A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN DETERMINING THAT THE LOCATION,
PURPOSE;-AND EXTENT OF A PROPOSED CONVEYANCE OF
THE DEDICATION. OF TWO PERMANENT EASEMENTS FOR
ACCESS TO EXISTING PIPELINE FACILITIES CONFORMS
WITH THE TUSTIN GENERAL PLAN.
The Planning Commission does hereby resolve as follows:
I. The Planning Commission finds and determines as follows:
A. That the Metropolitan Water District of Southern California (MWD)
proposes to accept from the County of Orange the dedication of two
easements encompassing Assessor's Parcel Number 105-015-21
for access to existing pipeline facilities in Peters Canyon Regional
Park.
B. That the facility access to ensure reliability of MWD's water supply
and distribution system is consistent with Goal 8 of the City of Tustin
General Plan Land Use Element, which is to ensure that necessary
public facilities and services should be available to accommodate
development proposed on the Land Use Policy Map.
C. That California Government Code Section 65402(b) provides that a
county shall not acquire or dispose of any real property within the
corporate limits of a city until the location, purpose, and extent of the
project has been reported by the local planning agency as to the
conformity with the applicable, adopted general plan.
D. That general plan conformity determinations required by
Government Code Section 65402 are not "projects" requiring
environmental review pursuant to the California Environmental
Quality Act.
II. The Planning Commission hereby determines that that the location,
purpose, and extent of the proposed conveyance for the dedication of two
permanent easements for access to existing pipeline facilities is in
conformance with the Tustin General Plan.

Easement

The County of Orange is conveying al waterline easement to Metropolitan Water District (MWD),
over Peters Canyon Regional Park. (Assessor's Parcels: 105-615-71 & 105-015-24). The
conveyance is for access purposes (ingress/egress) to one of their existing facilities to ensure
reliability of its water supply and distribution system. See attached reference (maps
As required by Government Code: Section 65402, this is to request that a
determination bu made can the conformance of the proposed County project with
the City's General Nolan.
