SUBJECT: WORKSHOP — FAIR POLITICAL PRACTICES COMMISSION
(FPPC) AMENDED REGULATION
Under the Political Reform Act, public officials may not make, participate in making, or
attempt to use their official positions to influence a governmental decision in which they
know or have reason to know that they have a disqualifying interest. A public official
has a disqualifying interest if the governmental decision, at issue, will have a reasonably
foreseeable, material financial effect on certain interests including an interest in real
property in which the official has a direct or indirect interest worth $2,000 or more.
The Fair Political Practices Commission (FPPC) recently amended FPPC Regulation
18702.2, which provides materiality standards for interests in real property. Most
significantly, the amended regulation establishes three (3) distinct categories for real
properties located:
1 . 500 feet or less;
2. 500 to 1 ,000 feet; and
3. 1 ,000 feet or more from the parcel subject to the governmental decision.
The three (3) distance-based categories create a new standard governing when public
officials have a conflict of interest in governmental decisions effecting interests in real
property.
This workshop would provide the Commission with an overview of the new revised
regulation.
