APPROVAL OF MINUTES - DECEMBER 13, 2004, PLANNING COMMISSION MEETING. 2. ADOPTION OF RESOLUTION NO. 3942 APPROVING CONDITIONAL USE PERMIT 04-026 TO CONSTRUCT A DRIVE-THROUGH LANE IN CONJUNCTION WITH AN EXISTING 2,983 SQUARE FOOT FAST-FOOD RESTAURANT ON THE NORTHWEST CORNER OF PROSPECT AVENUE AND FIRST STREET. It was moved by Pontious, seconded by Menard, to approve the Consent Calendar. Motion carried 5-0. 3. CONTINUED CONDITIONAL USE PERMIT 04-011 AND DESIGN REVIEW 04-009 TO ALLOW A 2,490 SQUARE FOOT TEMPORARILY PERMITTED MODULAR BUILDING TO REMAIN IN USE FOR TWO (2) YEARS AS A CLASSROOM BUILDING AND TO CONSTRUCT A 5,950 SQUARE FOOT, ONE-STORY, FREE STANDING OFFICE AND MEETING ROOM BUILDING FOR THE CHURCH. THIS PROJECT IS LOCATED IN THE PUBLIC AND INSTITUTIONAL (P&I) ZONING DISTRICT. RECOMMENDATION That the Planning Commission approve Conditional Use Permit (CUP) 04-011 and Design Review (DR) 04-009 by adopting Resolution No. 3935. Asked that the reference on the plans to the modular building as permanent be changed to temporary. Indicated that correction could be made at plan check. Asked if there was an elevation that faced the residential properties. Indicated that elevation is shown on page 2 of Attachment 5 to the staff report. Invited the applicant to the lectern. Aric Gless, architect Stated he was available to answer any questions; and, assured for the project Commissioner Menard that the reference to the modular building would be changed. Don Brockschmidt, 14702 Charloma, Tustin 7:09 p.m. Adopted Resolution No. 3941 7:11 p.m. Ortlieb Nielsen Commended staff and the Planning Commission for their fair hearing and resolution regarding this project. The Public Hearing closed. It was moved by Pontious, seconded by Floyd, to adopt Resolution No. 3935. Motion carried 5-0. 4. CONDITIONAL USE PERMIT 04-029 REQUESTING AUTHORIZATION TO ESTABLISH A TAl CHI MARTIAL ARTS STUDIO WITHIN AN EXISTING 1,500 SQUARE FOOT SUITE IN THE IRVINE INDUSTRIAL COMPLEX PLANNED COMMUNITY. THIS PROJECT IS LOCATED IN THE PLANNED COMMUNITY INDUSTRIAL (PC-IND) ZONING DISTRICT. RECOMMENDATION: That the Planning Commission adopt Resolution No. 3941 approving Conditional Use Permit 04-029. The Public Hearing opened. Presented the staff report. Invited the applicant to the lectern. Minutes - Planning Commission 1-10-05 - Page 2 Wang Zhang, applicant 7:12 p.m. Pontious Nielsen None Director reported Lee Menard Floyd Director Indicated, through his interpreter, that he had no questions; and, thanked staff for their assistance. The Public Hearing closed. Stated this is a good use in the industrial area. Agreed with Commissioner Pontious; and, asked for a motion. It was moved by Pontious, seconded by Floyd, to adopt Resolution No. 3941. REGULAR BUSINESS STAFF CONCERNS 5. REPORT OF ACTIONS TAKEN AT THE JANUARY 3, 2005, CITY COUNCIL MEETING. The City Council approved Final Tract Map 16506, a 63-unit condominium complex on Newport Avenue; the model home permit has been issued. Noted that, while tonight's Planning Commission meeting was quite short, the last meeting of January is expected to be lengthy due to the number of items noticed for that meeting. COMMISSION CONCERNS Indicated he was glad the holidays are over and welcomed everyone back for the new year. Wished everyone a Happy New Year. Welcomed the new Police Chief, Scott Jordan, to the City. Congratulated staff on their pay increase. Added his New Year wishes. Asked if the City had suffered any rain damage. Indicated there had been no significant incidents; two Building Department employees were on standby for the weekend; one was called out to a structure fire; Public Works was on duty all weekend; Loma Ridge contacted the City requesting the necessary measures be taken in preparation for the expected 3-20 inches of rain. Minutes - Planning Commission 1-10-05 - Page 3 Floyd Welcomed his sister and her family to the meeting; and, apologized that they came from sunny Florida only to be met with this rainy weather. Pontious Stated that the preparations and money spent by the City during the buildout of Tustin Ranch were a factor in the water runoff capabilities. Nielsen Noted that he passed under the 1-5 at Red Hill several times without incident. Welcomed the new Police Chief. Asked staff to explain the mention of Mr. Vanderhoff in the City Council Action Agenda. Director Answered that Mr. Vanderhoff was confusing the Planning Commission with staff regarding some permit questions; staff is meeting with Mr. Vanderhoff this week. Floyd Asked what time the new Chief will be sworn in Monday. Director Indicated staff will confirm the time and e-mail the Commissioners. Nielsen Wished everyone Happy New Year. Thanked staff for the reports.
