HomeMy WebLinkAboutPC RES 3728RESOLUTION NO. 3728 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, RECOMMENDING THAT THE CITY COUNCIL ADOPT THE FINAL NEGATIVE DECLARATION AS ADEQUATE FOR CODE AMENDMENT 00-001, AN AMENDMENT TO TUSTIN CITY CODE ARTICLE 9 CHAPTER 2 RELATED TO DRIVEWAYS AND SiTE ACCESS STANDARDS. l0 t3 14 t5 t6 l? 20 2! 22 2.4 2.5 2? 28 The Planning Commission of the City of Tustin does hereby resolve as follows: The Planning Commission finds and determines as follows: A~ That Code Amendment 00-001 related to driveways and site access standards is considered a "project" pursuant to the terms' of the California Environmental Quality Act; B, A Draft Negative Declaration has been prepared for this code' amendment and has been distributed for public review. Gl The Planning Commission of the City of considered evidence presented by the Development Director and other interested respect to the subject Negative Declaration. Tustin has Community parties with C, That the proposed code amendment will not result in any significant impacts and, therefore, no mitigation measures are necessary to reduce any significant impacts to a level of insignificance. II. A Final Negative Declaration, attached hereto as Exhibit A, has been completed in compliance with CEQA and State guidelines. The Planning Commission has considered the information contained in the Negative Declaration prior to recommending approval of the proposed code .amendment and finds that it adequately discusses the environmental effects of the proposed code amendment. On the basis of the initial study and comments received during the public hearing process, the Planning Commission has found there will not be a significant effect on the environment and recommends that City Council adopt the Final Negative Declaration for Code Amendment 00-001. l0 14 l? 20 2! ?.2 2,4 2,? Resolution No. 3728 Page 2 of 2 Further, the Planning Commission finds the code amendment involves no potentia'l for any adverse effects, whether individually or cumulatively, on wildlife resources; and, therefore, recommends that the City Council make a De Minimis Impact finding related to the California State Department Fish and Game Code Section 711.4.
