HomeMy WebLinkAboutPC RES 3789l0 ]4 20 2! 23 24 RESOLUTION NO. 3789 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN APPROVING CONDITIONAL USE PERMIT 00-036 TO AMEND CONDITIONAL USE PERMIT 81-3 THAT ESTABLISHED A MASTER SIGN PLAN FOR THE PROFESSIONAL OFFICE BUILDING LOCATED AT 17542 E. SEVENTEENTH STREET. The Planning Commission does hereby resolve as follows' The Planning Commission finds and determines as follows: Al That a proper application, Conditional Use Permit 00-036, was filed by' David Giglio on behalf of Troy Baydala of AMG Realty Partner services requesting authorization of Conditional Use Permit 00-036 amending Conditional Use Permit 81-3 that established a Master Sign Plan for the professional office building located at 17542 E. Seventeenth Street. B. That the Master Sign Plan is less restrictive than the requirements of the Sign Code as provided for in the Tustin City Code Section 9403(H)(2)(e) for properties of one (1) acre in size. Gl That a public hearing was duly called, noticed and held for said application on June 25, 2001 by the Planning Commission. D,, As conditioned, the proposed use will not be detrimental to health, safety, morals, comfort and general welfare of the persons residing in or working in the neighborhood in that: The number, size, and design of the monument signs are consistent with the sign regulations for commercial districts and are compatible with the design and scale of the building; The number, size, and location of the wall signs would be compatible with the design and scale of the building and consistent with surrounding commercial uses; and, The number, size, and location of the signs would provide adequate visibility for clients traveling along Seventeenth Street. E. That this project is Categorically Exempt pursuant to Class 11, Section 15311 of the California Environmental Quality Act. II. The Planning Commission hereby approves CUP 00-036 amending Conditional Use Permit 81-3 that established a Master Sign Plan for the professional office building located at 17542 E. Planning Commission Secretary 23 2,4 25 2'/ 28 EXHIBIT A CONDITIONAL USE PERMIT 00-036 CONDITIONS OF APPROVAL RESOLUTION 3789 (.1) (1) (1) (1) ~I=NFRA~ 1.1 All signs shall substantially conform with the Master Sign Plan date stamped June 25, 2001, on file with the Community Development Department, except as herein modified,' or as modified by the Director of Community Development in accordance with this Exhibit. The Director of Community Development may also approve minor modifications to Master Sign Program during plan check if such modifications are to be consistent with the provisions of the Tustin City Code and other applicable codes. 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with as specified, subject to review and approval by the Community Development Department. 1.3 Approval of Conditional Use Permit 00-036 is contingent upon the applicant and property owner signing and returning to the Community Development Department a notarized "Agreement to Conditions Imposed" form and the property owner signing and recording with the County Clerk-Recorder a "Notice of Discretionary Permit Approval and Conditions of Approval" form. The forms shall be established by the Director of Community Development, and evidence of recordation shall be prOvided to the Community Development Department. 1,4 The applicant shall hold harmless and defend the City of Tustin from ali claims and liabilities arising out of a challenge of the City's approval for this project. 1.5 Any violation of any of the conditions imposed is subject to the imposition of a civil penalty of $100.00 for each violation and each day the violation exists. The applicant shall be responsible for costs associated with any necessary code enforcement action. (~) (2) (3) (4) $~11RC. All proposed signs shall comply with the approved Master Sign Plan. All signs and their supporting structures shall be enclosed, structurally safe, and maintained in good condition and shall comply with the most current Uniform Building Code, and the National Electrical Code as locally amended. Flickering bulbs, burned out bulbs, and/or broken lights shall be repaired in a period not to exceed 48 hours from the time it is noticed. The entire sign shall not be illuminated until all repairs have been made. All c°nduit, raceways, crossovers, wiring, ballast boxes, transformers, and other necessary equipment for signs shall be concealed. Prior to issuance of any building permits or sign permits payment shall be made of all applicable fees, including but not limited, to, the following. Payment shall be required based upon those rates in effect at the time of payment and are subject to change. A, Building plan check and permit 'fees to the Community Development Department based on the most current schedule. Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of $43.00 (forty-three dollars) to enable the City to file the appropriate environmental documentation for the project. If within such forty-eight (48) hour period the applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened.
