Planning Commission Report General Plan Conformity Determination June 11, 2019 Page 2 APPROVAL AUTHORITY: Pursuant to Section 65402(b) of the Government Code, the Planning Commission is authorized to determine whether the location, purpose, and extent of the proposed acquisition or disposition of real property by a county is consistent with the General Plan. BACKGROUND AND DISCUSSION: Section 65402(b) of the California Government Code (Planning and Zoning Law) requires a county to submit a request for, and obtain a general plan conformity determination from, the local planning agency prior to acquisition or disposition of real property within the planning agency's jurisdiction. The County of Orange is proposing to convey to the Metropolitan Water District of Southern California the dedication of two (2) easements within the jurisdiction of the City of Tustin in Peter's Canyon Regional Park encompassing Assessor Parcel Number 105-015-21 for pipeline system access purposes to one of their existing facilities to ensure reliability of its water supply and distribution system. The Planning Commission is authorized to determine whether the location, purpose, and extent of the proposed conveyance are consistent with the General Plan. The continued reliability of the existing water supply and distribution system in Peter's Canyon Regional Park is consistent with Goal 8 of the City of Tustin General Plan Land Use Element; which is to ensure that necessary public facilities and services should be available to accommodate development proposed on the Land Use Policy Map. Therefore. the location, purpose, and extent of the proposed conveyance are in conformance with the General Plan CONCLUSION: The location, purpose, and extent of the proposed conveyance is in conformance with the General Plan and staff recommends that the Planning Commission adopt Resolution No, 4386 Jessica A661-1-af i eth A. The Planning Commission does hereby resolve as follows: 1. The Planning Commission finds and determines as follows: A. That the Metropolitan Water District of Southern California (MWD) proposes to accept from the County of Orange the dedication of two easements encompassing Assessor's Parcel Number 105-015-2.1 for access to existing pipeline facilities in Peters Canyon Regional Park. B. That the facility access to ensure reliability of MWD's water supply and distribution system is consistent with Goal 8 of the City of Tustin General Plan Land Use Element, which is to ensure that necessary public facilities and services should be available to accommodate development proposed on the Land Use Policy Map. C. That California Government Code Section 65402(b) provides that a county shall not acquire or dispose of any real properly within the corporate limits of a city until the location, purpose, and extent of the project has been reported by the local planning agency as to the conformity with the applicable, adopted general plan. D. That general plan conformity determinations required by Government Code Section 65402 are not "projects" requiring environmental review pursuant to the California Environmental Quality Act. II. The Planning Commission hereby determines that that the location, purpose, and extent of the proposed conveyance-for the dedication of two permanent easements for access to existing pipeline facilities is in conformance with the Tustin General Plan.
