HomeMy WebLinkAboutCC RES 89-146 RESOLUTION NO. 89-146 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING FINAL TRACT MAP NO. 13627 The City Council of the City of Tustin does hereby resolve: I The City Council finds and determines as follows: A Final Tract Map 13627 has been submitted on behalf of Foothill Communities Builders for the purpose of creating 27 numbered lots and numerous lettered lot subdivision from a portion of Blocks 40, 41, 42, and 66 of Irvine's subdivision as shown on a map thereof filed in Book 1, page 88 of Miscellaneous maps in the office of the County Recorder of the County of Orange, State of California. That the Planning Commission by the adoption of Resolution No. 2671 did recommend to City Council approval of Final Map 13627. The Tentative Map for the project was originally approved by the City Council on June 5, 1989 with the adoption of Resolution No. 89-68. Ce The proposed subdivision is in conformance ordinances, policies and standards of the evidenced by the following findings: with applicable City of Tustin, 1. That the proposed map is General Plan in that: consistent wi th the Tustin Area a Proposed densities and land uses are accordance with the Land Llse Element; identified in b~ Parkland has been identified and accordance with the Recreation Element; a 11 oca ted i n C Provisions for affordable housing as outlined in EIR 85-2 and the Housing Element will be considered at subsequent, project level, subdivision map processing; d Necessary actlons to mi ti gate noise impacts will be required pursuant to the Noise Element, including an analysis of the Browning Corridor. That the proposed map Specific Plan in that: Is consistent wi th the East Tustin ae Provisions of sector processing requirements concerning circulation, grading, drainage, and median and parkway landscape plans relative to Sectors 2, 3 4, 5, and 6 of the East Tustin Specific Plan, Phase IV have been met. That Identified land uses shown upon the subject map are consistent wtth permitted land uses outltned tn the East Tustln Speclflc Plan (Sectlon 3.4) d. That school and park sites have been identified in accordance with the Specific Plan (Section 3.4) 3. That the project as submitted ts consistent wi th the adopted Development Agreement between the City of Tustin and The Irvine Company dated November 3, 1986. 4. That approval and recordation of Tract 13627 is not the final discretionary approval for development within the subdivision. Subsequent subdivision maps will be required prior to development of most lots created by Tentative Tract Map 13627 in conformance with the Subdivision Map Act. 5. That the City has reviewed the status of the School Facilities Agreement between the Irvine Company and the Tustin Unified School District and the Facilities Agreement is consistent with the East Tustin Specific Plan. E. That the site is physically suitable for the type of development proposed. F. That the site is physically suitable for the proposed density of development. G. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habi tat. H. That the design of the subdivision or the type of improvements. proposed will not conflict with easements acquired by the public-at-large, for access through or use of the property within the proposed subdi vision. I. That the .design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. Reso]ution No. 89-146 Page three II. The City Council hereby approves FIna] Tract Map No. 13627 and authorizes the Ctty Manager or Ctty Englneer to execute subdivision bonds and agreements. .
