CONDITIONAL USE PERMIT (CUP) 2019-00009 APPLICANT: Andrea McDooling 3059 Edinger Avenue Property, LLC 3021 Edinger Avenue Tustin, CA 92780 PROPERTY OWNER: Myong Sik Joo MD & Jae Kyung Joo 1992 Trust 1640 Monrovia Avenue, #324 Costa Mesa, CA 92627 LOCATION: 3059 Edinger Avenue REQUEST: A request for a CUP to operate a veterinary clinic, laboratory, research and development and pharmacy uses, with associated tenant improvements within an existing 4,339 square foot tenant space. The project site is located within the Planned Community Industrial (PC-IND)/Jamboree Plaza Planned Community District at 3059 Edinger Avenue. ENVIRONMENTAL STATUS: This project is categorically exempt pursuant to the California Environmental Quality Act (CEQA) Section 15301, Class 1. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 19-005, approving Conditional Use Permit (CUP) 2019-00009 to establish a veterinary clinic with a combination of veterinary specialty and general services, office, laboratory, research and development and pharmacy uses, with associated interior tenant improvements at 3059 Edinger Avenue. Zoning Administrator Agenda July 8, 2019 Page 2 It was noted there were no members of the public in attendance for this item. The Zoning Administrator stated she had reviewed the staff report and did not need a presentation. The Zoning Administrator opened the Public Comments Section of the Public Meeting at 10:02 a.m. Mr. Mike Recupero, representative for the applicant, made favorable comments to staff for working with the applicant on the project. Mr. Recupero commented on the Site Plan included in the staff report, which was slightly different than the site plan presented. He wanted to ensure the site plan presented at the hearing, which included Demkowicz's most recent comments (decreasing signage), would be included in the public record. Staff to ensure the most recent Site Plan is added to the public record. Mr. Recupero also wanted to acknowledge, for the public record, that the project will be entitled as a stand alone facility. At one point, the applicant attempted a shared use with the neighboring facility across the street from the project site. Mr. Recupero stated the importance of the project being "general" or"specialty veterinary" as a stand alone facility and not tied to the neighboring facility. In response to Mr. Recupero's comments, Ms. Binsack stated that all documents associated with 3059 Edinger Avenue, will be associated with that facility alone. She also asked Mr. Recupero if he had reviewed and understood Exhibit E, the Zoning Administrator Action, along with the Conditions of Approval. Mr. Recupero stated he had reviewed and understood the Zoning Administrator Action and the Conditions of Approval. Although he did mention Condition No. 1.8 and stated that he spoke with Assistant Director, Justina Willkom, about this condition and he understood it to be a standard condition that allows the City to ask for a new traffic analysis. He wanted to make sure that Condition No. 1.8 was not specific to his client and that it was a general condition. Per Binsack, Condition No. 1.8 is a standard condition and it is not specific to his client and is included on almost every CUP that is processed through the City. Mr. Amat Tajudin, EBTA Architects, also made favorable comments toward staff in helping with the project. He asked about Condition No. 4.2 b (fees) and if the applicant has to send payment directly to Orange County Health Care Agency. Per Demkowicz, the fee is part of a general condition and it may or may not apply to the applicant. Ms. Andrea McDooling, applicant, also had favorable comments with regards to staff and the project. The Zoning Administrator closed the Public Comments Section at 10:05 a.m. The Zoning Administrator adopted ZAA 19-005. The Public Hearing was adjourned at 10:05 a.m. Zoning Administrator Agenda July 8, 2019 Page 3 REGULAR BUSINESS: None ADJOURNMENT: The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
