIC
All tenants are allowed window graphics. Window
graphics are signs which are applied directly to the
store front glass. Tenants may incorporate window
graphics onto their storefront glazing in addition to
their primary sign. The graphic elements are allot-
ted a maximum of 1 0% of total window area. Such
elements will be permitted: non-illuminated, etched,
painted or screen-printed onto window. The following
window graphics are not permitted:

.. Posters, advertising, or menus
., Stickers or adhesive graphics
, Vinyl cut letters
5. TENANT ADDRESS NUMERALS
landlord will provide tenant storefront address num-
bers in a standardized format.

" FABRICATION & INSTAllATION
It is intended that all finished work be of the highest
quality to pass eye-level examination and scrutiny by
the Landlord and Designer.
0.1 GENERAL FABRICATION SPECIFICATIONS
.. Construct all work to eliminate burrs, dents, cutting
edges, and sharp corners.
" Finish welds on exposed surfaces to be imperceptible
in the finished work.
.. Surfaces which are intended to be flat shall be with-
out dents, bulges, oil canning, gaps, or other physical
deformities.
, Except where approved otherwise by Landlord and
Designer, conceal all fasteners.
Make access panels tight-fitting, light proof, and flush
with adjacent surfaces.
, Carefully follow manufacturer's recommended fabri-
cating procedures regarding expansion / contraction,
fastening, and restraining of acrylic plastic.
Exercise care to assure that painted, polished, and
plated surfaces are unblemished in the finished work,
tU SIGNAGE CONSTRUCTION
Many signs require technical details to address struc-
tural and electrical needs. When developing these
sign details be sure to include the following details, if
applicable:
.. All transformers must be concealed within tenant
spaces.
,', Raceways can not be exposed.
^' All conduit must be rigid metal and concealed.
.. Fasteners and attachment connections should be

concealed from view.
.' Mounting pins and brackets should as thin as pos-
sible.
" Suspended signs should have ring or loop connec-
tions when possible to allow for sign movement.
Chains or cables may be necessary to limit move-
ment.
0 Lamp selection and aiming should be carefully con-
sidered to reduce glare for pedestrians and provide
appropriate accent lighting.
7. SIGN LIGHTING
7.1 All primary and secondary sign elements must be
internally and/or externally illuminated except for
window graphics. Hot spots and light leaks are not
permitted and must be repaired by the Tenant.
7.2 All illuminated signs shall be fabricated, installed, and
comply with national/local building and electrical
codes and shall bear the U.L. label. All signs must
conceal all identification labels and U.L. labels to
conform to U.L. Codes. All conductors, transformers,
cabinets, housings, and other equipment shall be
concealed and/or incorporated into storefront and/or
sign components permitted and must be repaired by
the Tenant. All illuminated signs shall be fabricated,
installed, and comply with national/local building and
electrical codes and shall bear the U.L. label. All signs
must conceal all identification labels and U.L. labels
to conform to U.L. Codes. All conductors, transform-
ers, cabinets, housings, and other equipment shall be
concealed and/or incorporated into storefront and/or
sign components. To protect the visual environment,
all Tenant's light fixtures in regards to brightness and
glare shall be subject to approval. Tenant's primary
sign, secondary sign (if applicable), canopy and blade
sign shall remain illuminated after hours as designat-
ed by the Landlord. Lighting in this zone is required
to be circuited and sw!tched separately from other
store fixtures on the Tenant's panel and controlled by
a time-dock. Tenant shall provide a disconnect switch
at sign transformer or near electrical junction box.
H. PERMITTED SIGNS
The following construction methods are permitted,
other conditions are subject to approval:
8.1 Reverse channel dimensional halo-lit letter-forms.
8.2 Open pan channel metal halo-lit letter-forms with
exposed neon faces (Lifestyle Center only).
8.3 Dimensional graphics with indirect light source such
as a spot light or picture light.
11.4 Routed metal face with push-through acrylic letter-
forms.
8.5 Routed metal face with flush acrylic letter-forms.
9. PROHIBITED SIGNS

10. TENANT SIGNAGE SUBMISSION
These signage requirements and approvals process
have been reviewed by the City of Tustin. The guide-
lines are specific to The District at Tustin Legacy and
may differ from the general requirements for signage
in other parts of the City. However, as signage is
an integral part of the development of The District
at Tustin Legacy, these more specific requirements
have been adopted. The Landlord, through his Design
Consultant, must approve any and all signage prior
to submittal to the City of Tustin Planning & Building
Divisions. The City will not issue signage permits
without original documents indicating the Design
Consultant's or designee's approval.
10.1 Tenant obtains approval from Design Consultant.
., Read this booklet in its entirety before proceeding
with signage design.
"If you have any questions, please contact the Design
Consultant.
" Submit a minimum of two (2) sets of final detail draw-
ings to the Design Consultant for review and approv-
al. Incomplete submissions to the Design Consultant
will be returned without review. The submission must
include the size and dimensions of all signs, letter
heights, materials, specified colors and color chips,
mounting details of all signs, graphic representation
of all signage in relation to the storefronts). including
exact location of signs, and any other requirements
specified by the City of Tustin Planning and Building
Divisions. The Design Consultant will retain one (1)
complete set on file in his / her office. Only when the
final design sets have been returned with the Design
Consultant's approval may the tenant apply for City
approval.
10.2 Tenant shall submit plans and other required materials
to the city of Tustin Planning and Building divisions for
sign permit and building permit pursuant to the city's
application processes.
10.3 Tenant submits shop drawings (if required by Design
Consultant) to Design Consultant for approval.
,> Shop drawings may not be necessary for all signs;
i.e., certain patio signs, or signs with simple detailing,
sufficient to be seen from the approved design set,
etc. The Design Consultant will inform the tenant on
the comments line of the wet stamp if this step is
required.
10.4 Tenant directs signage to be fabricated and installed
after Design Consultant's approval, City approval,
and Design Consultant's shop drawing approval (if
required) are obtained.
" Fabricate and install only after all required approvals,
including shop drawing approvals, have been obtained
and verified by the Design Consultant.
¡[¡.5 Tenant obtains Design Consultant and City of Tustin
Building Division's final approval in an on-site inspec-
tion of completed signage.
Contact the Design Consultant and City of Tustin
Building Division upon completion of installation of
signage for on-site inspections and final approvals.
Tenants may be required to redo signage if a sign
does not conform with the approved drawings.

THE CITY OF TUSTIN, AMENDING CONDITIONAL
USE PERMIT 04-015 TO AMEND THE PARTIAL
MASTER SIGN PROGRAM FOR THE DISTRICT AT
TUSTIN LEGACY BY ESTABLISHING A COMPLETE
MASTER SIGN PROGRAM
The Planning Commission does hereby resolve as follows:
I.
The Planning Commjssjon fjnds and determines as follows:
A.
That a proper request to amend Conditional Use Permit 04-015 has been
filed by the Vestar Development Company/Kimco Tustin loP. requesting
authorization to amend the partial master sign program for The District at
Tustin Legacy, approved on July 26,2004, to establish a complete master
sign program that would allow deviations from the Tustin City Code for
freestanding signs, wall signs, and specialty signs such as lifestyle center
blade, tenant blade, pedestrian directional, lifestyle super graphics,
awning, and canopy signs that are currently undefined by the Tustin Sign
Code.
B.
That the proposed project is located within the "MCAS Tustin Specific
Plan" land use designation of the General Plan, which provides for
commercial development and conforms to the MCAS Tustin Specific Plan,
in that a master sign program that deviates from standards in the Tustin
Sign Code is conditionally permitted in all specified planning areas of the
MCAS Tustin Specific Plan. In addition, the project is consistent with the
Air Quality Sub-element of the City of Tustin General Plan.
C.
That a public hearing was duly called, noticed, and held for said
application on January 24, 2005, by the Planning Commission.
D.
That a master sign program in conjunction with the development of
1,006,100 square feet of commercial uses will not be detrimental to the
health, safety, morals, comfort, or general welfare of the persons residing or
working in the neighborhood of the proposed uses, nor be injurious or
detrimental to the property and improvements in the neighborhood of the
subject property, or to the general welfare of the City of Tustin in that:
1. Pursuant to Tustin City Code Section 9403h2.(e), with the approval
of a Conditional Use Permit, the Planning Commission is authorized
to approve a master sign plan that deviates from the requirements of
the Tustin Sign Code for properties located within a center with at
least thirty thousand (30,000) square feet of building area. The
property is proposed for 1,006,100 square feet of building area;

2. As proposed, the large freestanding signs are generally consistent
with the quantities, sizes, and locations of the signs approved by the
Planning Commission on July 26, 2004. The design of these signs
has been revised to complement the building architecture;
3. As proposed, the signs are approprjate for The District at Tustin
Legacy since it is a large scale development with large building
masses that will contain services for residents and businesses in
and outside of the City of Tustin;
4. The number, size, and design of the freestanding signs, wall signs,
blade signs, awning signs, canopy signs, and lifestyle super graphics
in the Master Sign Plan would be an integral part of creating a lively
pedestrian atmosphere in the center; and,
E.
5. The signs would be constructed of high quality design and materials
and complement the architectural style of the buildings.
This project is Categorically Exempt pursuant to Section 15311, Class 11 of
the California Code of Regulations (Guidelines for the California
Environmental Quality Act).
II.
The Planning Commission hereby amends Conditional Use Permit 04-015
authorizing an amendment to the partial master sign program for The
District at Tustin Legacy (Tract 16695), approved on July 26, 2004, to
establish a complete master sign program that would allow deviations
from the Tustin City Code for freestanding signs, wall signs, and specialty
signs such as lifestyle center blade, tenant blade, pedestrian directional,
lifestyle super graphics, awning, and canopy signs that are currently
undefined by the Tustin Sign Code, subject to the conditions contained
within Exhibit A attached hereto.
PASSED AND ADOPTED by the Planning Commission of the City of Tustin, at a

All signs shall substantially conform with the submitted master sign program
for The District at Tustin Legacy date stamped January 24, 2005, on file with
the Community Development Department, except as herein modified, or as
modified by the Director of Community Development in accordance with this
Exhibit. The Director of Community Development may also approve minor
modifications to the master sign program if such modifications are to be
consistent with the provisions of the Tustin City Code and other applicable
codes.
Unless otherwise specified, the conditions contained in this Exhibit shall be
complied with as specified or prior to the issuance of any sign permits for the
project, subject to review and approval by the Community Development
Department. If a conflict exists between any provision of this approval or
any other provision contained herein or incorporated by reference and the
Tustin Legacy Disposition and Development Agreement (DDA) for Retail
Development (Tract 16695) dated July 20, 2004, the relevant provjsions of
the DDA shall prevail.
Amendment of Conditional Use Permit 04-015 is contingent upon the
applicant and property owner signing and returning to the Community
Development Department a notarized "Agreement to Conditions Imposed"
form and the property owner signing and recording with the County Clerk-
Recorder a notarized "Notice of Discretionary Permit Approval and
Conditions of Approval" form. The forms shall be established by the Director
of Community Development, and evidence of recordation shall be provided
to the Community Development Department.
As a condition of approval of the amendment of Conditional Use permit 04-
015, the applicant shall agree, at its sole cost and expense, to defend,
indemnify, and hold harmless the City, its officers, employees, agents, and
consultants, from any claim, action, or proceeding brought by a third-party
against the City, its officers, agents, and employees, which seeks to attack,
set aside, challenge, void, or annul an approval of the City Council, the
Planning Commission, or any other decision-making body, including staff,
concerning this project. The City agrees to promptly notify the applicant of
any such claim or action filed against the City and to fully cooperate in the
defense of any such action. The City may, at its sole cost and expense, elect
to participate in defense of any such action under this condition.

Any violation of any of the conditions imposed is subject to the payment of a
cjvj penalty of $100.00 for each violatjon, or such other amounts as the City
Council may establish by ordinance or resolution, and for each day the
violation exists, subject to the applicable notice, hearing, and appeal process
as established by the City Council ordinance.
The applicant shall be responsible for costs associated with any necessary
code enforcement action, including attorney fees, subject to the applicable
notice, hearing, and appeal process as established by the City Council by
ordinance.
All applicable findings and conditions of approval within Resolution No. 3923
approving Conditional Use Permit 04-015 shall continue to apply.
MASTER PLAN REVISIONS

Prior to approval of the final tract map, the applicant shall submit an 8% by
11 inch color version of the complete master sign program and an 8% by 11
inch black Ijne versjon of the complete master sign program for recordation
with the covenants, conditions, and restrictions (CC&Rs) for Tract 16695.
Prior to submittal, the master sign program shall be revised to incorporate
the following:
a.
The applicant shall define which tenants (Le., major tenants
occupying a minimum of 20,000 square feet) are eligible to be located
on the Single Tenant Monument Sign.
b.
The applicant shall include Sign Type exhibits for all tenant signs with
notes on the method of calculating sign area and maximum sign
area, including Major Tenant Primary Storefront Identity Signs, Major
Tenant Secondary Identity Signs, Non-Major Tenant Primary Store
Front Sign, Non-Major Secondary Sign, Tenant Blade Sign, Tenant
Canopy Sign, Tenant Awning Sign
c.
The applicant shall delete 4.12 on page 5.
The applicant shall add a description to page 5 for the "Tenant
Canopy Sign" to correspond with the exhibit on page 47.
d.
e.
The applicant shall clarify the location of the "covered canopy" sign
area on page 17.
f.
The applicant shall delete any reference to, "unless otherwise
approved." The text of the master sign program shall control the
requirements for all signs.
g.
The applicant shall delete any reference to City approval of the
content of lifestyle graphics and replace with a general statement that
only lifestyle images that relate to the nature of the center shall be

applicable pages to facilitate recordation of the master sign program

The master sign program shall be recorded with the covenants, conditions,

The numbers, quantities, and characteristics of all signs at the project site
shall conform to the approved master sign program. No sign shall be
constructed, erected, altered, replaced, moved, or painted unless the sign
conforms to the master sign plan.
A sign permit shall be applied for and recejved from the Community
Development Department prior to constructing, erecting, altering,
replacing, moving, or painting any sign pursuant to the Tustin Sign Code.
Prior to submittal of sign plans to the City of Tustin or issuance of sign
permits, all proposed signs shall be approved by the Design Consultant
and the Landlord, as designated in the master sign program. The Design
Consultant and Landlord shall affix an approval stamp or signature on the
plans submitted to the City.
Signs shall be designed to direct/inform both pedestrians and motorists.
The minimum letter size shall be six (6) inches to ensure legible signs.
Freestanding signs shall be located in a landscaped area and located on
private property outside of the right-of-way, including along South Loop
Road where landscaping improvements have been allowed to encroach
into the ninety-two (92) foot wide right-of-way. Prior to issuance of any
building and/or sign permits, the applicant shall obtain necessary approval
from the Public Works Department to ensure no part of any sign would
encroach on the future right-of-way.
Signs shall not be placed in a manner that will obstruct or inhibit sight
distance or visibility for the motorist.
PLAN SUBMITTAL

At the time of building and/or sign permit application, the plans shall comply
with the most recently adopted codes. The City is currently using the 2001
California Building Code (CBC) and 2001 California Electrical Code (CEC).
In addjtjon, the plans shall demonstrate that all sjgns shall be installed with
adequate horizontal and vertical intersection sight lines and entirely outside
of the public right-of-way within a landscape planter. Additional sight
evaluation could be required to satisfy the City's Standard Drawings and

Design Standards for Public Works Construction No. 510 for all affected
streets.
Prior to issuance of any building and/or sign permits, payment shall be made
of all applicable fees, including but not limited to, the following. Payment
shall be required based upon those rates in effect at the time of payment
and are subject to change.
A. Building plan check and permit fees to the Community Development
Department based on the most current schedule.
B. Electrical plan check and permit fees to the Community Development
Department based on the most current schedule.
C. Sign plan check and permit fees to the Community Development
Department based on the most current schedule.
Within forty-eight (48) hours of approval of the subject project, the
applicant shall deliver to the Community Development Department, a
cashier's check payable to the COUNTY CLERK in the amount of forty-
three dollars ($43.00) to enable the City to file the appropriate
environmental documentation for the project. If within such forty-eight (48)
hour period that applicant has not delivered to the Community
Development Department the above-noted check, the statute of limitations
for any interested party to challenge the environmental determination
under the provisions of the California Environmental Quality Act could be
significantly lengthened.
