HomeMy WebLinkAboutCC RES 89-17010 11 14 15 1(; 17 18 19. 20 21 22 23' 2~ 25 26 27 28 RESOLUTION NO. 89-170 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING VESTING FINAL TRACT MAP NO. 13796 The City Council of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows- A. That Final Vesting Tract Map No. 13796 has been submitted by the Bren Company. B. That a Public Hearing was held by the Planning Commission on April 24, 1989. At this hearing the Planning Commission recommended approval of Vesting Tentative Tract Map 13796 to the City Council. Subsequently, the City Council approved Vesting Tentative Tract Map 13796 on May 15, 1989. C. That the Planning Commission recommended approval of Final Tract Map 13796 to the City Council on November 13, 1989. D. That an Environmental Impact Report (EIR 85- 2 for the East Tustin Specific Plan), as amended, has 'been certified in conformance with the requirements of the California Environmental'Quality Act for the subject project area. E. That the proposed subdivision is in . conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, Development Agreement and Subdivision Map Act as it pertains to the development of residential condominium units. F. The .91 acres of parkland required for this development, was previously dedicated with recordation of Tract 12870. ]0 ]4 ]7 Resolution No. 89-170 November 20, 1989 Page two G. That the City has reviewed the status of the School Facilities Agreement between the'Irvine Company and the Tustin Unified School District, the East Tustin Specific Plan, EIR 85-2, the impacts of Vesting Tentative Tract .13796 on School. District facilities, and reviewed changes in State law, and finds and determines that the impacts on School District facilities, by approval of 'this map are adequately addressed. Ho That the site is physically suitable for the type of development proposed. · I. That the s.ite is physically suitable for the proposed density of development°- Jo That the design of the. subdivision or the' proposed ~mprovements are not 'likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat. K. That the design of the subdivision or the type of improvements' proposed will not conflict with easements acquired by the public-at- large, for access through or use of the property within the proposed subdivision° L. That the design of the subdivision or the types of improvements proposed.are not likely to cause serious public health problems. ,. M. That the Final Map is in substantial conformance with the Tentative Map. Resolution No. 89-170 November 20, 1989 Page three ]0 II. The City Council hereby approves Final Vesting Tract Map No. 13796 subject to final approval of the City Engineer and also authorizes the City Manager and/or City Engineer to execute any subdivision bonds or agreements for the subject parcel.
